End Drug Prohibition to Fight Organized Crime, World Leaders Say [FEATURE]

For nearly a decade now, a collection of former heads of state, high political figures, businessmen, and cultural figures have been working to reform drug policy at the national and international levels. Known as the Global Commission on Drug Policy, this group of planetary elders has been busy issuing reports at the rate of one a year on how to reduce the harms of prohibitionist drug policies and what would be more effective and humane alternatives.

Now they've just released their latest report, Enforcement of Drug Laws: Refocusing on Organized Crime Elites, which takes on the perverse and insidious ways drug prohibition actually empowers and encourages criminal enterprises, and counsels nations and the global anti-drug bureaucracy to find a better way. That includes pondering the possibility of drug legalization and the taming of illicit markets through regulation -- not prohibition, which has demonstrably failed for decades.

The commission rolled out its report Thursday with a virtual presentation on YouTube.

"This report has a new perspective on the problem of organized crime," said commission member Helen Clark, former prime minister of New Zealand and former head of the United Nations Development Program. "Organized crime is a challenge in every society, and if it gets into the political realm and starts corrupting political systems, that is a huge issue, and it has done that," she said.

"Where the commission comes from is that we're saying 'drugs are being caught up in this' because of the refusal of the international community to accept that drugs need to be responsibly regulated," Clark continued. The attempt to prohibit them has actually been a license for organized crime to build a half-trillion dollar a year industry peddling stuff. Could we take drugs out of that through responsible regulation?

As president of Colombia between 2010 and 2018, Juan Manuel Santos mediated a peace treaty with the leftist guerrillas of the FARC and won a Nobel prize for his efforts. He also presided over a country that is perennially in contention for being the world's largest cocaine producer. He knows about what drug prohibition can bring.

"I come from a country that has fought drug traffickers and drug trafficking for so long and has probably paid the highest price of any country in the world -- Colombia has lost its best leaders, best journalists, best judges, best policemen -- and we are still the number one exporter of cocaine to the world markets," Santos said. "Corruption and drug trafficking go hand in hand. The most dangerous and protected individuals often escape, while ordinary people who happen to use illicit drugs see their lives destroyed by the war on drugs," he argued.

"To fight organized crime, we must follow the money," Santos continued. "People are realizing that a war that has been fought for a half century and has not been won is a war that has been lost, and so you have to change your strategy and your tactics if you want to be successful. Corruption, violence, profits, and prohibition are very closely related. You do away with prohibition, you regulate, you bring down the profits, and immediately you will start to see an improvement in violence and corruption."

The commission's work centers around five pathways, explained commission chair and former Swiss president Ruth Dreifuss.

"It is putting health first," she said. "Second, it is also giving priority to the use of some of these substances for their medical benefits. It is one of the dramatic situations also, mainly in poor countries, that the people have no access to scheduled pain killers. The third pathway, which we think is very important, is to end the criminalization of people who use drugs. The fourth chapter of our reform program is that we have to deal with the criminality related to drugs, and that is why we issued this report today. And the last point is that we have to take control. The state -- reasonable and responsible people -- have to take control of drug markets and not let them stay in criminal hands."

While the 52-page report provides a detailed, evidence-based examination of the challenges of grappling with criminal groups that thrive under prohibition, it summarizes its findings with five basic recommendations for national governments and at the United Nations, whose anti-drug treaties form the legal backbone of global drug prohibition. These are:

