How the Global Drug War’s Victims Are Fighting Back [FEATURE]

Despite significant advances made by governments around the world in humanizing drug control systems since the turn of the century, human rights abuses still seem to be taking place in the course of enforcing drug prohibitions in recent years and, in some cases, have only gotten worse.

The United States continues to imprison hundreds of thousands of people for drug offenses and imposes state surveillance (probation and parole) on millions more. The Mexican military rides roughshod over the rule of law, disappearing, torturing, and killing people with impunity as it wages war on (or sometimes works with) the infamous drug cartels. Russia and Southeast Asian countries, meanwhile, hold drug users in "treatment centers" that are little more than prison camps.

A virtual event last summer, which ran parallel to the United Nations High-Level Political Forum on Sustainable Development, shined a harsh light on brutal human rights abuses by the Philippines and Indonesia in the name of the war on drugs and also highlighted one method of combating impunity for drug war crimes: by imposing sanctions on individuals responsible for the abuses.

The event, "SDG 16: The Global War on Drugs vs. Rule of Law and Human Rights," was organized by DRCNet Foundation, the 501(c)(3) charity operated by StoptheDrugWar.org, publisher of this newsletter. The "SDG 16" refers to Sustainable Development Goal 16 -- Peace, Justice, and Strong Institutions -- of the UN's 2030 Agenda for Sustainable Development.

Event organizer and executive director of the organization David Borden opened the meeting with a discussion about the broad drug policy issues and challenges being witnessed on the global stage.

"Drug policy affects and is affected by many of these broad sustainable development goals," he said. "One of the very important issues is the shortfall in global AIDS funding, especially in the area of harm reduction programs. Another goal -- Peace, Justice, and Strong Institutions -- is implicated in the Philippines, where President [Rodrigo] Duterte was elected in 2016 and initiated a mass killing campaign admitted by him -- although sometimes denied by his defenders -- in which the police acknowledged killing over 6,000 people in [anti-drug] operations [since 2016], almost all of whom resisted arrests, according to police reports. NGOs put the true number [of those who were] killed at over 30,000, with many executed by shadowy vigilantes."

The International Criminal Court (ICC) has proposed a formal investigation of human rights abuses in the Philippines drug war, but the court seems hampered by a chronic shortfall in funding, Borden pointed out.

"Former prosecutors have warned pointedly on multiple occasions of a mismatch between the court's mission and its budget," he said. "Recent activity at the conclusion of three different preliminary investigations shows that while the prosecutor in the Philippines moved forward, in both Nigeria and Ukraine, the office concluded there should be formal investigations, but did not [submit] investigation requests, leaving it [up to the] new prosecutors [to decide]. The hope is [that the ICC] will move as expeditiously as possible on the Philippines investigation, but resources will affect that, as will the [Philippine] government's current stance."

The government's current stance is perhaps best illustrated by President Duterte's remarks at his final State of the Nation address on July 26. In his speech, Duterte dared the ICC to "record his threats against those who 'destroy' the country with illegal drugs," the Rappler reported. "I never denied -- and the ICC can record it -- those who destroy my country, I will kill you," said Duterte. "And those who destroy the young people of my country, I will kill you, because I love my country." He added that pursuing anti-drug strategies through the criminal justice system "would take you months and years," and again told police to kill drug users and dealers.

At the virtual event, Philippines human rights advocate Justine Balane, secretary-general of Akbayan Youth, the youth wing of the progressive, democratic socialist Akbayan Citizens' Action Party, provided a blunt and chilling update on the Duterte government's bloody five-year-long drug war.

"The killings remain widespread, systematic, and ongoing," he said. "We've documented 186 deaths, equal to two a day for the first quarter of the year. Of those, 137 were connected to the Philippine National Police, the Philippine Drug Enforcement Agency, or the armed forces, and 49 were committed by unidentified assailants."

The "unidentified assailants" -- vigilante death squads of shadowy provenance -- are responsible for the majority of killings since 2016.

"Of the 137 killed, 96 were small-time pushers, highlighting the fact that the drug war is also class warfare targeting small-time pushers or people just caught in the wrong place or wrong time," Balane said.

He also provided an update on the Duterte administration's response to ICC Prosecutor Fatou Bensouda's June 14 decision concluding her preliminary examination of human rights abuses in the Philippine drug war with a request to the ICC to open a formal investigation into "the situation in the Philippines."

In a bid to fend off the ICC, in 2020, the Philippine Justice Department announced it had created a panel to study the killings carried out by agents of the state -- police or military -- but Balane was critical of these efforts.

"[In the second half of 2020], the Justice Department said it had finished the initial investigations, but no complaints or charges were filed," he said. "They said it was difficult to find witnesses [who were willing to testify about the killings], but [the victims'] families said they were not approached [by the review panel]."

The Justice Department is also undercutting the Philippine Commission on Human Rights, an independent constitutional office whose primary mission is to investigate human rights abuses, Balane pointed out.

"The Justice Department said the commission would be involved [in the investigation process by the panel], but the commission says [that the] Justice [Department] has yet to clarify its rules and their requests have been left unanswered," Balane said. "The commission is the constitutional body tasked to investigate abuses by the armed forces, and they are being excluded by the Justice Department review panel."

