Minorities Must be Criminals, Otherwise There Wouldn't Be So Many of 'Em in Prison

New DOJ data confirming that minorities receive harsher treatment than whites during traffic stops came as no surprise to us. Last week I discussed the study, warning that DOJ's poor reporting could embolden racial profiling apologists, despite the obvious disparities revealed in the data. Unfortunately, I was right.

Profiling skeptic Steve Chapman now exploits DOJ's report in a widely published editorial that's as sloppy as it is wrong:
Why would black drivers be arrested more often? Maybe because African-Americans commit crimes at a far higher rate and are convicted of felonies at a far higher rate. In 2005, for instance, blacks were nearly seven times more likely to be in prison than whites.
This is textbook circular reasoning of the sort that will earn you an F in Philosophy 101. By Chapman's logic, police could stop investigating white people entirely and we'd soon see that minorities commit 100% of all crimes.

By relying on the argument that increased searches of minorities are justified by their criminality, Chapman exposes his own unfamiliarity with the data he's discussing. The previous DOJ report, released in 2005, addresses this issue directly:

Searches of black drivers or their vehicles were less likely to find criminal evidence (3.3%) than searches of white drivers (14.5%), and somewhat less likely than searches of Hispanic drivers (13%).
This data comes straight from a report referenced by Chapman, yet he insists that "a motorist of felonious habits is also more likely to have illegal guns or drugs on board," and "the average black driver is statistically more likely to be a criminal than the average white driver."

The great irony here is that Chapman offers his made up statements about the heightened criminality of minorities while arguing that racial profiling doesn’t exist. His premise fundamentally endorses profiling and any officer who agrees with him is highly vulnerable to the exact behavior Chapman denies. It is really just priceless to find gratuitous racial stereotypes in an article about how the days of gratuitous racial stereotyping are behind us.

The police this year led the media to believe greater numbers of police would be present, but told us that there would be less. That made us distrustful, but at the event there were significantly less police. I estimate half the strength of last year. For reasons of their own, they wanted the public to think otherwise. The saliva testing Winnebago barely appeared, while we had a drug-wipe saliva testing kit make a false amphetamine positive as the ABC was recording the demonstration. We hope they use the recording. We believe the Winnebago may prove to be a white elephant, or a millstone, or both. We feel that this was one of the best organised MardiGrass weekends we have presented. We concentrated on running a full program in Peace Park, without gaps in activities so that people would be less prone to wandering away leaving a less attractive half filled venue. This year the nights were not as cold, and that helped make the night time program more enjoyable and better attended. The weather was good, and everything ran smoothly. In events using volunteers conflicts between members can emerge or some members may attempt to dominate, creating frictions that undermine morale and impede progress. We had an exceptionally trouble free MardiGrass Organising Body this year, and were blessed with exceptional MardiGrass volunteers from all over the world. I cannot praise their group spirit and dedication enough. They did everything asked, and came back for more. While last year's excessive police presence may have deterred some people, the people who came together for the 2007 MardiGrass were more determined than ever to show that we are no danger to anything, and that we are not criminals. The police have not deterred us, but united us. In 1937 there was a reefer madness campaign, which convinced millions of otherwise sensible people that cannabis caused instant insanity lust and murder. A new reefer madness campaign began in 2004, which left out the lust and murder, and reduced the number of instantly insane. The original reefer madness campaign created a prejudice, and the new reefer madness campaign seeks to sustain that prejudice through selective quotation, exaggeration and distortion of research. The truth will out eventually. The Nimbin Hemp Embassy and Nimbin MardiGrass will continue to oppose these unjust laws. The HEMP Olympix filled Peace Park this year as its reputation grows. Bob the Builder and Smurf set a new joint world record in the Speed Roll (3 papers plus filter) of 15 seconds in a tie for the Green Medal. In the roll off, Bob won in 17 seconds after Smurf stumbled. Bob also won the Green Medal again in the Artistic Roll this year, with a ‘rainbow coloured roses’ joint. The Growers’ Ironperson Event Green Medal was won by local lad Ruben in 71 seconds. The Womens’ won by Lily from France in 101 seconds. To the Editors: Jason DeParle's thoughtful and wide-ranging overview of American incarceration policy and its consequences hardly mentions rape in detention. Yet this is not a rare or trivial part of life behind bars. Neither is it, as some believe, an inevitable one. Prisoner rape has been largely ignored: by journalists, advocates, policymakers, and researchers. The available data therefore, especially on its frequency, are not very good. Still, it is possible to have some notion of the problem's magnitude. Recent studies of prisons in four midwestern states suggest that approximately 20 percent of male inmates are pressured or coerced into unwanted sexual contact; approximately 10 percent are raped.[1] Rates of sexual abuse in women's facilities, where the perpetrators are most likely to be male staff, seem to vary more by institution but are as high as 27 percent of inmates.[2] Since the US now incarcerates more people than any other country, both relative to population and in absolute terms, these percentages translate into horrifying real numbers. The congressional authors of the Prison Rape Elimination Act of 2003 (PREA), which DeParle does mention (and which is the only piece of federal legislation ever to address the issue), estimate in the bill's "Findings" section that in the twenty years preceding its passage over one million inmates were victims of sexual abuse in American facilities. That number should be recognized as something of a guess; but in the absence of more authoritative studies, it does not seem unreasonable. Prisoner rape is arguably this country's most serious human rights problem.

