De Facto Hash Truce in Lebanon's Bekaa Valley

The Lebanese government will not attempt to eradicate marijuana fields blooming across the country's Bekaa Valley, Beirut's Daily Star newspaper reported Friday. Sources cited by the Star said it was because of the fragile security situation in the area near the border with Syria and because the government had been unable to live up to pledges to provide financial compensation to farmers whose crops were destroyed last year.

They are also up against Bekaa Valley marijuana farmers in no mood to see their livelihood messed with.

"In the absence of alternatives, we will break the hands and legs of anyone who dares destroy our crops," one of the region's biggest growers, Ali Nasri Shamas, told the Daily Star. "We will not be gentle with [the security forces] like we usually are," added Shamas, who is wanted on several arrest warrants, including on a charge of attacking the Army. "It will be a full-blown war if necessary."

This after last year's eradication effort led to clashes between would-be eradicators and farmers armed with rifles, rocket-propelled grenades, and mortars. Those clashes, which resulted in the destruction of bulldozers hired by the government to plow under pot fields, ended only when the government promised to pay compensation to farmers. That didn't happen. The Finance Ministry said it didn't have the money.

This year, although the Higher Defense Council had fighting drug cultivation on the agenda this week, sources told the Daily Star that a "tacit agreement" last month between government officials and local leaders from the Baalbek-Hermel region in the northern Bekaa meant that eradication efforts weren't going to happen this year.

"The Army is exhausted by the roving security incidents and the farmers are poor and angry," said a political source. "Everyone wants to avoid a major confrontation with the military. No one wants carnage."

The Syrian civil war raging next door has led to repeated clashes inside Lebanon, especially since the open involvement of Hezbollah members in the fighting earlier this year. The Bekaa Valley is also a Hezbollah stronghold.

Lebanese hash provided funding for feuding militias in the Lebanese civil war between 1975 and 1990, and grew into a multi-billion dollar industry before the government cracked down under international pressure in the late 1990s. But its eradication campaigns have often generated violent clashes, and promised alternative development schemes have failed to materialize.

Now, the marijuana fields are back in a big war. The Daily Star described roads in the Bekaa Valley "lined with dark green cannabis fields."

This year's pot crop would be "wonderful," Shamas said. "We moved from 5,000 dunums of cannabis-cultivated land to 45,000 dunums," he said. (A dunum is about a quarter of an acre.) There is no shortage of dealers to buy the resulting hashish, he said, adding that it was destined for markets in Egypt, Turkey, and Europe.

While Shamas reveled in his anti-government outlaw status, other marijuana farmers said they had few other options. "We have no other choice," said Abu Asaad from Yammouneh. "Our region is highly poor and neglected and I prefer planting cannabis to turning into a bandit or a car thief."

The farmers scoffed at international aid and alternative development programs, saying they had been a bad joke.

"It's high time international donors realize that their money is not spent to devise tangible agricultural policies, but rather goes straight to the pockets of officials," Abu Asaad said. "Eradication campaigns are carried out at our expense and used to secure more funds, which will surely be embezzled."

Meanwhile, to save face, Lebanese authorities may do some Potemkin eradication.

"The police and Army might destroy a small plot of land where cannabis is grown in the next few weeks just to demonstrate that they have not dropped the ball on the matter, but I totally rule out a large-scale campaign," a source told the Daily Star.

Chronicle Book Review: Smuggler Nation

Smuggler Nation: How Illicit Trade Made America, by Peter Andreas (2013, Oxford University Press, 454 pp., $29.95 HB)

Wow. With Smuggler Nation, Brown University political science professor Peter Andreas has hit the ball out of the park -- or over the border. This book should be required reading for not only for people interested in we got to our current mess in the war on drugs, but also for anyone interested in American history in general, and the twinned growth of illicit commerce and the ever-increasing policing resources designed to thwart it in particular.

What makes Smuggler Nation so essential for people primarily interested in drug policy is the manner in which it situates drug prohibition and efforts to suppress the drug trade within the larger historical context of state efforts to control -- or prohibit -- trade. The war on drugs (or at least its interdiction component) didn't drop on us out of the sky, but was built upon already existing national-level efforts to enforce proscriptions on free trade, dating back to Jefferson's abortive ban on US ships trading with any foreign nations, the more successful, but still long-lasting and highly contentious effort to ban the slave trade, and Prohibition-era border enforcement.

Andreas shows that, going back to colonial times, smuggling and illicit commerce played a crucial role in the creation and expansion of the American economy, and, indeed, in the anti-British sentiment that led the way to the American Revolution in the first place. Whether it was enriching Providence and Boston merchants in the triangular slave trade, stealing intellectual property from England at the start of the Industrial Age, selling American cattle to hungry British troops stationed in Canada during the War of 1812, allying with the smuggler-pirate Jean Lafitte in the Battle of New Orleans in that same war, selling contraband whiskey to Indians, smuggling guns into Mexico (in the 1840s, in addition to now) -- the list goes on and on -- smuggling and illicit commerce was, and continues to be, part and parcel of the American story.

Andreas also show that those efforts to control unsanctioned commerce led directly -- and continue to lead directly -- to ever larger, more expansive, more expensive, and  more unintended consequence-generating law enforcement efforts to suppress it. We saw it with the early growth of the US Navy to combat tax evading smugglers, and how those efforts rerouted, but did not defeat, illicit trade. We saw it with the expansion of drug war interdiction efforts in the 1980s, where blockading the Caribbean route for Colombian cocaine rerouted, but did not defeat, illicit trade, and helped provoke the metastasis of what had been largely low-key, local Mexican smuggling networks into the Frankenstein monster drug cartels of today.

We can see that at work today in the current debate over the immigration reform bill working its way through Congress. House Majority Leader Boehner thought he could sell the bill to his conservative caucus by agreeing to expansive provisions to "regain control of the border" or "secure the border" by spending billions of dollars and adding 20,000 more federal agents along the Mexican border. (Nevermind that even that's not likely to be enough to satisfy Boehner's caucus, some of whom might support the bill but others of which have charmingly compared Mexican immigrants to dogs and asserted that those DREAM Act kids are mostly drug mules.)

There were 3,000 border agents in the early 1990s, 7,000 by the late 1990s, and there are 20,000 right now. The immigration bill would double that number again. As Andreas, relying on the historical record, notes, that is unlikely to stop drug smuggling or people-smuggling (there are much deeper driving forces to such phenomenon than law enforcement), but merely to divert it or reroute it, to corrupt enforcers, and to inspire the smugglers to come up with new technologies to get around it and gain entrée into Fortress America.

Andreas also makes an important point about "the threat" of transnational organized crime. That's pretty much just a fancy way of saying smuggling, he asserts, and it is nothing new. As he shows throughout Smuggler Nation, trade in contraband has been part of global trade since, well, forever. And now, given the rapid expansion of global commerce in recent decades, it would be surprising if contraband trade isn't expanding, too. It is, he argues, but possibly at a slower rate than the expansion of licit global trade. All of the hulaballoo over "the menace" of illicit trade is overdone, he dares to suggest.

Andreas is an academic who specialized in the US-Mexico border in his early career, and his publisher, Oxford University Press, is an academic press, but his writing is quite accessible to the lay reader. Smuggler Nation is chock full of great lost stories from American history, stories that hold serious lessons for us today as we struggle against the behemoth that our prohibition industry has become. Smuggler Nation will help explain how we got here, and you'll learn plenty and have lots of fun along the way.  This book needs to be on your bookshelf, and well-worn at that.

Sex, Lies, and a Georgia Drug Frame-up [FEATURE]

Part five of an ongoing investigative series, "Prosecutorial Misconduct and Police Corruption in Drug Cases Across America."

With a plot out of a Hollywood movie or a gripping Lifetime TV show, a mesmerizing drama of sex, power, frame-ups, planted drugs, and lies unfolded in real life in Georgia when two Murray County sheriff's deputies recently pleaded guilty in federal court for their part in a scheme to send an innocent woman to prison. Now both deputies await sentencing on charges of obstruction of justice and perjury stemming from an FBI civil rights investigation into the odd goings-on Down South.

