And then there were two. A group of Northern California attorneys, activists, and at least one prominent medical marijuana doctor Friday filed the text for a second marijuana legalization initiative aimed at the 2012 election in Sacramento Friday.
Anyone possessing, growing or otherwise involved with less than three pounds of pot would face no taxes. The Department of Public Health would have 180 days to come up with regulations for cannabis commerce.
The initiative is being backed by some familiar Northern California faces. Official proponents for the measure are Santa Rosa criminal defense attorney Joe Rogaway, Sebastopol criminal defense attorney Omar Figueroa, Oakland medical marijuana attorney Bill Panzer, Mendocino County medical marijuana activist Pebbles Trippet, and Berkeley-based medical marijuana physician Dr. Frank Lucido.
The repeal initiative is the second legalization initiative to get moving this year. Late last month, the Regulate Cannabis Like Wine initiative, filed by Libertarian Party and marijuana activist Steve Kubby and former Orange County Superior Court Judge Jim Gray, was approved to begin signature-gathering.
Observers are also waiting to see what will happen with the folks behind last year's Proposition 19 campaign, which came achingly close to victory with more than 46% of the vote. They are still keeping mum, despite rumors they will wait until 2016 because of a lack of funds and poor polling results.
Any legalization initiative will face the huge hurdle of actually gathering enough valid voter signatures to make the ballot. It will take more than 504,000 valid signatures to get on the ballot, and repeal initiative organizers estimate it will take $1.25 million just to gather the signatures.
And then there were two. Before this is over, there could be one or two more. Now, it becomes a matter of who can come up with the money to get one (or more) on the ballot for November 2012.

Regulate Marijuana Like Wine â an excellent initiative
Without question, the Regulate Marijuana Like Wine Act of 2012 is the most thoughtful, comprehensive, well crafted piece of legislation that I have seen in a long time (on just about any subject, for that matter). Read the full text here:

Frankly, it is curious to me why MPP, DPA, ASA DRC, SSDP, NORML etc. have not yet been more vocal and energetic in their support of this fine act. 'Vocal' and 'energetic' would mean to me providing a constant, upfront, easily found link to the RMLW website, constantly mentioning it, encouraging support including volunteer activity and monetary donations. Of course, I know that y'all have your own agendas, and of course do your own fundraising, but to my mind, RMLW has the greatest chance to succeed, addresses all of the problems with Prop 19, and completely protects medical marijuana patients and industry.
What I particularly like in this bill (besides its medical marijuana protections, and promotion of hemp agriculture) is the restriction against any commercial advertising of "get you stoned" pot.
This is extremely significant because it is the one factor which will prevent the "Mordor-ization" of the recreational cannabis industry. Large corporate interests will be hamstrung if they are not allowed to push their "brands" through commercial ads. This one restriction will allow mom and pop growers to continue on with the lifestyles they've chosen, as word-of-mouth advocacy is the means by which they have always achieved "brand" loyalty.
Hell, it might even please the MERP guys.
If this initiative succeeds, and it has all the potential to do so, it will break the back of the prohibition drug war once and for all, and that is what we are all about. Come on DRCnet, lead the charge. It's not gonna get better than this.

No state initiative will over ride the Commerce Clause but this is only for exchanges, sales or charity. Not individuals growing a reasonable amount for themselves. These laws will protect individuals from federal and state persecution, unless they sell it. The Raich case established the precedent to permit the IRS to bust Buyers Clubs, not the DEA. Same as CA and Alaska have in place. MMJ laws restrict individuals according to state law, not feds. Potentially more draconian in some states with high vested ignorance in profits on perpetuating the Ganjawar. Obama hasn't done anything he isn't allowed to do. Protesting Obama for fiction and wishful thinking is the same as fiction Rmoney's Neocons put out on purpose.