Constitutional Challenge of Canada's Medical Cannabis Program

Contact: Philippe Lucas, tel: 250-884-9821, E: [email protected] or Kirk Tousaw, tel: 604-836-1420, E: [email protected] In May of 2004, the Vancouver Island Therapeutic Cannabis Research Institute (VITCRI), a research and cultivation facility overseen by the Vancouver Island Compassion Society, was raided by the West Shore RCMP. Mat Beren and Michael Swallow were charged with multiple counts of cannabis production, and over 900 plants were seized and destroyed, temporarily leaving the critically and chronically ill members of the VICS without a safe source of medicine. The ensuing court case and Constitutional challenge - which is taking place from May 9th-18th in B.C. Supreme Court, 850 Burdett Avenue - will establish that the federal medical cannabis program is violating the constitutional rights of critically and chronically ill Canadians by a) unnecessarily restricting access to the program; b) supplying an inadequate source of cannabis; and c) instituting arbitrary limitations on production and distribution. "This ineffective, onerous and expensive program has long been an impediment to safe access" says Philippe Lucas, a medical cannabis user and founder of the VICS, "and clearly isn't protecting Canada's sickest citizens from arrest for their use of medical cannabis". The VICS legal team consists of Mr. John Conroy QC from Abbotsford, BC, and Mr. Kirk Tousaw. Witnesses for the defense include Senator Pierre-Claude Nolin (chair of the Senate Special Committee on Illegal Drugs), Dr. Robert Melamede (Biology professor at the University of Colorado, Colorado Springs). "We look forward to challenging the constitutionality of these regulations and demonstrating to the court that Health Canada is not meeting its obligations to Canada's critically and chronically ill", says Mr. Tousaw. If successful, this challenge will make the legal medical use of cannabis more accessible, and potentially legalize the community-based distribution of cannabis. A similar challenge in Ontario from 2003 resulted with the courts striking down the prohibition on the recreational adult use of cannabis in Ontario, thereby legalizing the personal use of cannabis for over 18 months. This case may lead to a similar outcome in B.C.