  1. States must acknowledge the negative consequences of repressive law enforcement approaches to drug policies and recognize that prohibition forges and strengthens criminal organizations. Sharing such conclusions with the public must then feed national debates to support bold drug policy reform. (We all know the litany by now: From racially-biased and militarized policing and over-incarceration in the United States to bloody drug wars in Mexico and Colombia financed by prohibition profits, to the murderous and repressive anti-drug campaign in the Philippines, enforcing drug prohibition has dreadfully harmful consequences.)
  2. States must analyze the transnational and trans-sectorial nature of criminal organizations, to review and reform the current exclusive focus on law enforcement. (Drug trafficking organizations don't just traffic drugs; they tend to get their fingers in whatever illicit enterprises can turn a buck for them, from wildlife smuggling to counterfeiting to extortion. And maybe we'd be better off devoting more resources to treatment and prevention instead of trying to suppress and arrest our way out of the problem.)
  3. States must develop targeted and realistic deterrence strategies to counter organized crime and focus their response on the most dangerous and/or highest profiting elements in the criminal market. States must also reinforce interdepartmental cooperation to address criminal markets in a broad sense, not solely drugs, and develop effective transnational coordination against trans-border criminal groups and international money laundering. (It's both cruel and ineffective to target drug users and street-level dealers for arrest and prosecution. But the recent Mexican experience has shown that the alternative strategy of going after "kingpins" can lead to an increase in violence as gang lieutenants engage in murderous struggles to replace each capo killed or captured. It's a real dilemma -- unless you undercut them by ending prohbition.)
  4. States must consider the legal regulation of drugs as the responsible pathway to undermine organized crime. (This increasingly seems like a very reasonable approach.)
  5. UN member states must revisit the global governance of the international drug control regime in order to achieve better outcomes in public health, public safety, justice, and greater impact on transnational organized crime. (It's way past time to nullify or amend the anti-drug treaties that guide international drug policies.)

The Global Commission on Drug Policy has laid out a framework for radical reform. Now, it's up to the nations of the world and the international institutions that bind us together to act.

CT Lawmakers Push to Add Children and Hospital Patients to Medical Marijuana Program

This week the General Law Committee of the Connecticut House and Senate gave its approval for a final vote to add children to the state's medical marijuana program with certain restrictions.

The main provision that was added to gain the Committee's support would block minors from smoking or vaporizing marijuana despite a doctor's recommendation. While the debate did stir the standard, "We don't want people to think it's okay for kids to smoke weed" argument, it also gave opportunities for the new rhetoric being heard in state capitols around medical marijuana a chance to shine. Rep. Dan Carter made an excellent case for not restricting a doctors ability to treat a patient telling the Connecticut Post:

"I do believe there's a clear need with respect to younger patients," Carter said. "In a way, I think we're putting the political part of it above the health part of it. I think there should be freedom for those practitioners who are going to prescribe this to utilize any delivery system they need to do. Clearly there are benefits, certain times, to inhale certain products. If we shut it down and say you can't smoke it or you can't vaporize it, I think in a way that retards... some of the studies we need to do."

The provision has a chance of being removed with time, more so with folks like Dan Carter already on the right side of the fence. With the way things are going, I don't expect a 16 year old smoking a joint on the way to chemo to rip at the moral fabric of society much longer.

The bill will also allow hospitals and hospices to administer cannabis to their patients. This will be a major factor in improving the quality of life for folks forced to live under medical supervision. Also it would request a group of pediatricians be formed for the purpose of adding more ailments to the 11 already approved for use in the state.

In general the bill represents a step forward, with a bit of a pothole that will be filled in time. Time is also the keyword in getting it passed, as lawmakers have until midnight on June 3rd to vote on the bill.

What To Do About the Drug Trade in West Africa? [FEATURE]

Over the past decade, West Africa has emerged as an increasingly important player in the global illicit drug trade. Although the region has historically not been a drug producing one -- with the important exception of marijuana -- it has become a platform for predominantly Latin American drug traffickers moving their illicit commodities toward lucrative European and Middle Eastern markets. The cocaine traffic alone is worth more than a billion dollars a year, according to a 2013 report from the UN Office on Drugs and Crime (UNODC).

And the trade is becoming more complex. Now, it's not only cocaine flowing through the region, but heroin destined mainly for Western Europe and methamphetamines being manufactured there and exported to Asia and South Africa, that same UNODC report found.

The region -- stretching along the African coast from Nigeria to the east to Senegal on the west, and extending deep into the Sahara Desert in countries such as Mali and Niger -- is plagued by weak states and corrupt governments, making it attractive to criminals of all sorts, who thrive in lawless lands. And it's not just criminals. The region is also home to various bands of Islamist militants, some of whom are involved in the drug trade.