The woman in question, Angela Garmley, had filed a complaint with the Georgia Judicial Qualification Committee alleging that Chief Magistrate Judge Bryant Cochran solicited sex from her in return for legal favors in a pending assault case in which she was the victim. Shortly after Garmley filed her complaint, she was arrested on August 14, 2012 in sleepy Chatsworth, Georgia, and charged with possession of methamphetamines.

"My client was set up and framed with methamphetamine drugs by Judge Bryant Cochran, whom she had accused of soliciting her for sex in exchange for legal favors in a case she had in Cochran's court," attorney McCracken Poston told the Chronicle.

Poston, a former Georgia state representative from nearby Ringgold with a reputation as a crack attorney, is representing Garmley in a civil lawsuit against Murray County. And Garmley isn't alone. Since this scandal broke, three women who worked in Cochran's court have filed a separate lawsuit against the judge and the county claiming Cochran sexually harassed them while county officials negligently failed to protect their rights.

"The judge, two deputies, and a handyman named C.J. who is employed at Judge Cochran's property conspired to plant the drugs on my client. And if the frame-up hadn't been discovered my client would've been facing 25 to 30 years in prison," Poston said, echoing the allegations made it the lawsuit.

Although Garmley's drug charge was dismissed a week later at the request of investigators when the frame-up was exposed, she is still suffering the consequences of her false arrest. Under Georgia law, it takes one year for the charge to be removed from Garmley's record, and the arrest has already cost her.

"My client was denied a much higher paid job due to the felony drug charge on her record and what the judge and cops did to her. Nobody should have to suffer like that," Poston said.

Lust and Privilege at the County Courthouse

According to Garmley's lawsuit -- and largely supported by the record in judicial proceedings so far -- she went to the courthouse on April 9, 2012 in regard to an assault on her by three persons the previous day. When Garmley arrived at Cochran's office, he requested that she meet with him alone, preventing her sister, who had been an eyewitness to the assault, from attending or providing a corroborating statement.

"While privately sitting in chambers with Cochran, I related details about the assault," Garmley said in the lawsuit.

But Cochran was more interested in the state of her marriage, the suit alleges, whether or not she had cheated on her estranged husband, and whether the persons who assaulted her "have anything on her to hurt her divorce from Joe Garmley." While shying away from particulars of the assault, Cochran made repeated comments about "how pretty" Garmley was and then veered into even more uncomfortable territory.

"My wife doesn't take care of my sexual needs and I need a mistress to have sex with I can trust," Garmley said Cochran told her. He had "a real boner" for her and wanted her to return to his office the following week, he added flirtatiously, the lawsuit alleges.

Garmley played along as if interested in his offer, the suit alleges, and then Cochran upped the ante by asking Garmley to send him a photo of herself in a seductive way to let him take a "sneak peek" at what he was going to get. After giving Garmley his private cell number, Cochran, with a fixed stare at Garmley, gave her a direct order: "Come back on Wednesday with a dress and no panties so we can have sex."

Garmley told investigators and her attorney that she complied with Cochran's request for a revealing photo, sending him pictures of herself in her underwear.

"I sent the pictures hoping Judge Cochran would permit my assault case to move forward to get justice," Garmley stated in her suit. "But I had no intention of meeting behind closed doors without panties to have sex with the judge."

Instead, Garmley filed a complaint against Cochran with judicial authorities, and that's when her experience with Murray County justice shifted from bad dream to nightmare.

The Drug Bust That Wasn't

Within days of filing her complaint against Cochran, Garmley suddenly found herself on the wrong side of the law, charged with possession of methamphetamine after a roadside traffic stop by Murray County Sheriff's Deputy Josh Greeson. Greeson's arrest report -- now in the hands of the FBI, the Georgia Bureau of Investigation, the US Attorneys Office, and Garmley's attorneys -- provided the official version of events.

"On 8-14-2012, while patrolling Eastbound on the Brown Bridge Road I noticed a vehicle heading Westbound with its bright lights on. As the vehicle passed me I turned around to make a traffic stop for failure to dim its bright lights," Greeson wrote. "Failure to dim headlights is an indicator someone under the influence of drugs or alcohol."

Garmley was a passenger in the vehicle, being given a ride by a male friend, Jason Southern, who was also charged with meth possession, as well as driving with a suspended license, and who is also a plaintiff in Garmley's lawsuit. Southern was giving Garmley a ride to the property she shared with her estranged husband, who lived in a separate residence on the property.

"When the vehicle pulled into the trailer park at 4177 Brown Bridge, I turned my blue lights on for the vehicle to stop," Greeson wrote in his report. "When I got out I approached the passenger side and requested to see both the driver and the passenger driver's license. Mr. Southern stated his license was suspended."

Then Joe Garmley showed up and began angrily arguing with his wife and Southern. Joe Garmley repeatedly ignored Deputy Greeson's orders to step away from the vehicle and continued to argue with his wife. Greeson then arrested him for obstruction of justice. Joe Garmley is also a plaintiff in Garmley's lawsuit.

"When Mr. Garmley was arrested," Poston explained, "his offense was a simple misdemeanor that he could have bonded out on that same night, but guess what? Mr. Garmley was held overnight without bond."

Returning to the business at hand, Deputy Greeson continued to investigate.

"When Mrs. Garmley stepped out of the vehicle she stumbled and had slurred speech, which led me to believe that she was on some sort of illegal drug," he reported. "I asked Ms. Garmley if she had used any illegal drugs or if there was any illegal drugs inside the vehicle and she said no. I asked Ms. Garmley if I could run my dog around her vehicle to assure me that there wasn't anything illegal in the vehicle and she stated it was fine to search her vehicle if I wanted. I got my K-9 Ruhl out of my patrol car and started my search at the back driver's side tail light."

Greeson also noted in his report that during the first search of the vehicle with the K-9 dog that the animal sniffing enhanced at the driver's side front tire and front lower part of the door. "On my second pass by the driver's side, the sniffing of the K-9 enhanced again."

"Due to my training with Ruhl at the South Georgia K-9 school, I was certain that his alert was true," Greeson wrote. "And based on my police training about different techniques that are used to hide narcotics, I looked up under the vehicle and located a small metal can stuck to the front of the vehicle right under the driver's door. When I opened the can there were bags of a crystal substance believed to be methamphetamine."

Garmley denied that the drugs were hers. "Then Mrs. Garmley said this was a set up," Greeson wrote in the report.

At this point, Murray County Sheriff's Captain Michael Henderson, a first cousin to Judge Cochran, appeared on the scene. "You happen to be in the wrong place," he told Southern, according to the lawsuit.

Both Ms. Garmley and the driver, Jason Southern, were charged with possession of meth and hauled off to jail while her husband Joe was transported to jail in a separate vehicle. Garmley posted a $2,500 bond and was released from jail. Her husband Joe also posted bail, but Southern remained in jail.

"Once Angela told me what happened, I knew the whole case stunk to high heaven," attorney Poston said. "My client and I had been on TV about the sexual allegations that Ms. Garmley had filed against Judge Cochran with the State Judicial Qualification Board and all of a sudden, my client gets pulled over and drugs were found in her car. I told the judge in open court that my client had been set up and that I would have the case investigated," Poston added.

Poston complained to the Georgia Bureau of Investigation (GBI), and GBI investigator James Harris launched an immediate investigation, questioning Deputy Greeson, Captain Henderson, and others involved. That's when the official story began to fall apart.

A Frame-Up Exposed

The day after the arrest, Deputy Greeson testified that he had not received prior information about Garmley's white Dodge vehicle prior to pulling it over. During GBI agents' interviews with  Greeson a week later, he insisted again that he had not been instructed to pull Garmley over. But by then, Poston and Garmley had reported to investigators that a man known as "C.J.," who worked as a handyman for Judge Cochran, had confessed to planting the drugs on Garmley's car.

"This C.J. guy confessed to me and Garmley that Judge Cochran paid him money to plant the drugs on Garmley's vehicle," Poston told the Chronicle. "She told both me and GBI investigators that on the night prior to her arrest, C.J. came by her house around 1:30am acting strange, asking Garmley if her father, who no longer lived with her, wanted to trade off his guitar. Mrs. Garmley said as C.J. talked, she noticed him watching her cell phone, but she moved it. C.J. said the judge told him that if he got ahold of Garmley's phone that he would get paid more, particularly because Garmley had the judge's phone number and text messages."

