Sentencing Postponed in the Charlie Lynch Trial

I spent all afternoon getting geared up to go ballistic over this, only to learn that nothing happened:
The sentencing of Morro Bay, California medical marijuana dispensary owner Charles Lynch has been delayed yet again, this time until June 11. According to producer Ted Balaker, who has followed the Lynch saga from its start, the mood in the courtroom was guardedly optimistic, especially as Judge George H. Wu openly expressed his sympathy for Lynch.

"To be blunt, if I could find a way out, I would," said Wu, referring to mandatory minimum sentencing guidelines that insist Lynch get at least five years in prison. However, Wu summarily dismissed the notion of disregarding the guidelines, claiming it would simply be a "monumental waste of time" because such a decision would be overruled by a higher court. [Reason]
I'm not sure what this postponement means. It's definitely not a bad thing, though. If nothing else, it gives us more time to contact DOJ and the White House in support of Charlie. Please do exactly that. Here's some background for those that need it:

From what i know about the case, Charles C. Lynch should be getting a new trail. The policy is as i understand it to go after people out of compliance with state law. By all accounts at the trial every attempt to bring up state law was blocked.

This seams a huge miscarriage of justice, and that should have president over any guide lines.

Mandatory Minimums Suck

Judge Wu has seen the light but seems caught in the middle of a Bad Law and what is the right thing to do. I just read that the Judge has directed the Lawyers to file briefs on how he can give Charles one yr, with possible home confinement. While I don't think Charles should do any time at all this may be the best he can hope for at this time. Back in 2003 Ed Rosenthal, a prominent marijuana advocate was found guilty but instead of getting any time "U.S. District Judge Charles Breyer released him on probation, saying Rosenthal had reasonably believed he was acting legally. Rosenthal has appealed his conviction."
Hopefully Charles's Lawyer is aware of Ed's case and plans on including it in his brief. If Charles can get Probation or even Home Confinement I'm sure he would be relieved and he can fight in Appeal if he wishes as public sentiment evolves.

One of the things that bothers me the most is that Atty Gen. Holder has yet to provide how the DOJ defines the "New Policy". Until we can see and read the New Policy we are being force to live under a Secret Law. Secret Laws were made illegal by the US Constitution and should be mentioned in the briefs from Lawyers filing in Charles behalf.

I protested, along with my daughter and son-in-law, outside my federal building the day ed was sentenced and obviously feel Charles Lynch should be immediately released from his unlawful detention.

Moreover, I'm the type of person that would support and advocate the rescue of Charles from his unlawful confinement and place those responsible in his place... that shithead sheriff in SLO town comes to mind.

The pot community routinely makes the error that you've made calling illegal marijuana prohibition a 'bad law' instead of what it is... an illegal law... that epitomizes the 'end justifies the means mentality of gods and gov'ts'.

This judge is ready to take a leap - Are Lynch's lawyers?

Ok, so the judge is saying he feels like he has to sentence Lynch to at least a year but he's delaying sentencing and asking for more arguments. In other words, he's asking Lynch's lawyers to give him a reason to throw out the conviction altogether. Now is the time to pull out all the stops on the state's rights, 10th amendment, personal freedom issues etc - time to argue against the federal preemption of state drug laws (or at least marijuana) altogether. The current state of affairs doesn't make sense - judges will be bound to consider medial during the sentencing phase but not the guilt phase, and still have to impose a mandatory minimum (maybe time to attack the mandatory minimum too)? This judge would rather make a clean break with the past, lay down a decision that avoid this whole morass - give him the chance!

Sentencing Charlie Lynch?

Charlie Lynch should only be thanked and rewarded for his beautiful love care and dedicated help to saving peoples lives! The people who are attacking Mr.Lynch should be eliminated from power for operating a terrorist dictatorship which has no right to exist. More proof that prohibitionists are terrorist racketeers who pose as legitimate.

Re "million man march" - force ended the first drug war 1920-33?

Force ended alcohol prohibition? I'm not familiar with that, so maybe I need to be educated. Can you be more specific about what you are referring to? I thought it was ended mainly by public perception that it was a failure, causing more problems than it solved, including seriously eroding respect for the law.

A combination head/militia march sounds very interesting though.