The Justice Department review is also barely scraping the surface of the carnage, Balane said, noting that while in May the Philippine National Police (PNP) announced they would be granting the review panel access to 61 investigations -- which accounts for less than 1 percent of the killings that the government acknowledged were part of the official operations since 2016 -- the PNP has now decreased that number to 53.

"The domestic review by [the] Justice [Department] appears influenced by Duterte himself," said Balane. "This erodes the credibility of the drug war review by the Justice Department, which is the government's defense for their calls against international human rights mechanisms."

The bottom line, according to Balane, is that "the killings continue, they are still systematic, and they are still widespread."

In Indonesia -- where, like Duterte in the Philippines, President Joko Widodo (Jokowi) also declared a war on drugs in 2016 -- it is not only extrajudicial killings that are the issue but also the increasing willingness of the government to resort to the death penalty for drug offenses.

"Extrajudicial killings [as a result of] the drug war are happening in Indonesia," said Iftitahsari, a researcher with the Indonesian Institute for Criminal Justice Reform, who cited 99 extrajudicial killings that took place in 2017 and 68 that happened in 2018, with a big jump to 287 from June 2019 through June 2020. She also mentioned another 390 violent drug law enforcement "incidents" that took place from July 2020 through May 2021, of which an estimated 40 percent are killings.

"The problem of extrajudicial killings [in Indonesia] is broader than [just] the war on drugs; we [also] have the problem of police brutality," Sari said. "Police have a very broad authority and a lack of accountability. There is no effective oversight mechanism, and there are no developments on this issue because we have no mechanisms to hold [the] police accountable."

Indonesia is also using its courts to kill people. Since 2015, Sari reported, 18 people -- 15 of them foreigners -- have been executed for drug offenses.

"In addition to extrajudicial killings, there is a tendency to use harsher punishment, capital punishment, with the number of death penalties rising since 2016," she said.

Statistics Iftitahsari presented bore that out. Death penalty cases jumped from 22 in 2016 to 99 in 2019 and 149 in 2020, according to the figures she provided during the virtual event.

Not only are the courts increasingly handing down death sentences for drug offenses, but defendants are also often faced with human rights abuses within the legal system, Sari said.

"Violations of the right to a fair trial are very common in drug-related death penalty cases," she said. "There are violations of the right to be free from torture, not [to] be arbitrarily arrested and detained, and of the right to counsel. There are also rights violations during trials, including the lack of the right to cross-examination, the right to non-self-incrimination, trial without undue delay, and denial of an interpreter."

With authoritarian governments such as those in Indonesia and the Philippines providing cover for such human rights abuses in the name of the war on drugs, impunity is a key problem. During the virtual event's panel discussion, Scott Johnston, of the U.S.-based nonprofit Human Rights First, discussed one possible way of making human rights abusers pay a price: imposing sanctions on them individually, especially under the Global Magnitsky Act.

That US law, which was based on one enacted in 2012 to target Russian officials deemed responsible for the death of Sergei Magnitsky in a Russian prison, was expanded in 2016 to punish human rights violators around the globe by freezing their assets or denying them visas to enter the United States. A related law known by its spot in the US Code, "7031(c)," can also be used to deny visas to immediate familly members of the alleged abusers.

"In an era [when]... rising human rights abuses and also rising impunity for committing those abuses [are]... a hallmark of what's happening around the world, we see countries adopting these types of targeted human rights mechanisms [imposing sanctions] at a rate that would have been shocking even five or six years ago," said Johnston. "Targeted sanctions [like the Global Magnitsky Act] are those aimed against specific individual actors and entities, as opposed to countrywide embargos," he explained.

The Global Magnitsky program is one such mechanism specifically targeted at human rights abuses and corruption, and the United States has imposed it against some 319 perpetrators of human rights abuses or corruption, Johnston said. (The most recent sanctions imposed under the act include Cuban officials involved in repressing recent protests in Cuba, corrupt Bulgarian officials, and corrupt Guatemalan officials.)

"We've seen a continued emphasis on using these tools in the transition to the Biden administration, with 73 cases [of sanctions having been reported] since Biden took office," he noted.

And it is increasingly not just the United States.

"The US was the first country to use this mechanism, but it is spreading," Johnston said. "Canada, Norway, the United Kingdom, [and] the European Union all have these mechanisms, and Australia, Japan, and New Zealand are all considering them. This is a significant pivot toward increasing multilateral use of these mechanisms."

While getting governments to impose targeted sanctions is not a sure thing, the voices of global civil society can make a difference, Johnston said.

"These are wholly discretionary and [it]... can be difficult to [ensure that they are]... imposed in practice," he said. "To give the U.S. government credit, we have seen them really listen to NGOs, and about 35 percent of all sanctions have a basis in complaints [nonprofits]... facilitated from civil society groups around the world."

And while such sanctions can be politicized, the United States has imposed them on some allied countries, such as members of the Saudi government involved in the killing of U.S.-based journalist Jamal Khashoggi and in cases of honor killings in Pakistan, Johnston noted.