Realizing that his cell phone log could be subpoenaed regardless of whether his messages were deleted, Greeson finally cracked, telling investigators that Henderson had asked him to pull the drug-planted car over and to keep quiet about it.

"Henderson asked Greeson not to tell investigators about his order to pull Garmley's car over, which put Greeson in a position to lie about it, and that's a conspiracy," said Poston. "Captain Henderson then changed course and confessed his role in the scheme to have Garmley's car stopped so Greeson could find the planted drugs."

Surrounded by reporters, Greeson sobbed as he recalled having feared to refuse Captain Henderson's order to deny knowing ahead of time about Garmley's car having drugs. Greeson also said Henderson visited his home before he spoke with GBI about Garmley's arrest.

"I can't remember exactly how Henderson put it, but he said for me not to mention about the lookout on the vehicle and that I was the only one who knew about the lookout. And if I didn't say nothing about it, nobody would know," he said. "I was always told to stay on Henderson's good side."

Both Henderson and Greeson were fired from the sheriff department and Cochran,who had just been reelected for a third term, abruptly resigned his judgeship a day after the arrests of Garmley, her husband Joe, and Jason Southern.

Henderson later told investigators he arrived at the arrest scene to assist Greeson with Garmley's husband Joe after he appeared on the scene and disrupted the investigation. Judge Cochran denied Garmley's allegations and further denied that he resigned because of them, instead offering up that he had resigned over warrants he had pre-signed for officers when he wasn't available during normal hours. Pre-signing warrants is a breach of judicial ethics; it would allow any officer to pick up a blank warrant with Cochran's signature and fill in the blanks to effect the arrest of search of a citizen without the judge's knowledge or any judicial oversight.

Michael Henderson, 41, a former captain with Murray County Sheriff Department pleaded guilty on March 27 to obstructing a civil rights investigation into allegations surrounding the "throw down" dope found under Mrs. Garmley's vehicle as well pleading guilty to a charge of tampering with a witness pending a civil rights investigation. He faces up to 20 years in prison with a fine up to $250,000.

Josh Greeson, 26, pleaded guilty on April 12 to similar charges after previously denying he had not been instructed by then-Captain Henderson to pull over Garmley's drug-laden car as she headed home. Greeson admitted to obstructing a pending public corruption and civil rights violations by tampering with a government witness -- Angela Garmley. Greeson also admitted to deleting text messages and call logs that he received on his phone from Henderson and Cochran on the night he stopped Garmley with the planted drugs.

As part of their plea deals, both Greeson and Henderson agreed to tell everything they knew about the set-up, as well as what Judge Cochran knew. The investigation continues. Judge Cochran has yet to be indicted on any criminal charges, and the same goes for the man known as C.J., who admitted to planting the drugs. But both are named in Garmley's civil suit.

The case has drawn howls of outrage from prosecutors, law enforcement, and defense attorneys alike.

"The criminal justice system is based on the premise that police officers must be honest and truthful above all," said Northern District of Georgia US Attorney Sally Quillian Yates. "Mr. Henderson and Mr. Greeson weren't, and such conduct cannot stand."

"We as taxpayers should all be horrified," said prominent Houston criminal defense lawyer Vivian King. King is host of a weekly court justice program called Truth & Justice. "We as taxpayers should hold our judges and law enforcement officers to a higher standard and if found guilty they should be punished. And the judge in this case should be disbarred."

"I never had fellow narcotics officers plant drugs, but usually when something like this happens, there is usually a woman somewhere in the mix," said retired Houston police narcotics officer Billy Williams, and the case of Judge Cochran was no exception. "So he abused his power for sex and a woman brought him down."

Henderson and Greer await sentencing, and Poston is urging them to sing like canaries.

"Under federal sentencing guidelines the only thing the deputies can do to help themselves is to tell everything they know about my client being framed with the drugs and that includes everything they know about the judge's involvement," he said. "I suspect there are more people involved or knew the dope was planted because Judge Cochran made several calls to the sheriff department about my client's vehicle having drugs inside."

In this case of lust, power, and justice perverted, the fat lady is yet to sing.

Chronicle Review Essay: What Next for Mexico?

The Fire Next Door: Mexico's Drug Violence and the Danger to America by Ted Galen Carpenter (2012, Cato Institute, 307 pp., $24.95 HB)

Drug War Mexico: Politics, Neoliberalism, and Violence in the New Narcoeconomy by Peter Watt and Roberto Zepeda (2012, Zed Press, 260 pp., $24.95 PB)

As of this month, Felipe Calderon has finished his term as president of Mexico, and while history may prove kinder in the long run, he leaves office known as the man who plunged his country into a drug war. Some 50,000 people, or is it 60,000 or 70,000? -- nobody seems to know for sure -- have been killed in the multi-sided conflict since Calderon, in almost the opening act of his administration, deployed the army against the so-called cartels six years ago.

Thousands more have disappeared. The Mexican government says it has 9,000 unidentified corpses. The addition of tens of thousands of Mexican army troops and federal police into conflict-ridden cauldrons like Ciudad Juarez or Michoacan where intra-cartel violence ran rampant only seemed to jack up the number of killings. Cartel-linked corruption plagues the police forces and tarnishes the not-so-sterling reputation of the Mexican military.

Calderon's throwing the military into the fray and his strategy of attempting to decapitate the cartels by going after their top leadership have produced some results -- the government proudly says 25 of 37 top capos have been captured or killed -- but have clearly failed to destroy the cartels, stop the traffic of drugs into the US, or reduce the horrendous levels of violence. He -- and the country -- have also paid a disastrous price, not just in terms of lives lost, but in public cynicism and insecurity, loss of confidence, international dismay and disgust, and domestic political capital.

Indeed, only a dozen years after "the perfect dictatorship" of the PRI fell in disgrace at the hands of Vicente Fox and the PAN, Calderon and the PAN are out, and the PRI is back. Calderon's disaster of a drug war and steady increase in violent crime in general while he was preoccupied fighting the cartels certainly deserve credit, if that is the word, for the return of the rejected.

Now, Calderon's successor, the PRIista Enrique Pena Nieto, has a chance to change course, and his administration has made no secret it wants to. Just this week, Pena Nieto's secretary of the interior, Miguel Angel Osorio Chong, bitterly attacked Calderon's US-backed strategy for causing violence to increase, saying its decapitation strategy had only fractured the cartels, making them "more violent and much more dangerous." The new government will abandon that strategy and instead concentrate on reducing violent crime affecting ordinary civilians, Osorio Chong and Pena Nieto have said.

But having a smarter drug war is not going to get the job done, argues libertarian-leaning Cato Institute senior fellow for defense and foreign policy studies Ted Galen Carpenter in The Fire Next Door. He rather convincingly makes the case that there is no solution to the Mexican drug war short of ending drug prohibition and sucking the money out the multi-billion dollar black market business in the substances we love to consume north of the border. Only then will the cartels be weakened enough to recede as a threat to Mexico and to the US, which as his subtitle indicates, is the real focus of his concern.

British academics Peter Watt and Roberto Zepeda are Carpenter's polar opposites in terms of ideological orientation, but in Drug War Mexico, they arrive at some similar policy prescriptions, at least when it comes to drug prohibition itself. "If the illegal narcotics were decriminalized and stringently controlled, it is likely cartel profits would be severely constrained," they write.

But even that would not suffice, they argue. Legalization is probably a pipe dream for now, and even were it to occur, "it would not necessarily on its own present a long-term answer to the institutional corruption and the eruption of violence in the last few years," they write, noting that drug revenues now make up only about half of cartel earnings, and that legalization does nothing in itself to address the broader economic and political problems that allow the illicit drug business to flourish in the first place.

And that's where they part ways with Carpenter. For Watt and Zepeda, Mexico's "narcoeconomy" is a manifestation of its insertion into the global capitalist economic order, which is the main problem. For Carpenter, global capitalism, the free market, neo-liberalism, whatever you want to call it, is just the status quo.