Now, a commission of prominent West Africans is calling for fundamental changes in drug policies in the region. Last week, the West Africa Commission on Drugs, issued a report, Not Just in Transit: Drugs, the State and Society in West Africa, calling for the decriminalization of drug use, treating drug use primarily as a public health issue, and for the region to avoid becoming the next front line in the failed war on drugs.

The commission is impressive. It was initiated by former UN Secretary-General Kofi Annan of Nigeria and headed by former Nigerian President Olusegun Obasanjo, and includes other former heads of state as well as a distinguished group of West Africans from the worlds of politics, civil society, health, security and the judiciary.

And so is its very existence. It marks the entrance of West African civil society into the international debate on drug policy in which calls for fundamental drug reform have gained increasing momentum in recent years. In 2008, former Latin American heads of state and other luminaries formed the Latin American Commission on Drugs and Democracy, and in 2011, Annan and other world luminaries and former heads of state came together to form the Global Commission on Drug Policy. Now, West Africa adds its voice to the chorus calling for change.

"We call on West African governments to reform drug laws and policies and decriminalize low-level and non-violent drug offenses," said Obasanjo upon the report's release last week. "West Africa is no longer just a transit zone for drugs arriving from South America and ending up in Europe but has become a significant zone of consumption and production. The glaring absence of treatment facilities for drug users fuels the spread of disease and exposes an entire generation, users and non-users alike, to growing public health risks."

"Most governments' reaction to simply criminalize drug use without thinking about prevention or access to treatment has not just led to overcrowded jails, but also worsened health and social problems," added Kofi Annan.

"We need the active support and involvement of civil society and of the international community," said commission member Edem Kodjo. "South America, where most of the drugs smuggled to West Africa come from, and Europe, which is the main consumer market, must take the lead to deal with both production and consumption at home. We cannot solve this problem alone; governments and civil society have to come together in West Africa to help prevent the drug problem from getting completely out of hand."

The report won kudos from American drug reformer Ethan Nadelmann, head of the Drug Policy Alliance.

"First Europe, then the Americas, now Africa," he said. "Drug policy reform is truly becoming a global movement, with Kofi Annan and Olusegun Obasango providing the sort of bold leadership that we've also seen in Latin America. Maybe, just maybe, West Africa will be spared the fate of other parts of the world where prohibition-related crime, violence and corruption spiraled out of control."

But some analysts, while welcoming the report, suggested that it did not get at the heart of the problem in West Africa.

"The report focuses on public health, and that's great, but I'm not sure that's the issue," said Vanda Felbab-Brown, a senior fellow with the Center for 21st Century Security and Intelligence in the Foreign Policy program at the Brookings Institution who has published extensively on West Africa. "Nor are there generally large prison populations due to the arrests of low-level drug offenders. There is increasing drug use, and many addicts don't have access to public health. That, however is not because they were arrested, but because Africa in general doesn't have access to public health," she pointed out.

"In some senses, the commission report is preventative -- it warns of policies that would be counterproductive -- but it is not going to solve West Africa's problems," Felbab-Brown continued. "And the harm reduction approaches that dominate the discourse in Europe and the US are not really apropos for West African public health issues. The increasing focus of the international community is interdiction, but that accounts for only a small fraction of the total traffic, and the report doesn't deal with what kind of alternate law enforcement there should be, or who should be targeted."

But others thought the criminal justice and public health emphasis in the report were a step down the right path.

"The report's message about alternatives to criminalization for use and minor offenses is important in criminal justice terms -- to discourage the horrible over-representation of minor drug offenders in prisons in the region -- but also as a reminder that there are no such alternatives unless the health and social sectors develop those alternatives," said Joan Csete, deputy director of the Open Society Foundation's Global Drug Policy Program.

"Health ministries need to be as important around the drug policymaking table as the police, which is far from the case in most of Africa today," she added. "Services for treatment of drug dependence in the region are absent or of appalling quality. Improving health and social support for people with drug dependence is a key to drug policy reform in West Africa."