Initial Reports on the Global Marijuana Marches

DRCNet bumper sticker on a car at the SF marijuana march I'll be writing this week about the Global Marijuana Marches that were set to take place in 232 cities Saturday. I drove into San Francisco for the event there, and I've gathered some initial reports from around the globe. Look for a full run-down in the Chronicle on Friday. Saturday was glorious in San Francisco, with sunny skies and temperatures in the 70s. San Francisco's version of the global marijuana march, Cannabis Awareness Day, was at City Hall plaza, where rows of vendors and exhibitors bracketed the crowd and local bands blasted rock, surf, pop, and rhythm & blues at the crowd. The San Francisco event was long on music, short on rhetoric—"We've heard all that pot talk before," said one organizer from the stage—and extremely mellow. What pot politics there was came around making too much money off the dispensaries, with some speakers warning that the greedy would be weeded out. Jack Herer held court in one tent as star-struck fans sought autographs and pictures. There was lots of open pot-smoking, and not a policeman in sight all afternoon. It was like a lovely afternoon in the community park. Things weren't so mellow in Eastern Europe. In Sofia, Bulgaria, police dispersed a crowd of about 400 demonstrators, blocking the event from taking place. It was worse in Moscow, Russian police attacked ralliers, arrested 30 and beating others. Some have already been sentenced to jail time. In Prague, by contrast, authorities stood aside as about 1500 held a pot party at Letna Plain. The largest rally reported so far was in Toronto, where "Prince of Pot" Marc Emery led a crowd of about 20,000 in calling for freeing the weed. I haven't heard anything from other European capitals or the big cities of Latin America yet. Meanwhile, down under at the Nimbin Mardi Grass festival in Austalia, police reported more than 100 arrests, 60 of them for marijuana, among the more than 7,000 festival-goers. Video Showing Field Drug Test False Positives for Many Different Soaps

In the aftermath of the infamous "soap bust" of drummer Don Bolles of "The Germs" fame, Dr. Bronner's has released a video showing the NarcoPouch field drug test coming up with false positives for a range of natural soap products. The results prove that the test kit which was used to jail Don Bolles, drummer for the legendary punk band The Germs on April 4, will always give a false-positive for the drug GHB (Gamma Hydroxy Butyrate) if used on any true natural soap. However, in an interesting twist, the test will test negative for fake mislabeled "liquid soap" products that are actually detergent-based, not soap. "The NarcoPouch® 928 is a great test for determining if a product labeled 'Soap' actually contains real soap or not. It's ironic that the flawed GHB field test used by cops shows in a graphic immediate way true versus fake soaps. Fortunately for Don Bolles, the much more accurate confirmation drug-testing by the Orange County crime lab proved our soap did not contain the drug GHB." Detergents in fake soap products are usually made in part or even entirely from petroleum along with vegetable feedstocks. For instance, Sodium Myreth Sulfate, the main ingredient in JASON's so-called "Pure, Natural, & Organic Soap" is made by attaching ethylene oxide groups from petroleum to vegetable fatty acid, which also produces trace 1,4 dioxane as a side reaction. Olefin Sulfonate, the main ingredient in both Nature's Gate ORGANICS "Soap" and Kiss My Face ObsessivelyOrganic "Soap", is made entirely from petroleum. Cocamidopropyl Sultaine, the main ingredient in EO's so-called soap, is in significant part petroleum-based. Bronner laments: "Companies mislead consumers in conflating their detergent-based products with ecological biodegradable soaps, even calling these synthetic detergent products 'organic'. Dr. Bronner's Magic Soaps are real soaps made from real organic oils, while these other so-called 'Soap' products are detergents made from petroleum and conventional vegetable material. They are not soap, they are not organic, they are not natural." The crime lab confirmation test that exonerated Don Bolles and Dr. Bronner's soaps of GHB, uses the GC-MS method which is much more accurate than the field drug test kits used by the Newport Beach Police. "Police departments nationwide should immediately stop using the ODV, Inc. field test for GHB as it is not accurate when used on soaps and who knows what other common household products," said Bronner. ODV, Inc, maker of NarcoPouch® 928 Inc is a subsidiary of Armor Holdings, Inc. The company has done nothing to alert police departments about the false positives when used on natural soap. According to retired FBI agent and forensics expert Dr. Frederick Whitehurst, "There is no effort by the National Academies of Science to validate forensic science protocols and there are no national standards for presumptive field drug tests. Drugs to Vaccinate You... Against Drugs!