Thus the differences. Carpenter sees legalization as a market-based solution to the problem of Mexico's drug violence, while Watt and Zepeda see the free market as the problem, legalization as no better than a partial solution to Mexico's drug violence, and fundamental social and economic reform as the necessary precondition.

Differences notwithstanding, both Carpenter and Watt and Zepeda provide histories of drug trafficking in Mexico, the complicity of the state and other actors, and the ins and outs of the cartel wars, and both cast a leery eye on US policies toward Mexico and its drug wars. The US has backed Calderon's militaristic approach with hundreds of millions of dollars in mostly military and law enforcement aid under Plan Merida. Carpenter views this as dangerously empowering the military against civilian institutions, while Watt and Zepeda see it as backing a Mexican ruling class strategy of using the military to repress and intimidate political opposition in the guise of the drug war.

Both are valuable contributions to the ever-growing bibliography of Mexico's prohibition-induced dance of death. Carpenter's primary concern is from a US national security perspective, and his examination of the dangers of the violence left unchecked for the US is sobering. His concentration on the US also leads him to focus like a laser on calling for ending prohibition in the US, after which surely others will follow.

Watt and Zepeda do especially well in unraveling the networks of complicity that embed the Mexican drug trade squarely within the larger economy and polity, and make an especially strong case that the Sinaloa Cartel has received favorable treatment from various state actors. They also deserve kudos for clarifying just how exhaustively and effectively the former PRI-state did not so much repress as manage the drug trade during its tenure.

Those "good old days" of Mexican drug trafficking, where the violence was kept within limits, where the occasional exemplary bust of drug lord kept the Americans at bay, where the drugs flowed quietly and the money accumulated in the pockets of policemen, politicians, and army officers, doesn't look so bad now. That's one strong reason we're starting to hear a lot of talk about reaching an accommodation with the cartels or, more pejoratively, appeasement.

Will Pena Nieto and the PRI cut a deal with the cartels? As Carpenter notes, things have changed. The unitary PRI-state is no more; the number of parties and players who would have to be cut in has grown, and whatever deals are done could be undone in the next election. And the US certainly wouldn't approve. Still, Pena Nieto seems to be signaling to the cartels at least a truce of sorts: "You don't mess with us (by killing, kidnapping, and extorting the good people) and we won’t mess with you (by trying to decapitate your leadership).

That would be a very uncomfortable accommodation, but short of ending drug prohibition, it may be the best Mexico can hope for, at least in the short run. Let's see if the crime rate starts to drop, the grisly killings grow less frequent, the "neutralization" of drug bosses less frequent. There will certainly be no public pronouncement.

But that's a bargain with the devil. Perhaps Mexico can live with the tamed cartels and their insidious corruption, but if it's going to get serious about eliminating their wealth and power, the only answer is increasingly clear, whether you're on the left ,the right, or in the middle.

The Top Ten Drug Policy Stories of 2012 [FEATURE]

In some ways, 2012 has been a year of dramatic, exciting change in drug policy, as the edifice of global drug prohibition appears to crumble before our eyes. In other ways it is still business as usual in the drug war. Marijuana prohibition is now mortally wounded, but there were still three-quarters of a million pot arrests last year. The American incarceration mania appears to be running its course, but drug arrests continue to outnumber any other category of criminal offense. There is a rising international clamor for a new drug paradigm, but up until now, it's just talk.

The drug prohibition paradigm is trembling, but it hasn't collapsed yet -- we are on the cusp of even more interesting times. Below, we look at the biggest drug policy stories of 2012 and peer a bit into the future:

1. Colorado and Washington Legalize Marijuana!

Voters in Colorado and Washington punched an enormous and historic hole in the wall of marijuana prohibition in November. While Alaska has for some years allowed limited legal possession in the privacy of one's home, thanks to the privacy provisions of the state constitution, the November elections marked the first time voters in any state have chosen to legalize marijuana. This is an event that has made headlines around the world, and for good reason -- it marks the repudiation of pot prohibition in the very belly of the beast.

And it isn't going away. The federal government may or may not be able to snarl efforts by the two states to tax and regulate legal marijuana commerce, but few observers think it can force them to recriminalize marijuana possession. It's now legal to possess up to an ounce in both states and to grow up to six plants in Colorado and -- barring a sudden reversal of political will in Washington or another constitutional amendment in Colorado -- it's going to stay that way. The votes in Colorado and Washington mark the beginning of the end for marijuana prohibition.

2. Nationally, Support for Marijuana Legalization Hits the Tipping Point

If Colorado and Washington are the harbingers of change, the country taken as a whole is not far behind, at least when it comes to public opinion. All year, public opinion polls have showed support for marijuana legalization hovering right around 50%, in line with last fall's Gallup poll that showed steadily climbing support for legalization and support at 50% for the first time. A Gallup poll this month showed a 2% drop in support, down to 48%, but that's within the margin of error for the poll, and it's now a downside outlier.

demonstrate a post-election bump for legalization sentiment. Support for legalization came in at 47%, 51%, 54%, and 57%, including solid majority support in the West and Northeast. The polls also consistently find opposition to legalization strongest among older voters, while younger voters are more inclined to free the weed.

As Quinnipiac pollster Peter Brown put it after his survey came up with 51% support for legalization, "This is the first time Quinnipiac University asked this question in its national poll so there is no comparison from earlier years. It seems likely, however, that given the better than 2-1 majority among younger voters, legalization is just a matter of time."

3. Global Rejection of the Drug War

International calls for alternatives to drug prohibition continued to grow ever louder this year. Building on the work of the Latin American Commission on Drugs and Democracy and the Global Commission on Drug Policy, the voices for reform took to the stage at global venues such as the Summit of the Americas in Cartagena, Colombia, in April, the International AIDS Conference in Washington in July, and at the United Nations General Assembly in September.

While calls for a new paradigm came from across the globe, including commissions in Australia and the United Kingdom, this was the year of the Latin American dissidents. With first-hand experience with the high costs of enforcing drug prohibition, regional leaders including Colombian President Santos, Guatemalan President Perez Molina, Costa Rican President Chinchilla, and even then-Mexican President Calderon all called this spring for serious discussion of alternatives to the drug war, if not outright legalization. No longer was the critique limited to former presidents.

That forced US President Obama to address the topic at the Summit of the Americas and at least acknowledge that "it is entirely legitimate to have a conversation about whether the laws in place are doing more harm than good in certain places" before dismissing legalization as a policy option. But the clamor hasn't gone away -- instead, it has only grown louder -- both at the UN in the fall and especially since two US states legalized marijuana in November.

While not involved in the regional calls for an alternative paradigm, Uruguayan President Mujica made waves with his announcement of plans to legalize the marijuana commerce there (possession was never criminalized). That effort appears at this writing to have hit a bump in the road, but the proposal and the reaction to it only added to the clamor for change.

4. Mexico's Drug War: The Poster Child for Drug Legalization

Mexico's orgy of prohibition-related violence continues unabated with its monstrous death toll somewhere north of 50,000 and perhaps as high as 100,000 during the Calderon sexenio, which ended this month. Despite all the killings, despite Calderon's strategy of targeting cartel capos, despite the massive deployment of the military, and despite the hundreds of millions of dollars in US aid for the military campaign, the flow of drugs north and guns and money south continues largely unimpeded and Mexico -- and now parts of Central America, as well -- remain in the grip of armed criminals who vie for power with the state itself.

With casualty figures now in the range of the Iraq or Afghanistan wars and public safety and security in tatters, Calderon's misbegotten drug war has become a lightning rod for critics of drug prohibition, both at home and around the world. In the international discussion of alternatives to the status quo -- and why we need them -- Mexico is exhibit #1.

And there's no sign things are going to get better any time soon. While Calderon's drug war may well have cost him and his party the presidency (and stunningly returned it to the old ruling party, the PRI, only two elections after it was driven out of office in disgrace), neither incoming Mexican President Enrique Pena Nieto nor the Obama administration are showing many signs they are willing to take the bold, decisive actions -- like ending drug prohibition -- that many serious observers on all sides of the spectrum say will be necessary to tame the cartels.