And Felbab-Brown agreed that while measures like drug prevention and treatment wouldn't solve the region's problems, they would still be helpful.

"We're already seeing quite a bit of heroin in the region, and we are seeing increasing use," she said. "These are cheap and prevalent commodities, the traffickers partake in kind, and user communities are being established. In a sense, developing strategies to prevent use, get treatment, and prevent the spread of HIV and Hepatitis C is useful because there are more and more users."

But for Felbab-Brown, the key problem for West Africa is its weak and corrupt states.

"The big trafficking issues are around the intersection of very poor, very weak, very corrupt, and often very fragile states with state participation in various forms of criminality," she said. "Drugs are just another commodity to be exploited by elites for personal enrichment. Elites are already stealing money from oil, timber, and diamonds, and now there is another resource to exploit for personal enrichment and advancement," she argued.

"One narrative has it that drug trafficking has caused fragility and instability, but I think trafficking compounded the problems; it didn't create them," Felbab-Brown continued. "There is a systematic deficiency of good governance. Many of these states have functioned for decades like mafia bazaars, and the trafficking just augments other rents. There are rotten governments, miserable institutions, and poor leadership around all commodities, not just drugs."

"The states are not monolithic," Csete noted. "Some have high-level corruption, some are aggressive in trying to fight money-laundering and other elements of organized criminal networks, some rely heavily on traditional interdiction methods. Some of these countries have relatively strong democratic systems and relatively strong economic growth; some have governance institutions that are less strong."

The state of the states in West Africa influenced the commission and its recommendations, Csete said.

"Legalization of drugs -- production, sale, consumption -- was not judged to be politically feasible or necessarily desirable by the commission," she explained. "I think the commissioners generally perceive that generally these countries do not yet have a political climate favorable to debate on progressive changes in drug policy. The whole idea of the commission and its report is to open those debates -- high-profile people from the region saying things that sitting officials do not find it politically easy to say."

"These are newer post-colonial states," Felbab-Brown noted. "Are we having unreasonable expectations? Is this like Europe in the 13th Century, or is that some of these countries are doomed to exist in perpetual misgovernance?"

While there may be concern in Western capitals about the specter of West African drug trafficking, many West Africans have other, more pressing, drug policy concerns.

In its 2013 report, the UNODC noted that the importation of fake pharmaceutical drugs from South and Southeast Asia into the region was a problem. Joey Tranchina, a longtime drug policy observer who has recently spent time in Mali, agrees.

"Having traversed Mali from Bamako to Mopti, except for the usual oblique indigenous references to smoking weed, the only personal experience I have with drug crime is counterfeit pharmaceuticals from India, China, and Russia," he said. "They're sold cheap in the streets to people who can't afford regular meds and they take the place of real pharmaceuticals, especially malaria and HIV drugs. These drug scams are killing people in Mali," he said.

"Most people in West Africa don't see drug trafficking as that much of a problem," said Felbab-Brown. "If it's mostly going to Westerners, they say so what? For them it is a mechanism to make money, and those drug traffickers frequently become politicians. They are able to create and reconstitute patronage networks around drug trafficking, just as they were once able to get elected with money from blood diamonds."

It seems that, to the degree that drug use and drug trafficking are West African problems, they are problems inextricably interwoven with the broader issues of weak, fragile, and corrupt states that are unable or unwilling to deliver the goods for their citizens. The West Africa Commission on Drugs has pointed a way toward some solutions and avoiding some failed policies already discredited elsewhere, but it seems clear that that is just the beginning.

Colorado Bill to Seal Old Marijuana Convictions Wins Committee Vote. The Senate Judiciary Committee passed a bipartisan sponsored bill that would allow someone to have their marijuana conviction sealed, if the conviction is now legal under Amendment 64. The committee heard nearly two hours of public comment before approving the measure, Senate Bill 14-218. The bill passed on a 3-2 vote and is now headed to the Committee on Appropriations.

