STOP!The IL-legal and UN-constitutional “WAR on DRUGS”!

“For informed readers and believers of the Federal Constitution for self-governing by “WE, the people”, no explanation is necessary, for the uninformed, an explanation of the Spirit and Intent of the Framers seems impossible.”

  Our Declaration of Independence and Federal Constitution for self-governing by “WE, the people”, have been studied and analyzed by scholars and intellectuals from around the World for over 225-years and proclaimed the work of GENIUS!

  Does anyone believe or even think that Our Framers and Founders of this still Young Republic “WE” like to call America honestly believe that Our Forefathers would ever draft, create, and endorse a Constitution for self-government by the same Forefathers that would confer Federal Constitutional authority to take-away the Framers and Founders “life, liberty, and property” for possessing, buying, selling, dispensing, or distributing Our Forefathers favorite recreational drink . . .TEA . . . well, do you?  I thought not!

  It is not the subject matter of melons, marijuana, cabbage, cocaine, tomatoes, or TEA that is the issue here friends, it is the People’s Perpetual Protections Secured by Our Constitution for self-government that is the issue here fellow Patriots!

  Believe it when I tell you that Congress has been writing federal criminal statutes for over two hundred years and they know how to legally and constitutionally draft and enact a federal criminal statute ready for the President’s signature.

  To be precise, there is no federal criminal statute that would PROHIBIT, FORBID, or make it UNLAWFUL, for any person at random or targeted by the DEA to buy, sell, use, or abuse, cocaine, marijuana, heroin, or controlled substances, whatever they are now or ever will be, and the Ninety-First Congress didn’t!  One man did!

 

  On December 09, 1975, Mr. Justice LEWIS F. POWELL penned the unanimous Opinion for the Burger Supreme Court that the truncated phrase, “it shall be unlawful for any person” of the OFFENSES and PENALTIES statute, Title 21, United States Code, Section 841, “By its own terms . . .reaches any person[1]!

  Justice POWELL and the Supreme(s) were quite right in their unanimous opinion about Dr. Moore because Dr. Moore’s defense counsel claimed Dr. Moore was a registrant therefore exempt from the ambits of punishment prescribed by Congress for a violation of Title 21, United States Code, Section 841(a)(1) but Justice POWELL should have finished the truncated phrase for the unanimous Opinion that; “By its own terms . . . reaches any person registered”!

  To make matters worse, Mr. Justice POWELL went even further to make his own constructive-implication and conclusion of law that; “§841 was reserved for prosecution of those outside the legitimate distribution chain [and]the severe penalties provided for in §841(b) [are]for those seeking to avoid regulation entirely by not registering”!

  There is not one syllable of language in the text of the Legislative History of Public Law: 91-513, that even suggests that; “the severe penalties provided for in §841(b) [are]for those seeking to avoid registration entirely by not registering”.

  To quote the late guru of Constitution Law from the hill, Senator SAM ERVIN of North Carolina in an acid speech from the floor of the Senate commenting on the Comprehensive Drug Abuse Prevention and Control Act of 1970 said this bill is; “as full of unconstitutional, unjust, and unwise provisions as a mangy hound dog is full of fleas”[2]!

  The Senator was right, there are far too many violations of Constitution Law and American Criminal Jurisprudence practiced in this Republic for over 200-years to elaborate on here, but to that end, I have authored a short synopsis entitled; “NIXON’S REVENGE is a FRAUD!” with adjudicated case cites and official documentation that should be on the shelves around the first of November.

  Meantime, I don’t know how many signatures will be needed for the Members of the House Committee on the Judiciary to take NOTICE of Our issue, but I would like to have at least ONE MILLION of my fellow Citizens sign the below Petition for Investigation by the House of Representatives Committee on the Judiciary!

  Disclaimer— (1) Signatures on this Petition are of the nature of a Constitution Law issue and are not to be construed as a medical-marijuana initiative and neither condones nor condemns the recreational or medical use or abuse of drugs or other substances: (2) The signatures below do not challenge the constitutionality of the OFFENSES and PENALTIES statute § 841 but rather, the signatures below challenge the federal jurisdictional authority in personam for the Executive and Judicial branch of the government of the United States to respectively; arrest, prosecute, hear, convict, and impose the punishment prescribed by the Ninety-First Congress specifically and with purpose of intent, reserved, restricted, and limited to; “[a]ny person who violates subsection (a) of this section. . .” for any person at random NOT registered whose conduct was admitted or found to be; “[i]n violation of Title 21, United States Code, Section 841(a)(1)”.

  The below signatures are the constituents of the House of Representatives, Respectfully Request that this Committee on the Judiciary whose names appear below, Investigate, hold Hearings, and render a conclusion of Constitution Law, whether or not; the clear and plain language of Title 21, United States Code, Section 841, (in relevant part below) reaches any person at random NOT registered by the Attorney General of the United States for federal-jurisdiction to be federally-regulated in the closed commercial system of controlled substances, whatever they are now or ever will be, and “WE, the people” would respectfully remind Our Servants of Public Office listed hereafter, that this is an Election Year!