"But we still have never seen them used in the context of the Philippines and Indonesia."

Maybe it is time.

Philadelphia Ban on Pre-Hire Marijuana Testing Takes Effect on January 1. An ordinance passed by the city council in April and signed into law by Mayor Jim Kenney (D) that bars employers from requiring potential hires to submit to pre-employment testing for marijuana will go into effect on January 1. The ban does not address testing of current employees, nor does it stop employers from firing people for being high on the job or having marijuana at the workplace. There are some exceptions to the ban: law enforcement positions, jobs requiring a commercial drivers license, and child care and health care workers.

St. Louis Mayor Signs Bill Repealing Marijuana Laws. Mayor Tishaura Jones (D) has singed Board Bill 132, which repeals the city's laws related to the possession of small amounts of marijuana and paraphernalia. "We are seeing a major shift in the way our country sees not just marijuana, but how it connects to public safety, incarceration, and economic opportunity in our communities," said Mayor Jones. "This law will help reduce racial disparities in our policing, make our city safer, and make St. Louis more competitive in hiring for city positions." Of 600 people arrested on marijuana charges in the city in the last three years, nearly 500 were black, the mayor's office said.

Haiti's Leader Kept a List of Drug Traffickers; His Assassins Came for It. Assassinated Haitian President Jovenal Moïse was moving against drug and arms smugglers, and that may be what is behind his murder, The New York Times reports: "Before being assassinated in July, he had been working on a list of powerful politicians and businesspeople involved in Haiti's drug trade, with the intention of handing over the dossier to the American government, according to four senior Haitian advisers and officials tasked with drafting the document.

The president had ordered the officials to spare no one, not even the power brokers who had helped propel him into office, they said -- one of several moves against suspected drug traffickers that could explain a motive for the assassination." When the gunmen who killed him burst into his residence, they stayed long enough to search through his files for his list of suspected drug traffickers, which one of the captured gunmen said was a key target.

"I would be a fool to think that narco-trafficking and arms trafficking didn't play a role in the assassination," said Daniel Foote, who served as the US special envoy to Haiti before stepping down last month. "Anyone who understands Haiti's politics or economics understands this." Some of the traffickers are linked to former President Michel Martelly, and his brother-in-law, Haitian businessman Charles Saint-Remy, at whom many fingers are being pointed, has been named by the DEA as a suspected drug trafficker.

Malta Set to Legalize Marijuana This Week, Would Be First in Europe. The Maltese parliament is set to approve a marijuana legalization bill Tuesday that the president has already promised to sign into law. People 18 and up could possess up to seven grams (a quarter ounce) and grow up to four plants. Home growers could possess up to 50 grams of their harvest at home. The bill does not envision commercial sales, but instead would allow for non-profit cooperatives to grow and distribute marijuana to members.

Massachusetts Poll Finds Majority Think Marijuana Legalization Has Been a Good Thing. Five years after voters approved legal weed, a new University of Massachusetts Amherst/WCVB poll shows strong continuing support for marijuana legalization in the Bay State. The poll found 61% of respondents said legalization has been a net positive for the state, 25% said it was neither positive nor negative, and only 13% said it was negative. "This poll also shows that legalization is reducing the stigma historically associated with cannabis, which will only enable the Commission to continue making headway on efforts to ensure full participation in this industry by disproportionately harmed communities," Cannabis Control Commission Chairman Steven J. Hoffman said in a statement. "Our work is far from done, and my colleagues and I will continue to be vocal about the solutions that are needed to ensure Massachusetts meets its equity mandate."

Medical Marijuana

Pennsylvania Regulators Order Review of Medical Marijuana Vape Products. The state Health Department has ordered a review of "all vaporized medical marijuana products containing additional ingredients." Growers and processors licensed by the state must submit samples of vape products containing "anything that alters the dosage level, color, appearance, smell, taste, effect or weight of the medical marijuana." The department is also warning against additives not yet approved by the FDA: "If you are producing any vaporized medical marijuana products that contain additional ingredients that are not approved by the (U.S. Food and Drug Administration) for inhalation, you MUST recall these products pursuant to 28 Pa. Code 1151.42(c)." But the Pennsylvania Cannabis Coalition, representing medical marijuana licensees said the vape products had already won state approval.

Mexico Draft Marijuana Legalization Bill Being Circulated. A draft marijuana legalization bill is now being circulated among senators, with a top lawmaker saying a vote could come by December 15. The bill has yet to be formally introduced, but the draft is largely similar to the bill the Senate passed late last year. The Supreme Court three years ago held that the prohibition of marijuana possession and cultivation was unconstitutional, but the Congress has repeatedly failed to meet court deadlines to implement legalization, leading the court last year to vote to end criminalization on its own. But that still leaves the need for a structure for legal marijuana markets unmet and that's what the politicians are struggling with.