Medical Marijuana

Louisiana Medical Marijuana Bill Dies in Committee. There will be no medical marijuana legislation passing through the Louisiana legislature this year. Senate Bill 541, sponsored by Sen. Fred Mills (R-New Iberia) was defeated in the Senate Health and Welfare Committee on a vote of 6-2.

Iowa Limited CBD Medical Marijuana Bill Passes Senate. The Iowa Senate on Thursday approved a narrow opening for Iowa parents with children suffering from severe epilepsy to be able to access cannabis oil as a treatment option. After an emotion-charged debate, senators voted 36-12 to pass Senate File 2360, a bill that legalizes the possession and medical use under certain conditions of cannabidiol, a non-psychoactive component of marijuana that backers say possesses a wide range of therapeutic benefits. Ten Republicans joined 26 Democrats in passing the bill. Sen. Joe Bolkcom (D-Iowa City) is the sponsor.

US House Narrowly Defeats Amendment to Allow VA Docs to Recommend Medical Marijuana. Nearly 200 members of Congress, including 22 Republicans, voted in favor of an amendment Wednesday intended to allow physicians within the Veterans Affairs system to recommend medical marijuana to veterans in states that allow it. The bipartisan-sponsored amendment failed 195-222. The amendment, sponsored by Congressmen Earl Blumenauer (D-OR), Sam Farr (D-CA), Dana Rohrabacher (R-CA), and Jared Polis (D-CO), was the first of its kind to be introduced on the House floor. It would have become part of House Resolution 4486, the Military Construction and Veterans Affairs and Related Agencies Appropriations Act.

Asset Forfeiture

Florida Sheriff on Asset Forfeiture Rampage. Marion County Sheriff Chris Blair is seizing criminal suspects' assets like never before, according to this report from The Ocala Star Banner. Prior to Blair taking office in 2012, asset forfeiture cases averaged 38 a year, but jumped to 57 last year, and there are already 33 so far this year. Now, Blair is expanding the practice beyond drug cases to include common crimes. Suspects face being stripped of their property after being arrested by officers for DUI, shoplifting, burglary, armed robbery, resisting arrest, driving with a suspended or revoked license, or grand theft. One woman had her 2008 Chevy seized after being caught with a few oxycodone pills. Here's the money quote (so to speak), as Blair's office explains the increase in seizures: "It shows the difference between a sheriff with 35 years of law enforcement experience and a sheriff who came from the business world," Chief Deputy Fred LaTorre explained. Class Action Lawsuit Coming Over Nevada County's Highway Robbery Asset Forfeiture Program. Humboldt County already had to give back the money it stole from driver Tan Nguyen under the guise of its highway asset forfeiture program -- and pay his lawyer's fees -- but now the county faces a class action lawsuit from other victims of its overzealous law enforcement practices. After Ngyuen won his case against the Humboldt County Sherff's Department, 20 more people have come forward to say that they too had been stopped in Humboldt County and forced to give up money without any charges or even being accused of a crime. In many cases, they weren't even slapped with a speeding ticket. "What they're doing is profiling. They think they're stopping people who are on their way to California to buy drugs, and then bring them back to the Midwest or the Eastern states, and then sell them," said John Ohlson, he attorney for the cash seizure victims.

Drugged Driving

"Impaired" Driving Bill Wins Vermont Senate Committee Vote. The Senate Judiciary Committee Wednesday approved a drugged driving bill, House Bill 501, but not before amending it to remove the zero tolerance language in the version passed by the House. Instead, the Senate version now says the amount of drugs in your system has to actually impair your ability to drive. While the distinction between the two bills seems small, it may be a tough fight to hammer out a compromise by next Friday, when the session adjourns. The version of the bill cited here is the original; the amended version is not yet available.