The Mexican drug wars have also sparked a vibrant and dynamic civil society movement, the Caravan for Peace and Justice, led by poet and grieving father Javier Sicilia. After crisscrossing Mexico last year, Sicilia and his fellow Mexican activists crossed the border this summer for a three-week trek across the US, where their presence drew even more attention to the terrible goings on south of the border.

5. Medical Marijuana Continues to Spread, Though the Feds Fight Back

Eighteen states and the District of Columbia have now legalized the use of marijuana for medical purposes, and while there was only one new one this year, this has been a year of back-filling. Medical marijuana dispensaries have either opened or are about to open in a number of states where it has been legal for years but delayed by slow or obstinate elected officials (Arizona, New Jersey, Washington, DC) or in states that more recently legalized it (Massachusetts).

None of the newer medical marijuana states are as wide open as California, Colorado, or Montana (until virtual repeal last year), as with each new state, the restrictions seem to grow tighter and the regulation and oversight more onerous and constricting. Perhaps that will protect them from the tender mercies of the Justice Department, which, after two years of benign neglect, changed course last year, undertaking concerted attacks on dispensaries and growers in all three states. That offensive was ongoing throughout 2012, marked by federal prosecutions and medical marijuana providers heading to federal prison in Montana. While federal prosecutions have been less resorted to in California and Colorado, federal raids and asset forfeiture threat campaigns have continued, resulting in the shuttering of dozens of dispensaries in Colorado and hundreds in California. There is no sign of a change of heart at the Justice Department, either.

6. The Number of Drug War Prisoners is Decreasing

The Bureau of Justice Statistics announced recently that the number of people in America's state and federal prisons had declined for the second year in a row at year's end 2011. The number and percentage of drug war prisoners is declining, too. A decade ago, the US had nearly half a million people behind bars on drug charges; now that number has declined to a still horrific 330,000 (not including people doing local jail time). And while a decade ago, the percentage of people imprisoned for drug charges was somewhere between 20% and 25% of all prisoners, that percentage has now dropped to 17%.

That decline is mostly attributable to sentencing reforms in the states, which, unlike the federal government, actually have to balance their budgets. Especially as economic hard times kicked in in 2008, spending scarce taxpayer resources on imprisoning nonviolent drug offenders became fiscally and politically less tenable. The passage of the Proposition 36 "three strikes" sentencing reform in California in November, which will keep people from being sentenced to up to life in prison for trivial third offenses, including drug possession, is but the latest example of the trend away from mass incarceration for drug offenses.

The federal government is the exception. While state prison populations declined last year (again), the federal prison population actually increased by 3.1%. With nearly 95,000 drug offenders doing federal time, the feds alone account for almost one-third of all drug war prisoners.

President Obama could exercise his pardon power by granting clemency to drug war prisoners, but it is so far a power he has been loathe to exercise. An excellent first candidate for presidential clemency would be Clarence Aaron, the now middle-aged black man who has spent the past two decades behind bars for his peripheral role in a cocaine deal, but activists in California and elsewhere are also calling for Obama to free some of the medical marijuana providers now languishing in federal prisons. The next few days would be the time for him to act, if he is going to act this year.

7. But the Drug War Juggernaut Keeps On Rolling, Even if Slightly Out of Breath

According to annual arrest data released this summer by the FBI, more than 1.53 million people were arrested on drug charges last year, nearly nine out of ten of them for simple possession, and nearly half of them on marijuana charges. The good news is that is a decline in drug arrests from 2010. That year, 1.64 million people were arrested on drug charges, meaning the number of overall drug arrests declined by about 110,000 last year. The number of marijuana arrests is also down, from about 850,000 in 2010 to about 750,000 last year.

But that still comes out to a drug arrest every 21 seconds and a marijuana arrest every 42 seconds, and no other single crime category generated as many arrests as drug law violations. The closest challengers were larceny (1.24 million arrests), non-aggravated assaults (1.21 million), and DWIs (1.21 million). All violent crime arrests combined totaled 535,000, or slightly more than one-third the number of drug arrests.

The war on drugs remains big business for law enforcement and prosecutors.

8. And So Does the Call to Drug Test Public Benefits Recipients

Oblivious to constitutional considerations or cost-benefit analyses, legislators (almost always Republican) in as many as 30 states introduced bills that would have mandated drug testing for welfare recipients, people receiving unemployment benefits, or, in a few cases, anyone receiving any public benefit, including Medicaid recipients. Most would have called for suspicionless drug testing, which runs into problems with that pesky Fourth Amendment requirement for a search warrant or probable cause to undertake a search, while some attempted to get around that obstacle by only requiring drug testing upon suspicion. But that suspicion could be as little as a prior drug record or admitting to drug use during intake screening.

Still, when all the dust had settled, only three states -- Georgia, Oklahoma, and Tennessee -- actually passed drug testing bills, and only Georgia's called for mandatory suspicionless drug testing of welfare recipients. Bill sponsors may have been oblivious, but other legislators and stakeholders were not. And the Georgia bill is on hold, while the state waits to see whether the federal courts will strike down the Florida welfare drug testing bill on which it is modeled. That law is currently blocked by a federal judge's temporary injunction.

It wasn't just Republicans. In West Virginia, Democratic Gov. Roy Tomblin used an executive order to impose drug testing on applicants to the state's worker training program. (This week came reports that only five of more than 500 worker tests came back positive.) And the Democratic leadership in the Congress bowed before Republican pressures and okayed giving states the right to impose drug testing requirements on some unemployment recipients in return for getting an extension of unemployment benefits.

This issue isn't going away. Legislators in several states, including Indiana, Ohio, Texas, and West Virginia have already signaled they will introduce similar bills next year, and that number is likely to increase as solons around the country return to work.

9. The US Bans New Synthetic Drugs

In July, President Obama signed a bill banning the synthetic drugs known popularly as "bath salts" and "fake weed." The bill targeted 31 specific synthetic stimulant, cannabinoid, and hallucinogenic compounds. Marketed under brand names like K2 and Spice for synthetic cannabinoids and under names like Ivory Wave, among others, for synthetic stimulants, the drugs have become increasingly popular in recent years. The drugs had previously been banned under emergency action by the DEA.

The federal ban came after more than half the states moved against the new synthetics, which have been linked to a number of side effects ranging from the inconvenient (panic attacks) to the life-threatening. States and localities continue to move against the new drugs, too.

While the federal ban demonstrates that the prohibitionist reflex is still strong, what is significant is the difficulty sponsors had in getting the bill passed. Sen. Rand Paul (R-KY) put a personal hold on the bill until mandatory minimum sentencing requirements were removed and also argued that such efforts were the proper purview of the states, not Washington. And for the first time, there were a substantial number of Congress members voting "no" on a bill to create a new drug ban.

10. Harm Reduction Advances by Fits and Starts, At Home and Abroad

Harm reduction practices -- needle exchanges, safer injection sites, and the like -- continued to expand, albeit fitfully, in both the US and around the globe. Faced with a rising number of prescription pain pill overdoses in the US -- they now outnumber auto accident fatalities -- lawmakers in a number of states have embraced "911 Good Samaritan" laws granting immunity from prosecution. Since New Mexico passed the first such law in 2007, nine others have followed. Sadly, Republican Gov. Chris Christie vetoed the New Jersey bill this year.

Similarly, the use of the opioid antagonist naloxone, which can reverse overdoses and restore normal breathing in minutes, also expanded this year. A CDC report this year that estimated it had saved 10,000 lives will only help spread the word.

There has been movement internationally as well this year, including in some unlikely places. Kenya announced in June that it was handing out 50,000 syringes to injection drug users in a bid to reduce the spread of AIDS, and Colombia announced in the fall plans to open safe consumption rooms for cocaine users in Bogota. That's still a work in progress.

Meanwhile, the UN Commission on Narcotic Drugs unanimously supported a resolution calling on the World Health Organization and other international bodies to promote measures to reduce overdose deaths, including the expanded use of naloxone; Greece announced it was embracing harm reduction measures, including handing out needles and condoms, to fight AIDS; long-awaited Canadian research called for an expansion of safe injection sites to Toronto and Ottawa; and Denmark first okayed safe injection sites in June, then announced it is proposing that heroin in pill form be made available to addicts. Denmark is one of a handful of European countries that provide maintenance doses of heroin to addicts, but to this point, the drug was only available for injection. France, too, announced it was going ahead with safe injection sites, which could be open by the time you read this.  