Mexico Cartel Violence Continues to Plague North Central States. Even though the country's murder rate -- largely driven by prohibition-related violence -- is finally set for a slight decrease this year, clashes between rival drug trafficking and other criminal organizations continue talking a toll, most recently in the states of Sonora and Zacatecas. Authorities in Sonora announced Wednesday they had found 14 clandestine graves outside of the state capital of Hermosillo. They noted that each pit should contain at least one -- if not more -- bodies. In Sonora, there is a three-way battle for control among the Sinaloa cartel, allies of the Jalisco cartel, and a faction allied with fugitive drug lord Rafael Caro Quintero. Meanwhile, in Zacatecas, three more bodies were found hanging from bridges in the town of San José de Lourdes Tuesday. That comes just a week after 10 more bodies -- nine hanging from bridges -- were found in Ciudad Cuauhtemoc. The Sinaloa and Jalisco cartels are vying for control of that state, too. On Wednesday, the Mexican army said it was sending nearly 3,500 soldiers and National Guard members to the state to perform law enforcement functions.

Indiana Democratic Party Calls for Marijuana Legalization. The Indiana Democratic Party, has announced its full support for marijuana legalization and called on the General Assembly to get the job done. They also called on Gov. Eric Holcomb (R) to rescind his opposition to legalization. Bills to legalize marijuana have so far gone nowhere in the GOP-dominated legislature, but the Democrats said legalization "would provide the opportunity to create an additional revenue stream for the state, create good-paying jobs, develop a long-term cash crop for Indiana's ag and business communities, provide medicinal opportunities for people like the state's veterans and seniors, and could start the process of expunging records for simple possession across the state."

Oklahoma Marijuana Legalization Initiative Hit with Legal Challenge. A marijuana legalization initiative sponsored by Oklahomans for Responsible Cannabis Action is being challenged in court by an incarcerated person, Paul Tay. Tay's lawsuit raises numerous claims about the constitutionality of the initiative, including challenging the validity of signatures gathered in Indian County. "We believe that we have a really strong case," ORCA Director Jed Green said. "[The man filing this challenge] wants attention… this is the second time that he's done this." Green called the lawsuit "a shotgun challenge," going after multiple points and seeing if any of them stick. Green says the challenge is what he calls a shotgun challenge, going after multiple points and seeing if any of them stick. "We don't believe that a lot of it is really pertinent," he said. There will be a hearing on the challenge on December 14.

Drug Testing

Pennsylvania ACLU Opposes Bill to Compel Parental Drug Screening in Abuse and Neglect Cases. The ACLU of Pennsylvania has come out against HB 1737, which would allow county children and youth services (CYS) agencies to obtain court orders to compel parents to undergo drug and alcohol testing during child welfare investigations if there is evidence that impairment due to drug or alcohol use is a contributing cause of alleged abuse or neglect. "Because drug testing is considered a search, both the Pennsylvania and United States Constitutions require the government to show that it has probable cause before it can compel an individual to undergo a drug test," the group said. "HB 1737 would permit unconstitutional intrusions on parents' privacy rights because it does not contain a requirement that a CYS agency have probable cause to believe that an act of child abuse or neglect has occurred and that drug testing the parent will reveal evidence relating to such abuse." The bill passed the House last week.

Ecuador Prison Clash Leaves at Least 68 Dead. In the latest outbreak of fighting among prison gangs linked to international drug trafficking groups, at least 68 prisoners were killed in an hours-long gun battle Saturday inside the Litoral Penitentiary, the country's largest prison. This is the second major outbreak of violence at Litoral in less than two months. In September, 119 prisoners were killed in gang-related clashes there. Another 79 prisoners were killed in clashes last February. So far this year, more than 300 prisoners have died in the violence. The prison violence comes amid a national state of emergency decreed by President Guillermo Lasso in October that empowers security forces to fight drug trafficking and other crimes. The country's prisons hold some 40,000 inmates, including 15,000 jailed awaiting trial, and are filled way above capacity.

Gallup Poll Sees Continuing Strong Majority Support for Marijuana Legalization. A new Gallup poll released Thursday has marijuana legalization maintaining record-high levels of support with 68 percent of respondents in favor—the same percentage as when Gallup last polled in November 2020. Only 32 percent favored continuing marijuana prohibition, giving legalization two-to-one support. "As was the case in 2020, solid majorities of U.S. adults in all major subgroups by gender, age, income and education support legalizing marijuana," Gallup said. "Substantive differences are seen, however, by political party and religion." Support for legalization was highest among Democrats (83 percent), followed by independents (71 percent) and Republicans (50 percent).

Congressional Research Service Report Provides Pathway for Presidential Administration to Deschedule Marijuana. A new report from the nonpartisan Congressional Research Service (CRS) outlines pathways for the Biden (or any other) administration to unilaterally end marijuana prohibition and issue a general amnesty for federal marijuana crimes by acting administratively to remove marijuana from the Controlled Substances Act (CSA). "The President could pursue the appointment of agency officials who favor descheduling, or use executive orders to direct DEA, HHS, and FDA toconsider administrative descheduling of marijuana," the CRS report advised. "The notice-and-comment rulemaking process would take time, and would be subject to judicial review if challenged, but could be done consistently with the CSA’s procedural requirements.The Biden administration has officials in place who are sympathetic to legalization, but the president himself has no sign of going further than decriminalization, not legalization.