Law Enforcement

Delaware Drug Lab Scandal Could See Thousands of Drug Cases Thrown Out. The Delaware Public Defender's Office on Wednesday filed "the first wave" of legal challenges to try and overturn 9,500 drug convictions because of tampering and thefts at the state's drug testing lab. This is on top of the more than 3,700 pending drug prosecutions in Delaware courts that are at risk of being dismissed due to the scandal at the Controlled Substances Lab inside the Delaware Medical Examiner's Office. And on the same day that public defenders delivered five archive boxes containing 112 motions for post-conviction relief to prosecutors and the court, state officials revealed that an employee at the Medical Examiner's Office has been suspended with pay as an investigation into the missing drug evidence continues. Georgia Narc Denied Immunity in Killing of Innocent Pastor in Drug Investigation. A narcotics officer who fatally shot a Baptist pastor in Georgia persuaded a federal judge to partly reduce the jury-imposed $2.3 million verdict, but failed in his bid to claim qualified immunity because he was acting in his capacity as a law enforcement officer. Billy Shane Harrison shot and killed Pastor Jonathan Ayers after Ayers attempted to flee in his car from undercover officers attempting to question him in a drug investigation. The judge in the case ruled that "defendant could not have reasonably believed that Ayers posed an imminent threat of serious harm or that deadly force was necessary to prevent his escape," the 11-page ruling states. "And because it is clearly established that it is unreasonable for a police officer to use deadly force under such circumstances, defendant's motion for judgment as a matter of law based on qualified immunity is denied." No criminal charges were ever filed against Harrison for the killing.

Maine Governor Says He Found Money to Pay for More Drug War. Gov. Paul LePage (R) announced Wednesday that his administration has found $2.5 million to pay for a drug enforcement bill that would add agents, judges and prosecutors and increase funding for addiction treatment programs. The bill was enacted with broad bipartisan support, but the Legislature's budget committee did not fund it. On Wednesday, the LePage administration said it has found a projected surplus in the state's unclaimed-property fund, which is overseen by the State Treasurer's Office and consists of money and personal assets that are considered lost or abandoned. The governor said he will propose emergency legislation today to allocate the surplus to the drug enforcement initiative. But it's unclear whether the Legislature will consider it. The ACLU of Maine, which has consistently opposed the bill, urged lawmakers to reject LePage's proposal. "The governor continues to push a proposal that would scale up an already bloated criminal justice system while giving a back seat to more effective treatment programs," the group said. "Plenty has been said about the need for a balanced approach, but this proposal is nothing of the sort... A truly balanced approach would mean scaling back law enforcement while increasing treatment and prevention."

Sentencing

National Academy of Sciences Report Calls for Big Cuts in Imprisonment. A groundbreaking report released yesterday by the National Research Council, the principal operating arm of the National Academy of Sciences, documents the unprecedented and costly price of US incarceration rates. As the report points out, this unprecedented rate of incarceration is a relatively new phenomenon in US history. America's prison population exploded largely as a result of the failed drug war policies of the last 40 years. The report calls for a significant reduction in rates of imprisonment and says that the rise in the US prison population is "not serving the country well." It concludes that in order to significantly lower prison rates, the US should revise its drug enforcement and sentencing laws.

Sentencing Commission Submits Federal Sentencing Guideline Amendments to Cut Drug Sentences. On Wednesday, the US Sentencing Commission submitted its proposed amendments to the federal sentencing guidelines to Congress. In addition to recommending reductions in some drug sentences, the Commission is also seeking public comment on the issue of whether to apply the amendment to the drug quantity table retroactively. Comments can be made through July 7 and can be emailed to [email protected].

Federal Judge Calls for Clemency for Convicted Cocaine Dealer. In an opinion issued Tuesday, US District Court Judge Paul Friedman urged President Obama to commute the sentence of Byron McDade, who was convicted following a jury trial in 2002 of conspiracy to distribute more than five kilograms of cocaine. Friedman sentenced McDade to 27 years in prison, the shortest sentence possible under federal sentencing guidelines, which were mandatory at the time. Prior to his conviction in the drug case, McDade had only a single misdemeanor on his record, for which he paid a $10 fine. "The sentence this Court was required to impose on Mr. McDade was unjust at the time and is 'out of line' with and disproportionate to those that would be imposed under similar facts today," Friedman wrote in his opinion dismissing McDade's latest bid to overturn his conviction. "While the Court is powerless to reduce the sentence it was required by then-existing law to impose, the President is not. The Court urges Mr. McDade's appointed counsel to pursue executive clemency on Mr. McDade's behalf so that justice may be done in this case." The administration recently called on federal drug prisoners to seek clemency.