This has been another year of slogging through the mire, with some inspiring victories and some oh-so-hard-fought battles, not all of which we won. But after a century of global drug prohibition, the tide appears to be turning, not least here in the US, prohibition's most powerful proponent. There is a long way to go, but activists and advocates can be forgiven if they feel like they've turned a corner. Now, we can put 2012 to bed and turn our eyes to the year ahead.

HSBC Bank Admits Cartel Money Laundering

The London-based HSBC Group, Europe's largest banking entity, has agreed to forfeit $1.256 billion and pay an additional $600 million-plus in fines for laundering money for Mexican drug cartels and other objects of American ire, federal officials announced Tuesday. The agreement was part of a deal to avoid criminal prosecution of the bank by the Justice Department and will result in deferred prosecution provided the bank lives up to its agreements with the Justice Department.

The bank was accused of violating the Banking Secrecy Act, the International Emergency Economic Powers Act, and the Trading with the Enemy Act -- the latter two types of violations having to do with its transactions on behalf of customers in Cuba, Iran, Libya, Sudan, and Burma, all of which were subject to sanctions enforced by the Office of Foreign Assets Control at the time of the violations. The Banking Secrecy Act violations have to do with the banks laundering of at least $881 million for Mexican drug trafficking organizations.

"HSBC is being held accountable for stunning failures of oversight -- and worse -- that led the bank to permit narcotics traffickers and others to launder hundreds of millions of dollars through HSBC subsidiaries, and to facilitate hundreds of millions more in transactions with sanctioned countries," said Assistant Attorney General for Criminal Affairs Lanny Breuer. "The record of dysfunction that prevailed at HSBC for many years was astonishing. Today, HSBC is paying a heavy price for its conduct, and, under the terms of today's agreement, if the bank fails to comply with the agreement in any way, we reserve the right to fully prosecute it."

"Today we announce the filing of criminal charges against HSBC, one of the largest financial institutions in the world," said US Attorney for Eastern New York Loretta Lynch. "HSBC’s blatant failure to implement proper anti-money laundering controls facilitated the laundering of at least $881 million in drug proceeds through the US financial system. HSBC's willful flouting of US sanctions laws and regulations resulted in the processing of hundreds of millions of dollars in OFAC-prohibited transactions. Today's historic agreement, which imposes the largest penalty in any BSA prosecution to date, makes it clear that all corporate citizens, no matter how large, must be held accountable for their actions."

HSBC may have been slapped with the largest penalties ever, but it is hardly the only bank to have been caught profiting off prohibition. In 2010, Wachovia forfeited $110 million to avoid criminal prosecution for money laundering for the cartels, Sigue Corporation forfeited $15 million in 2008, American Express International Bank paid $65 million in fines and Union Bank of California forfeited $21.6 million in 2007, and Bank Atlantic paid a $10 million fine to avoid prosecution for laundering drug cartel profits in 2006. Like HSBC, all of those banks agreed to reform their banking practices and submit to federal oversight as part of the agreement.

HSBC is accused of under-staffing its anti-money laundering program and failing to monitor billions of dollars in purchases of physical dollars by its Mexican affiliate, HSBC Mexico. It reportedly failed to monitor over $670 billion in wire transfers and the purchase of over $9.4 billion in US dollars.

According to the Justice Department, "HSBC Mexico's own lax AML controls caused it to be the preferred financial institution for drug cartels and money launderers."

The unanswered question is why a government that lets bankers who launder hundreds of millions of dollars of drug profits routinely sends crack-slingers to federal prison for decades for selling a few dollars worth of drugs. Perhaps if those drug dealers had a few million dollars they could hand over to the feds, they could walk, too.

Marijuana Votes Have Mexicans Talking Legalization

With US public support for marijuana legalization now at the 50% mark, and state legalization efforts now starting to come to fruition, people are naturally talking about it. Academics at RAND and elsewhere recently came out with a book, "Marijuana Legalization: What Everyone Needs to Know," discussing the wide range of issues impacted by legalization and that will come into play affecting how it will play out. (We are sending out copies of this book, complimentary with donations, by the way.)

One of the most interesting discussions going on is about how legalization in Washington and Colorado will affect Mexico. We reported yesterday that Mexico's incoming administration plans to reassess Mexico's fight against drugs, which has cost the country dearly in lost life. Luis Videgaray, a key advisor to President-elect Enrique Pena Nieto, assures that the president continues to oppose legalization, according to the AP. Nevertheless, other Mexican voices are raising the legalization question with increased intensity.

"It seems to me that we should move to authorize exports," [governor of the the violence-plagued border state of Chihuahaha Cesar] Duarte [an ally of Pena Nieto] told Reuters in an interview. "We would therefore propose organizing production for export, and with it no longer being illegal, we would have control over a business which today is run by criminals, and which finances criminals."
 

And as The Economist noted last week (hat tip The Dish), the Mexico City-based think tank Mexican Institute for Competitiveness (IMCO) believes that legalization may cost the cartels big time. IMCO estimates that Mexican drug trafficking organizations earn $2 billion per year from marijuana, with $1.4 billion of it going to the US. Significantly, IMCO doesn't just think that legalization by the US and Mexico would cut off the cartels from those funds. They have speculated that marijuana grown in Washington and Colorado (particularly Colorado) might be diverted and sold in other states, with a dramatically lowered cost made possible by legalization causing prices to drop elsewhere as well. Lower prices in turn might lead US marijuana users who now buy Mexican weed to switch to marijuana grown in the US instead, even if it's still illegal in their own states.

I am skeptical that we will see that kind of price drop just yet, in the absence of federal legalization, even in Washington or Colorado. It hasn't happened yet from medical marijuana, even though marijuana grown for the medical market is just as divertable as marijuana grown for the recreational market may be -- the dispensaries themselves haven't undercut street prices, partly to try to avoid diversion. Sellers in other states, and the people who traffic it to them, will continue incur the kinds of legal and business risks that they have now. And it is still impossible to set up the large scale farming operations for marijuana that reduce production costs today for licit agriculture. But we don't really know yet.

Now one study is just one study, at the end of the day -- there are other estimates for the scale and value of the marijuana markets and for how much Mexican marijuana makes up of our market. But the cartels clearly have a lot of money to lose here, if not now then when federal prohibition gets repealed -- IMCO's point is valid, whether they are the ones to have best nailed the numbers or not.

It's also the case that some participants in the drug debate, such as Kevin Sabet, have argued that legalization won't reduce cartel violence, because "the cartels will just move into other kinds of crime." But those arguments miss some basic logical points. Cartels will -- and are -- diversifying their operations to profit from other kinds of illegal businesses besides drugs. But it's their drug profits -- the most plentiful and with the highest profit margin -- that enable them to invest in those businesses. The more big drug money we continue to needlessly send them, the more they will invest in other businesses, some of which are more inherently violative of human rights than drugs are.

Some researchers believe that Mexican cartels will step up their competition in other areas, if they lose access to drug trade profits, which could increase violence at certain levels of the organizations. But such effects are likely to be temporary. Nigel Inkster, former #2 person in Britain's intelligence service and coauthor of "Drugs, Insecurity, and Failed States: The Problems of Prohibition," at a book launch forum said he thinks that at a minimum the upper production levels of the drug trade, as well as the lower distribution levels, would see violence reductions. (We are also offering Inkster's book to donors, by the way.)

And it isn't just violence that's the problem. As a report last year by the Center for International Policy's Global Financial Integrity program noted, "[C]riminal networks... function most easily where there is a certain level of underdevelopment and state weakness... [I]t is in their best interest to actively prevent their profits from flowing into legitimate developing economies. In this way, transnational crime and underdevelopment have a mutually perpetuating relationship." The money flow caused by prohibition, accompanied by violence or not, is itself an important enough reason to urgently want to end prohibition as we do, and to reduce the reach of prohibition as much as is politically possible in the meanwhile, as Colorado and Washington have done.

And so Mexican and other thinkers are speaking up, as are victims of the current policy. For all their sakes, President Pena Nieto should not dismiss legalization so quickly. And Sabet and others should not be so quick to try to argue away the impact that the billions of dollars drug prohibition sends each year to the illicit economy has in fueling criminality and hindering societies from developing.