Ohio Towns Split on Marijuana Reform Ballot Measures. More than a dozen Ohio cities had marijuana reform measures on the ballot Tuesday and seven of them voted to approve local measures to decriminalize marijuana. Before Tuesday, 22 cities and counties across the state had adopted similar marijuana reform measures. The most common initiative language was "shall [jurisdiction] adopt the Sensible Marihuana Ordinance, which lowers the penalty for misdemeanor marijuana offenses to the lowest penalty allowed by State Law?" Voters in Martins FerryMurray CityNew LexingtonNewStraitsville, RaylandTiltonsville and Yorkville approved the decriminalization proposals, while voters in BrooksideDillonvaleLaurelvilleMcArthurMorristownMount Pleasant and Powhatan Point rejected the reform measures.

Mexico's Michoacan Sees New Massacre, 11 Killed Near Tarecuato. Michoacan state prosecutors announced late Monday that police had found the bullet-riddled bodies of five men and six boys near the town of Tarecuato in the north of the state near the border with the state of Jalisco. The area has been a hotbed of bloody conflict between the Jalisco New Generation Cartel and local criminal gangs. Tarecuato is not from the municipality of La Barca, where clandestine mass graves have been unearthed, and also near to the avocado-producing regions of the state, which are the target of organized crime extortion efforts.

Chronicle Book Review: The Afghanistan Papers

Chronicle Book Review: The Afghanistan Papers: The Secret History of the War by Craig Whitlock (2021, Simon & Schuster, 346 pp., $30 HB)

Well, this is a book that could hardly be more timely. Coming out in the immediate wake of the chaotic debacle that was the final American withdrawal from Afghanistan, The Afghanistan Papers takes advantage of voluminous troves of heretofore unseen accounts of the war to paint an unflattering portrayal of two decades of our seemingly interminable occupation of the country in the name first of fighting Al Qaeda and then of vanquishing the Taliban.

While the book is about the war effort as a whole, for devotees of drug policy, it has two chapters specifically to opium production, its role in the war, and American and allied efforts to suppress it. More on that below.

The author, Craig Whitlock, is an investigative journalist with The Washington Post who spent the last two decades covering the global war on terror and has won prestigious journalistic awards for his efforts. In 2016, he learned of the existence of hundreds of interviews with war participants -- civilian and military alike -- conducted by the Special Inspector General for Afghanistan Reconstruction (SIGAR) under the rubric Lessons Learned.

For reasons that would become obvious upon their release, SIGAR did not want to release them, but the Post sued under the FOIA Act, eventually prevailing and producing a series of stories based on them in 2019. Here, Whitlock supplements those Lessons Learned interviews with oral history interviews of officials who served at the US embassy in Kabul conducted by the Association for Diplomatic Studies and Training, interviews with more than 600 Afghanistan war veterans conducted by the Army's Operational Leadership Experience project, as well as hundreds of previously classified memos Pentagon head Donald Rumsfeld drafted between 2001 and 2006.

Woven together in Whitlock's narrative, the interviews and documents present a devastating indictment of American hubris, cluelessness, and fecklessness as general after commanding general came and went, all proclaiming "progress" even as the war effort slipped deeper and deeper into the Afghan morass and the body count -- both allied and Afghan civilians -- grew ever higher.

"We didn't have the foggiest notion of what we were undertaking," said Army Lt. Gen. Douglas Lute, war czar under Bush and Obama.

"We did not know what we were doing," said Richard Boucher, the Bush administration's top diplomat for South and Central Asia.

"There was no coherent long-term strategy," said British Gen. David Richards, who led US and NATO forces in 2006 and 2007.

Yet officials like these, and many, many more, spent the war years playing up illusory successes, minimizing real defeats, and always proclaiming "progress" was being made. But after about 2005, the only progress really being made was by the Taliban, which had returned from defeat to begin an insurgency that would slowly, year by year, envelop ever more of the country until in August it swept into Kabul and once again took control of the country.

The American project to do nation-building in Afghanistan, always half-baked and half-hearted project failed despite the billions upon billions of dollars poured into the country. Or perhaps because of it. As one interviewee noted, the only thing the US managed to build in Afghanistan was "massive corruption."

Enter the opium economy. Not only were leading members of the American-backed Afghan government stacking up personal fortunes out of the US largesse, they were also deeply implicated in the illicit, but economically dominant, opium economy. Even when the Afghan or Americans developed solid cases of drug trafficking, connections inside the government ensured that traffickers remained protected. The Taliban profited from the trade, but so did everybody else.

And even when the Americans managed to snag one of the traffickers, things tended to go screwy. In 2008, they lured an alleged Afghan trafficker named Haji Juma Khan to Jakarta, where Indonesian authorities extradited him to New York to face trafficking charges brought by a federal grand jury. But when he got to court, his defense attorney mentioned in open court that he was an informant for the CIA and DEA, the judge cut her off and later sealed the legal proceedings. His legal proceedings then vanished into a black hole. He was never convicted of any charges but still spent 10 years in US custody before being released in 2018. That tale ought to raise some Orwellian fears.