International

Silk Road Internet Drug Sales Web Site Still As Busy As Ever. Eight months after federal agents brought down the man alleged to be running an underground Web site called Silk Road that had become a thriving venue for drug trafficking, not only is the site up and running again but the new version is more vibrant than ever. Busted Not Broken, a report from watchdog group the Digital Citizens Alliance claims the "online black market economy has done a complete somersault in the six months since the fall of the original Silk Road. Lebanese Druse Leader Walid Jumblatt Says Legalize Marijuana. Walid Jumblatt, stalwart of the Lebanon's Druse community and leader of the Progressive Socialist Party, said Thursday he supported marijuana legalization, for both medical and economic reasons. "Never in my life have I smoked marijuana, but I support growing cannabis for medical use and to improve the living conditions of farmers in north and the Bekaa Valley," Jumblatt told Al-Jadeed TV. "Let's legalize cannabis and regulate its cultivation," the politician said. Crop substitution programs in the Bekaa Valley, which once saw a multi-billion marijuana trade, have been a failure, he added.

New Biography Says Obama Smoked Pot -- A Lot

President Obama has written about his drug use as a teenager, but excerpts from a new biography of the president portray him as a party hardy high school and college marijuana user. And that has reform advocates calling foul on a president who laughs off serious questions about marijuana legalization and whose Justice Department is cracking down on medical marijuana distribution.

The new biography, Barack Obama: The Story, is written by veteran Washington political journalist David Maraniss and contains extensive material about the president's smoke-filled young adulthood including his leading role in the Choom Gang, with "choom" used as verb meaning to get high.

Obama choomed his way through the Punohao School in Honolulu and Occidental College in Los Angeles, Maraniss reports, citing interviews with the president's erstwhile colleagues. And young Obama wasn't just experimenting; he showed signs of being a serious pothead.

He created a pot-smoking trend among his peers called "TA," short for "total absorption," and also is credited with popularizing the notion of "roof hits," or rolling up all the windows in a car while smoking, then tilting one's head back and sucking the last remnants of smoke from the roof.

Young Barry and his Choom Gang buddies were so serious about their fun that they assessed penalties on their peers for wasting smoke by not inhaling fully. If you wasted smoke, you were penalized by being passed by the next time the joint came around. "Wasting good bud smoke was not tolerated," a member of the gang told Maraniss.

The president-to-be was also an eager pot smoker. He was known for elbowing his way in out of turn when a joint was being passed, shouting "Intercepted!" and taking an extra hit.

Obama seemed to retain his marijuana-friendly attitude until he attained the presidency. While there are no stories of him getting baked while editing the Harvard Law Review, he was critical of the drug war while an Illinois senator, and as a presidential candidate, he vowed to not go after medical marijuana in states where it is legal.

But as president, he has converted himself into a full-blown prohibitionist, laughing off marijuana legalization, continuing to fund the drug war at the same high levels (and with the same law enforcement heavy spending ratio), and attempting to export US drug war strategies to violence-wracked areas like Mexico and Central America. And, after a year and a half of relatively benign neglect, his Justice Department has turned on medical marijuana providers with a vengeance.

The publication of the Maraniss excerpts provoked a response from Ethan Nadelmann, executive director of the Drug Policy Alliance, who chided the president for his shifting stance and warned there could be a political price to pay.

"Barack Obama won a lot of hearts and minds some years ago when he talked so openly and frankly about his youthful marijuana use. That contrasted refreshingly with Bill Clinton's hemming and hawing about not having inhaled, much less George Bush's refusal to even acknowledge what old friends revealed about his marijuana use," Nadelmann noted. "But the president has been losing lots of hearts and minds, especially those of young voters, with his striking silence on marijuana issues since he became president -- apart from providing lame excuses for the federal government's aggressive undermining of state medical marijuana laws.