Amnesty Raps Mexico on Human Rights Abuses in Drug War

Mexico must take decisive action to rein in systematic and widespread use of torture, ill-treatment, and other human rights abuses, which have increased dramatically since outgoing President Felipe Calderon unleashed the military to fight the country's so-called cartels nearly six years ago, Amnesty International said in a report released last Thursday.

The report, Known Abusers, But Victims Ignored: Torture and Ill-Treatment in Mexico, documents the increase of cases of torture and ill-treatment by the police and military forces, the lack of effective investigations and almost total lack of prosecutions, and the juridical weaknesses and lack of political will that allow such abuses to go unpunished and even allow testimony obtained through torture to be used to convict its victims.

An estimated 60,000 people have been killed and another 160,000 displaced in prohibition-related violence in Mexico since Calderon made waging the drug war the centerpiece of his then new administration in December 2006. The cartels are responsible for much of the mayhem, but as the violence intensified, human rights complaints filed with federal authorities have more than quadrupled, from 392 in 2007 to 1669 in 2011. Nearly 5,000 federal complaints have been filed overall, and those are just the cases when someone bothered to go through the formality of a process that too often produces no results.

And, the Amnesty report shows, it is mainly just a formality. According to the report, federal prosecutors prosecuted no torture cases in 2007 or 2008, one in 2009, and filed four more in 2010. Similarly, the number of state level torture prosecutions can be counted in the single digits each year since 2007.

"The Calderón administration has effectively turned a blind eye to the 'torture epidemic' we've been witnessing in Mexico," said Rupert Knox, an Amnesty International Mexico researcher. "The protection of human rights has been ignored or sidelined in favor of the government's strategy of militarized combat of organized crime and drug cartels. Across Mexico criminal suspects often face detention and trial on the basis of evidence obtained under torture and ill-treatment while prosecutors and courts fail to question seriously information or evidence obtained in this manner."

Miriam Isaura López Vargas is a case in point. She was arbitrarily detained in Ensenada, Baja California, on February 2, 2011. During interrogation in a military barracks in Tijuana by a civilian federal prosecutor, members of the army reportedly sexually assaulted her, subjected her to near asphyxiation and stress positions, and threatened her in order to coerce her into signing a confession falsely implicating other detainees in drug trafficking offenses.

"I heard a man scream many times, they kept on asking him, 'Where are the guns, where are the drugs?' A bit later I heard 'Take him away and bring me the next one.' I heard them open a door," Lopez Vargas recounted. "They put a wet cloth over my face, when I tried to breathe. I felt the wet cloth, it became difficult to breathe, I then felt a stream of water up my nose, I tried to get up but couldn't because they had me held down by my shoulders and legs… someone was pressing down on my stomach, they did this repeatedly as they kept on asking the same questions."

A week later, she was transferred to Mexico City and held without being brought before a judge until April 26, 2011, when she was charged with drug offenses. The following month, the case against her collapsed, and she was released by a federal judge. She filed a complaint alleging she was tortured; it has yet to be acted on.

The involvement of the Mexican military in the Lopez Vargas is not unusual. Across Mexico,  military personnel performing policing functions have held thousands of suspects in military barracks before presenting them to prosecutors. In this context, there have been numerous reports of torture and ill-treatment while in military custody.

"Federal authorities have shown an absolute lack of leadership to combat torture and ill-treatment seriously at the state level or federal level," said Knox. "The only way to tackle torture and ill-treatment is by ensuring that all cases are properly investigated and those responsible, brought to justice. In a letter sent to Amnesty International, Mexican President elect Enrique Peña Nieto committed to implement policies and take action to end torture, we urge the authorities to abide by their promises."

Drug War Chronicle Book Review: The Lebanese Connection

The Lebanese Connection: Corruption, Civil War, and the International Drug Traffic, by Jonathan Marshall (2012, Stanford University Press, 261 pp., $24.95 HB)

It's harvest time in Lebanon right now, and Shiite farmers in the Bekaa Valley are out working their fields, preparing to turn thousands of acres of cannabis plants into hashish, the Red Lebanese and Blond Lebanese for which the tiny Middle Eastern country is famous. And with the harvest comes conflict, as the country's anti-drug agency and the Lebanese Army head out into the fields to try to eradicate them.

The Chronicle reported at the beginning of August about hash farmers firing machine guns and RPGs at eradicators, vandalizing tractors and bulldozers used to plow under the fields, and organizing street blockades in cities in the valley. Protests broke out in Yammouneh, Baalbek, and Boudai, and authorities backed off, announcing a week later that they would form a committee to study development issues in the Bekaa. And the harvest goes on.

Of course, it wasn't just farmers' resistance that hampered the eradication effort this year. The Bekaa Valley, with its Shiite tribes, sits right next door to Syria, currently embroiled in a brutal civil war now based largely on sectarian and confessional divisions, many of which echo profoundly in Lebanon. In fact, Lebanon was part of Greater Syria until the French carved it out under a League of Nations mandate in 1943. Now, it has seen outbreaks of street fighting between rival pro- and anti-Assad militias in Tripoli, the largest city of the Lebanese north, as well as kidnapping by Shiite tribal militias after some of their number were kidnapped by Sunni militias on the other side of the border.

"Our policy is very clear. We want to demolish all of the hashish cultivation in the Bekaa," Col. Adel Mashmoushi, head of the office of drug control, tells the Lebanon Daily Star a couple of weeks ago, before quickly adding that eradication had been enfeebled this year because "the situation in the Bekaa is very delicate right now" due to "the political and security situation caused by Syria."

Mashmoushi said his men had managed to destroy only about 1,500 acres of cannabis fields out of what he estimated to be somewhere between 7,000 and 10,000 acres planted in the northern valley.

But, as global drug trade scholar Jonathan Marshall makes clear in his masterful and highly informative The Lebanese Connection, despite the terrifying sectarian war next door, the violent echoing clashes in Tripoli, and the Bekaa farmers' and traders' violent defense of their industry, this is a relatively quiet time in Lebanon's history in the international drug trade. According to his elaborately sourced estimates, Lebanese hash production was at level five to seven times higher during the period on which he focuses, the Lebanese civil war of 1975 to 1990.

In fact, relying heavily on archival State Department, Federal Bureau of Narcotics, and DEA documents, among other sources, Marshall shows that the tiny sliver of the Levant that is Lebanon was a giant in the drug trade going as far back as the 1950s and a significant hash producer as early as the end of World War I.

Its largest market back then was Egypt, which had been supplied by Greek growers. But when the Greeks banned cannabis planting in 1918, poor Shiite farmers in the Bekaa took up the slack, and they haven't stopped growing ever since. Production boomed during the civil war and was banned in 1992 after the return of a central government, but it has never stopped. Eradication programs have been half-hearted, ill-conceived, and met with hostility, and promised alternative development schemes somehow never seem to materialize.

But it wasn't just hash, either. With Beirut a rising financial center for the Middle East and the center of global networks of Lebanese traders, Marshall shows definitively how it also became a center of the global drug trade. Opium skimmed from legal production in Turkey was smuggled into Syria by Kurds, transmuted to morphine base by Syrian chemists in Aleppo, smuggled into Lebanon by various means and various actors, transported through seaports controlled by Christian politicians to be delivered to French (later, Italian) organized crime groups, whose chemists refined it into heroin, and whose international networks, including American mobsters, sent it on the veins of consumers in the West.

In a history replete with ton-plus hash busts and multi-kilo heroin seizures, Marshall works his way through the underworld of Lebanon-based drug trafficking, its connections abroad, its crime bosses and political allies, both foreign and domestic. Along the way, he exposes the hypocrisy and cynicism of numerous nations, who with one hand raged against drugs, while with the other were complicit in--or at least looked away from--the billion-dollar a year business.