Whitlock provides a concise history of our efforts to suppress the opium economy as well as the profound contradiction at the heart of the effort: Any attempt to suppress the opium economy undermined the counterinsurgency project. In other words, you could have your war on terror or you could have your war on drugs, but you couldn't have both.

Not that the US and its allies didn't try. In 2003, the British offered to pay farmers to eradicate their crop in one province, but the farmers just took the money and harvested the crops anyway. In 2006, the Bush administration launched Operation River Dance, siccing tractors and weed whackers on the poppy fields of Helmand province. The tractors broke down, the hand eradicators quit and worked harvesting poppies whey they got better pay, and corrupt local officials ensured that only disfavored farmers got raided. Not only was the operation a flop -- despite the de rigueur press releases announcing "progress" -- it was severely counterproductive to the war effort because it enraged the opium economy-dependent population of the province, already a Taliban hotbed, and turned them decisively against the Americans and their Afghan allies in Kabul.

The Obama administration tried a different tack: Alternative development, along with crackdowns on smuggling and trafficking. That didn't work either; between 2002 and 2017, Afghan acreage devoted to opium production quadrupled, even as the US spent $9 billion to stop it. The Trump administration reverted to Bush-style tactics, although in 2017 instead of going after poor peasants, it unleashed high-tech bombers and fighter aircraft on "heroin laboratories" that turned out to be mostly easily replaceable mud huts. The destruction of those mud huts was yet another sign of "progress" that was soon forgotten.

If the American withdrawal from Afghanistan this fall was a debacle, it has many fathers. Joe Biden just got to clean up the mess left by his predecessors, and as Whitlock makes achingly clear, there is plenty of blame to go around.

Pennsylvania Poll Has Record High Support for Marijuana Legalization. A new Franklin & Marshall College poll has support for marijuana legalization at a record high, with 60 percent of respondents backing it. That's up one percentage point since the last Franklin & Marshall poll in March. The poll comes as a number of state legislators file bills to make it happen, but such efforts have so far gotten little traction in the Republican-controlled House and Senate.

Drug Policy

Senate Confirms Dr. Rahul Gupta as ONDCP Director. The Senate last Thursday confirmed President Biden's pick to head the Office of National Drug Control Policy (ONDCP—the drug czar's office), Dr. Rahul Gupta. Gupta is the first MD to serve as drug czar. Gupta has served as West Virginia's Chief Medical and Health Officer and Senior Vice President at March of Dimes. As the state’s Chief Health Officer, Dr Gupta led the opioid crisis response efforts and launched a number of pioneering public health initiatives, including the Neonatal Abstinence Syndrome Birthscore program to identify high-risk infants. He also led the development of the state’s Zika action plan and its preparedness efforts during the Ebola Virus Disease Outbreak.

International

Colombia Coca Growers Seize, Then Release 180 Government Soldiers. Hundreds of coca growers armed with sticks and machetes seized 180 Colombian soldiers who were part of an operation to destroy coca crops early last week and released them days later after deciding unilaterally to let them go after negotiations with the government. "The situation ends here with a voluntary agreement from the growers," said a mediator from the ombudsman's office. The eradication operation was taking place near the Venezuelan border and threatened to disrupt the farmers' livelihoods.

Italian Activists Turn in Hundreds of Thousands of Signatures for Marijuana and Psilocybin Referendum. Last Thursday, activists handed in some 630,000 signatures for a referendum to legalize the cultivation of marijuana and other psychoactive plants and fungi. Now, the Supreme Court of Cassation has 30 days to determine that the signatures are valid, and if they are found valid, the Constitutional Court will determine whether the measure conflicts with the national constitution or international treaties. Activists say they intentionally limited the referendum's language to meet that standard.

British Prime Minister Says He Will Examine Latest Advice on Legalization of Psilocybin. In response to a question in Parliament from Tory MP Crispin Blunt, who said the drug had "exciting potential" and urged him to review the law to allow more research into psilocybin's therapeutic qualities, Prime Minister Boris Johnson said Thursday he would: "I can say that we will consider the Advisory Council on the Misuse of Drugs recent advice on reducing barriers to research with controlled drugs such as the one he describes, and we will be getting back to him as soon as possible." Psilocybin is currently a Schedule I substance under the Misuse of Drugs Act, which means it requires a Home Office license to conduct research, and Blunt and other campaigners want it moved to Schedule 2 to make it easier to conduct research.

British Labor Party Leader Says He Would Not Decriminalize Drugs. Asked if a Labor government would either decriminalize drugs, Labor Party leader Sir Keir Starmer said it would not. The comment comes after Scotland's Lord Advocate called for diverting from prosecution people caught with small amounts of drugs. Starmer criticized the notion even as he accused the Scottish National Party of having an "appalling" drug overdose death. When asked about the Lord Advocate's advice made sense, Starmer said: "The Lord Advocate has set up principles and we have not seen the detail yet, which will come out shortly. I do not think what happens in Scotland should be a general application across the UK. One of the benefits of devolution is to allow each of the nations to look separately in context to the challenges they have. But if I was prime minister of the UK I would not be introducing that."