My friend Grant Smith over at Drug Policy Alliance has commented on NIDA research to develop vaccinations and the philosophical implications of "robbing entire future generations of the basic human right to have freedom of choice and sovereignty over their bodies and minds." As a follow-up, I'd like to point out here the danger from a straight medical perspective. The questions of whether a vaccine will work, what its side effects may be, and what the likelihood is of experiencing such side effects are questions that go along with the development of any new medication. But there is something fundamentally different -- medically and scientifically -- about the concept of a vaccine to permanently disable a person from experiencing the effects of ingesting a drug. First, the neurological system that goes to work when one tries to "get high" is intimately tied to the rest of our neurology -- getting a thrill from chocolate or a rush from exercise, for example, involves some of the same chemical interactions in the brain that are involved in smoking a cigarette or snorting cocaine. I'm not saying that the acts are the same, but they are biochemically similar and related. They have to be -- each of us only has one brain, after all. Second, most drugs, both legal and illegal, either are used medically now or are highly similar to drugs that are used medically now. Cocaine and methamphetamine are both schedule II substances -- highly regulated, but used in medicine. Meth is from the same family as the widely used Ritalin. Heroin is a close variant of morphine. I don't know of current medical uses for nicotine, but I don't think it can be categorically ruled out for all time. Could a vaccination to block the euphoric effects of these drugs interfere with the ability of the same or similar drugs to produce the medical benefits for which they are also used? The only way to really know for sure is to do test people for it. But because only a fraction of all children go on to experience the medical problems that would be treated by the drugs, to do such a test and have sufficient data for it to be meaningful would require vastly expanding the number of kids who have to be given the vaccination initially as part of the research. And possibly excepting Ritalin use, the data would not come in for several decades, because most people acquire the afflictions for which the medications are used late in life. So in addition to the disturbing philosophical implications that Grant has explored, I really see this direction as inherently reckless from a straight medical perspective -- there is just no truly reliable way to know whether the treatment administered to toddlers or grade-schoolers now could put them in a box with respect to medical treatment down the road -- there's just no feasible way to gather enough data in advance, and if we did we might still not find out for 70 years. Rank this one right up there with the drug-fighting franken-fungus -- don't go there!

Following is an update from Moscow on the police brutalization and free speech violation committed by authorities against marijuana march participants. (Click here to read the first update received this weekend.) - Dave Dear sisters and brothers! Thank you for your assistance and attention to Russian problems with human rights. Below there is new information about events with cruel breaking up of Marijuana march in Moscow: All cannabis activists were unlawfully sentenced by Moscow district court! As I earlier informed all arrested cannabis activists were delivered at The Presnentsky administrative district court of Moscow City. Not only participants of Marijuana march were accused but also other people who were sympathized them. The Judge has worked during the whole night without the rest. She has hypocritically convicted demonstrators according to The Russian Administrative law for the propaganda of drugs (...and bla-bla-bla). No one of councels for the defence was allow in the process. Finally some of activists were sentenced for 15 days of arrest. Other ones were nominated money fine. On juridical commentary all accusations are unlawfully. There are not simply disproportionate sentences, but sentences absolutely fixed by lawlessness. Here is that Ivan Ninenko who is the protector of activists has told: I just returned from the court versus delayed on the March for Legalize MJ and people who sympathized them near police department named "ARBAT". They all were accused according articles 19.3 (non-obedience to legal requirements of employees to militias), 6.13 (propaganda of narcotics) and 20.2 (overset of undertaking of meeting, demonstration and picketing). The judge listened the case during the whole night from 9 P.M. to 9 A.M. Total: Three girls - a fine on 4500 rubles. Sergey Konstantinov - 15 days of arrest and the fine on 3500 rubles. To every another 6 lads (list later) - 10 day of arrest and the fine on 3500 rubles. Now I'm going to sleep because I'm very tired. Such unlawfulness that I never saw! Brothers and sisters, friends, this is never mind what kind of the march is this and as you are to take to it. More so, some guys were delayed not on the march, but beside a police department "Arbat". BUT it is IMPORTANT to spread this information over the World into the name of God and for liberties of people and human right.