Marshall excels at seeing through the smoke of the murky milieu where all this took place. And what a milieu! Beirut in the mid-20th Century was a decadent, cosmopolitan oasis in the desert of Middle East culture, home to Westernized Arab princes, anything-goes nightclubs, lavish casinos, and European prostitutes. It was also awash in spies, arms dealers, and adventurers -- the Cold War Russian and American intelligence services, the French, the Israelis, the Syrians, the Turks, and, after the Iranian Revolution of 1979, a flashpoint of the brewing proxy war between the Shia Islam of Iran and the Sunni Islam of Saudi Arabia and the Gulf States.

And Lebanon was a weak, communally divided state operating under a political agreement that divvied up key political positions by sect -- the Christian Maronites got the presidency and the leadership of the armed forces, the Sunnis got the prime minister's office -- but froze those divisions even as the demographic makeup of the country shifted toward its Muslim communities, not to mention an influx of hundreds of thousands of Palestinian refugees from Israel, and later, Jordan after the Hashemite kingdom drove out the PLO in 1970.

A weak central state, rising sectarian tensions, highly profitable drug smuggling operations, external manipulation by any number of foreign interests, and a tradition of corruption in government came together in a perfect storm as Lebanon imploded into civil war in 1975, not to emerge from it for 15 years. When it came to the role of drugs in the conflict or to arming the various factions, Marshall shows definitively that nobody had clean hands.

As the Lebanese economy crumbled amidst the violence, the importance of the illicit drug economy became all the more critical for the militias: they relied on drug profits to pay their soldiers and buy their weapons. The global drug trade may not have been the cause of the conflict (although it was a cause -- Marshall cites incidents of precursor violence between Christian and Palestinian militias over drug deals that helped ratchet up the tension), but he shows that it was profits from the trade in prohibited drugs that allowed the contending factions to make the war deadlier and longer than it otherwise would have been.

He also shows that some of the most deadly fighting was not for sectarian reasons, but over control over lucrative drug smuggling routes and, especially, ports. And, paradoxically, he shows how complicity in the drug trade overcame sectarian and even regional divisions: Syrian soldiers patrolling the Bekaa turned a blind eye to Shiite hash farmers, who trafficked their product with the connivance of Christian Maronite warlords. Meanwhile, Israeli military intelligence turned a blind eye to hash smuggled into and through Israel by its allies in the South Lebanon Army or by other traffickers from whom it thought it could glean intelligence.

The Lebanese Connection is too dense with chewy information to do more than touch on its contents in a review, but it is a sterling contribution to the academic literature on the global drug trade, having made a truly original contribution.  It also opens a revealing view not only on the contemporary Middle East, but contemporary terrorism, covert operations by state and non-state actors, and the making of narco-states and failed states.

It's also a very timely book, appearing as Syria bursts into flames. Syria is Lebanon writ large: many of the same ethnic and sectarian divisions are at play, as is the international meddling at several levels of proxy war, with familiar faces like the US, Britain, France, Iran, Israel, and Saudi Arabia all seeking to influence the outcome and doing goodness knows what behind the scenes. Syria, however, is not a major global drug trade hub, but careful followers of the  situation there will have noted the occasional accusations -- from both sides -- of  "criminals" being involved. Maybe in 20 years, we will have a better idea of what went on behind the scenes and the role of drug trafficking and smuggling networks there. In the meantime, The Lebanese Connection provides some insight into the forces at play.

Book Review: Drugs, Insecurity, and Failed States: The Problems of Prohibition

Chronicle Book Review: Drugs, Insecurity, and Failed States: The Problems of Prohibition by Nigel Inkster and Virginia Comolli (2012, Adelphi, 163 pp. PB, $12.50) 

Longtime readers of Drug War Chronicle likely are already familiar with many -- but not all -- of the topics in Drugs, Insecurity, and Failed States. The Chronicle has been on the ground and reported back from Afghanistan, Colombia, and Mexico -- all of which get individual chapters in this new book -- on the problems generated by drug prohibition in those producer and/or transit nations.

We've also reported to a lesser extent on the drug war's impact on Central America, but almost not at all on its impact in the countries of West Africa, which has become an important staging ground for drug flows from Latin America to Europe and the Middle East. Drugs, Insecurity, and Failed States has individual chapters on these two regions as well.

Even though some of the information is new, the book's thesis should also be familiar to Chronicle readers: The present drug prohibition regime is not only failing to win the war on drugs, it is also setting off and prolonging violent conflict -- both political and criminal -- in producer and transit countries.

We have certainly seen that in spades in the past few decades. In Mexico, which is both a producer and a transit state, the multi-sided drug wars pitting the so-called cartels against each other and the state have left more than 50,000 dead in six years and shaken public confidence in state institutions. In Colombia, profits from the illicit coca and cocaine trade fund leftist guerrilla armies -- one of which, the FARC, has been at war with the state since 1964 -- and rightist paramilitaries alike. In Afghanistan, which supplies almost 90% of the world's opium and the heroin derived from it, both the Taliban and elements of the Afghan state are profiting handsomely from the illicit trade.

Drugs, Insecurity, and Failed States provides succinct, yet fact-filled overviews of the deleterious effects of prohibition in all three countries, as well as West Africa and Central America. In all of them, the lure of the profits of prohibition exceed the threat of law enforcement or the ability of the state to suppress the black market economy. That's not news.

What is newsworthy about Drugs, Insecurity, and Failed States is who has produced it. The authors, Nigel Inkster and Virginia Comolli, are, respectively the director of Transnational Threats and Political Risk at the London-based International Institute of Strategic Studies (IISS) and a research analyst at that august institution. Not only that, Inkster is a veteran of the British Secret Intelligence Service who spent his last two years as the Assistant Chief and Director for Operations and Intelligence. 

The IISS, which was founded to manage the Cold War for the West more than half a century ago, describes itself as "the world's leading authority on political-military conflict." With many former US and British government officials among its members, IISS very much is the establishment, an organ of the global security elite.

When the IISS says a policy has not only failed but has produced counterproductive results, governments tend to listen. Now, we have the IISS quite clearly and vehemently saying that drug prohibition has done both. And that's what makes Drugs, Insecurity, and Failed States so remarkable -- not that we want to give short shrift to the cogent analysis in the book.

It is noteworthy that the authors also take on the international drug control bureaucracy based in UN agencies such as the International Narcotics Control Board (INCB) and the Office on Drugs and Crime. They chide the INCB for not only failing to control the illicit drug traffic, but also with failing to uphold the other part of its mandate: ensuring an adequate supply of opiate-based pain medications. Noting that a handful of Western countries account for a staggering 80% or more of all opioid pain medication usage, Inskter and Comolli clearly think vast portions of the planet are not getting sufficient pain medications, and they blame the INCB. To be fair, though, they also acknowledge other obstacles to the effective treatment of pain in developing nations.

Drugs, Insecurity, and Failed Statesis also useful for its discussion of the alternatives to prohibition and what decriminalization or legalization would and would not achieve. Decriminalization would be a benefit to drug users, they argue, citing the Portuguese experience, but would not address black market profits. And legalization would certainly weaken, but is unlikely to eliminate, the violent criminal organizations running amok in places like Mexico and Central America.

For politically motivated actors, such as the FARC in Colombia and the Taliban in Afghanistan, for which the profits of the drug trade are not an end in themselves, but a means to achieving political goals, legalization would have little impact, except on their revenue streams. Such groups would find other means to continue, Inkster and Comolli suggest.

The book also discusses the prospects for trying to change the global prohibition regime, which is based on the 1961 Single Convention and its two successor treaties. The outlook is not sunny, the authors suggest, given a distinct lack of interest in reforms by such major players as the United States, China, and Russian, not to mention the lack of a hue and cry for change from regions including Africa, the Middle East, and Southeast and East Asia.

But even within the ambit of the global prohibition regime, there is a bit of room for experimentation. The INCB could try to find less restrictive interpretations of the treaties, and the Office on Drugs and Crime could shift its emphases. That could result in some small openings, perhaps for supervised injection sites or heroin maintenance and the like, but not in major changes and not in an end to global drug prohibition.

Drugs, Insecurity, and Failed States concisely restates some old arguments and adds a few new ones, and it provides handy overviews of the problems of prohibition in producer and transit countries. One can only hope that members of the policymaking circles at which it is aimed actually pick it up and read it because the global security establishment is telling them in no uncertain terms that not only is prohibition not working, it's making matters worse.