Canadian Prime Minister Urged to Decriminalize Drug Possession. Nearly 70 organizations across the country, including the HIV Legal Network, the British Columbia Civil Liberties Association, and the National Association of Women and the Law, have written a letter to Prime Minister Trudeau asking him he make drug policy reform a priority for his newly re-elected Liberal government. Even though  Trudeau's Liberal Party approved a decriminalization resolution in 2018, Trudeau has so far rejected the move, but pressure is rising along with the number of drug overdose deaths. The groups are calling for immediate drug decriminalization and a safe drug supply, saying that the overdose deaths are driven by "a contaminated drug supply and the stigma associated with drug use."

Costa Rica Congress Approves Medical Marijuana. The Congress on Tuesday approved the legalization of medical marijuana over opposition from President Carlos Alvarado. The law allows for the cultivation and processing of marijuana for medical use but does not allow for recreational use. Lawmakers are calling on Alvarado not to veto the bill. If he does, the bill would have to be passed again with a supermajority.

Peru Coca Farmers Protest Goverment Crop Eradication. Hundreds of coca leaf growers are in the fifth day of a highway blockade as they protest the destruction of their crops by the government. The protest began with the eradication of coca fields in Carabaya province, in the Puno region. Growing coca leaf is legal for farmers who are on a registered government list, but that list has not been updated since 1978. The demonstrators, who mainly voted for President Pedro Castillo, are calling on him to stop the eradication of unpermitted crops.

Spanish Socialist Party Votes Against Legalizing Marijuana. The ruling Socialist Party (PSOE) joined with rightist opposition groups in opposing a bill to legalize marijuana that was sponsored by its coalition partner Unidas Podemos. In opposing the measure, the Socialists aligned themselves with the conservative Popular Party and the extremist right Vox Party. That tactical alliance was able to defeat the bill 263-75. "This is not a question of the right or the left, it is a question of public health," said PSOE lawmaker Daniel Vicente in Congress, adding: "We are a government party."

Chronicle Book Review: The Dope [FEATURE]

The Dope: The Real History of the Mexican Drug Trade by Benjamin T. Smith (2021, W.W. Norton, 462 pp, $30 HB)

This past weekend, top-level American officials were in Mexico City meeting with their Mexican counterparts to discuss rebuilding cooperation in the endless struggle against Mexican drug trafficking organizations. The meeting comes nearly 15 years after then-President George W. Bush and then-Mexican President Felipe Calderon initiated the Merida Initiative to fight drugs, crime, and violence. In 2007, when the Merida Initiative began, there were about 2,300 drug-related deaths in Mexico. Fifteen years and $1.6 billion in US security assistance later, the annual Mexican death toll is north of 30,000, American overdose deaths largely linked to Mexican-supplied fentanyl are at an all-time high, and despite killing or capturing dozens of "kingpins," the so-called "cartels" are more powerful than ever.

In The Dope: The Real History of the Mexican Drug Trade, Mexico historian Benjamin T. Smith relates the story of another meeting between American and Mexican officials more than 80 years ago. It was at the League of Nations in 1939, and Mexican diplomat Manuel Tello was trying to sell the assembled narcotics experts on a novel approach to opioid addiction: Post-revolutionary Mexico had just passed a new drug law that allowed for state-run morphine dispensaries. Doing that could treat addiction and allow users to get their fix without resorting to a black market, he argued.

That proposal, one much in vogue in harm reduction and public health circles these days, was shot down by none other than Harry Anslinger, head of the American Federal Bureau of Narcotics and self-appointed dope cop to the world. He made it clear to the Mexicans, who had also irked him by challenging his Reefer Madness propaganda, that no such nonsense would be tolerated. That encounter, Smith's narrative makes clear, is emblematic of the US-Mexico relationship when it comes to drugs. The US, with its insatiable appetite for mind-altering substances, has for decades leaned on Mexico to repress the trade its citizens demand, and the results have for decades been dire.

As Smith shows, US pressure on Mexico to ramp up its anti-drug efforts, particularly in the 1940s and 1970s, produced temporary results but also long-term pathologies. Where Mexican authorities had been happy to manage the trade rather than repress it, Washington demanded strict enforcement and aggressive action. Harsher enforcement, including the resort to torture and murder (with the knowledge, encouragement, and sometimes the participation of DEA agents), produced a meaner criminal underworld. Smith especially notes the American insistence on a broad strategy of relying on informants as an aggravating factor in escalating trafficker violence, as traffickers turned on each other for revenge or to protect themselves from potential rats.

Smith also clarifies that the drug trade has always been seen not just as a scourge but as a resource by elements of the Mexican state. Early on, a post-revolutionary governor in Sinaloa taxed the opium traffickers and used the proceeds for public works. Governors in border states like Baja California and Chihuahua followed suit, taxing the trade, protecting favored traffickers and making exemplary busts of those without favored status to please the Americans. Although, as he notes, the politicians increasingly tended to forget the public works and just pocket the money themselves.

Smith described the structure of the relationship between the Mexican state and the drug traffickers as more a "protection racket" than an adversarial one Prior to the 1970s, the racket was carried out at the state level, with the governors and the state police forces providing the protection. Levels of violence were generally low, but likely to spike when a change of administration meant a new set of players in the racket and a new set of favored and disfavored traffickers. The favored traffickers could get rich; the unfavored ones could get jailed or killed as sacrificial lambs to appease the Americans.

In the 1970s, though, both the repression and the protection racket went national, with the mandate to fight the drug trade (and the license to manage it) going to the dreaded federales and their masters in the Ministry of Justice and the presidential palace. The levels of violence increasingly dramatically as the federales and the armed forces pleased the Americans by arresting, torturing, and killing marijuana- and opium-growing peasants as well as traffickers. Traffickers who could once accommodate themselves to the occasional exemplary short prison sentence now fought back when faced with death or years behind bars.

But in this century, thanks largely to fabulous profits from the cocaine trade, the drug traffickers have flipped the script. They no longer work for the cops; the cops now work for them. It's a process Smith refers to as "state capture," even if the state function that is being captured is illicit. Now, cops and politicians who don/t understand who is charge end up in unmarked graves or starring in horrid torture/murder videos.

The Dope is a fascinating and sobering tale, full of colorful characters like Dr. Leopoldo Salazar Viniegra, the crusading post-revolutionary physician who argued that marijuana was harmless and whose government office was behind the morphine dispensary plan, and La Nacha, Ignacia Jasso, the dope queen of Ciudad Juarez for decades, along with a veritable rogue's gallery of traffickers, cops, spooks, and politicians, all of whom vie for control of the trade and its incredible profits.

It also reveals some broad findings. First, economics is the driving force of the drug trade, and the economic opportunity it has provided (and continues to provide) to millions of Mexicans means it is not going away, Second, as noted above, authorities have sought to harness income from the drug trade, with the result that they are now harnessed to it. Third, aggressive anti-drug policies are driven more by moral panics, the need for bureaucratic fundraising, and scapegoating, and "are rarely implemented for their effectiveness." Nor do they work, even on their own terms, as our current overdose death numbers shout out. Fourth, the causes of violence originate "not from inside the drug trade, but inside the state," particularly with the churning of protection rackets with the arrival of new political leadership. "The other principal cause of violence has been the war on drugs itself."

There is an extensive mythology around the Mexican drug trade. Benjamin T. Smith has gone a long way toward dispelling those myths by providing an accurate, in-depth, well-sourced history of the trade and the domestic and international politics around it. Pennsylvania Sees Bipartisan Effort to Legalize Marijuana. A Republican state senator has joined forces with a Democrat in a bid to garner bipartisan support for marijuana legalization. Senator Mike Regan (R) and Rep. Amen Brown (D) are teaming up on Regan's proposed bill, which would legalize marijuana, includes social equity provisions, and seeks to create a tax and regulatory structure for legal weed. Democratic politicians in the state, including Gov. Tom Wolf, have been calling for legalization, but the Republican-controlled legislature has so far resisted such entreaties. It's time for us to move forward in Pennsylvania," said Regan, a former US marshal who played a role in crafting the state's medical marijuana program. "If we can take the violence out of it and we can regulate it and tax it and let police focus on the really serious crimes, I think it's a huge step forward."

Opioids

Michigan House Committee Takes Up Opioid Treatment Expansion. The House Health Policy Committee has met to discuss several pieces of health-related legislation, including a pair of bills that would expand access to treatment for opioid use disorder, HB 5163 and HB 5166. "HB 5163 will expand capacity to treat opioid overdoses in emergency departments, a key interception point for people who use drugs where we see a high risk of overdose upon discharge," said bill sponsor Rep. Angela Witwer. The bill would allow emergency departments to provide medication-assisted treatment, create specific hospital overdose care protocols, and provide referrals to community-based care organizations. HB 5166 would increase access to the opioid overdose reversal drug naloxone by allowing community-based organizations to distribute the drug. Currently, under a 2016 standing order law, pharmacists can give the drug without a prescription, similar to an over-the-counter drug. No votes were taken on the bills.

Law Enforcement

DEA Agent Killed in Tucson Was Enforcing Marijuana Prohibition. DEA Agent Michael Garbo, who was killed Monday in a shootout on an Amtrak passenger train in Tucson, died attempting to enforce federal laws against marijuana. The accused shooter, known only as D.T., opened fire on drug task force agents after they found 2.4 kilograms of marijuana, 50 packages of edibles, and "other marijuana and cannabis products," according to the court documents. D.T. and his partner, Devonte Okeith Mathis, were targeted by the DEA, whose agents were given a list "that contained names of several individuals on an Amtrak train that was arriving in Tucson" as part of their routine investigative activities. Task force officers saw Mathis move several bags a few rows away from where he and his partner were sitting, then took the bags off the train to inspect them and found marijuana. When agents then attempted to approach D.T., he opened fire, killing Garbo and wounding another DEA agent and a Tucson police officer. D.T. was then fatally shot.