"Most disappointing is his failure to say a word as president about the fact that half of all drug arrests each year are for nothing more than possessing a small amount of marijuana, which is something Barack Obama did lots of in his younger days, or to offer any critical comments about the stunning racial disproportionality in marijuana arrests around the country," Nadelmann continued. "Roughly twice as many people are arrested for marijuana possession now as were arrested in the early 1980s, even though the number of people consuming marijuana is no greater now than then. If police had been as keen on making marijuana arrests back then, it's quite likely that a young African American man named Barry Obama would have landed up with a criminal record -- and even more likely that he would not have his current job."

Recent polls show support for marijuana legalization at 50% or higher, with even higher levels of support among liberals and Democrats. It is time for Obama to address the issue, Nadelmann said.

"President Obama needs to come clean once again about marijuana -- but this time he needs to speak not of his own youthful use but rather of the harmful consequences of today's punitive marijuana policies for young Americans today," he said.

We're Winning Any Time the President is Forced to Say the Word "Legalization"

This MSNBC footage is pretty exciting to see.

Obama got dragged kicking and screaming into this debate, and it's a significant moment even if he didn’t give up any new ground. Just look at what happened here. Obama had to travel all the way to Colombia to argue against legalizing drugs, and he didn’t do a particularly good job. The drug war debate looked nothing like this just a few short years ago, i.e. I do not recall Bill Clinton or George W. Bush being forced into any situations like this one.

The impact of a symbolic moment like this is something we can't exactly measure, but my take on the situation is that the lights are being turned on. People are talking about the drug war more than ever before, which creates a kind of pressure that hasn’t existed in the past.

When both sides of the debate are talking about policy change, that says a lot, even if one side isn't serious about it. Opponents of legalization are now in the awkward position of pretending that there's some kind of 3rd way to handle this, and they're going to look sillier from one day to the next as the problem gets worse under their watch. What happens after the "reforms" offered by the Obama Administration and people like Kevin Sabet fail to save a single life south of our border? We're going to find out.

What's So Funny About the War on Drugs?

For all the progress that's been made towards bringing the drug policy debate into the political mainstream, there remains a tragic tendency among many in the press to burst out laughing at the idea of fixing our disastrous drug laws. The latest embarrassing example comes courtesy of Al Kamen in The Washington Post:

Yes, we know that jobs and the economy are the marquee issues for this campaign. Even major topics such as war and education are getting short shrift among the wannabe nominees.

But those reefer-mad kids over at Students for Sensible Drug Policy are trying to, uh, smoke the candidates out on their favorite subject.

Pass the chips, dude. This is some entertaining TV. 

Pass the chips? Wow. I can't speak for Al Kamen, but there's nothing about the War on Drugs that makes me hungry for junk food. Eric Sterling didn't like Kamen's tone very much either and responded with a deservedly harsh letter to the editor:

Regarding Al Kamen’s Jan. 18 column “ ‘Reefer Madness’ for the YouTube Generation”:

This article is consistent with my hypothesis that the rules of professional conduct of journalists or some style manual require that articles about drug policy include a joke about chips, brownies or junk food. Can reporters and editors be so humor-deprived that they always have to joke about laws and policies that every year put hundreds of thousands of cannabis users in handcuffs, give them a criminal record and cost hundreds of millions of dollars on pointless police overtime. Ha, ha, ha, “pass the chips”; I’m dying with laughter.

Kamen's childishness is meant to be cute, I assume, but it plainly belittles a gutsy effort by a concerned group of young Americans to ask valid questions of candidates on the campaign trail. How odd it is that he calls attention to these young activists bravely confronting prominent politicians, only to turn around and insult them. For what…caring about something?

Is the arrest of close to a million Americans a year for marijuana a strange or entertaining thing to be upset about? For that matter, is our world-record incarceration rate and the spiraling costs that go along with it? Is the escalating violence in Mexico amusing to anyone? If these things aren't funny, then we should be applauding rather than laughing when someone works to ensure that we don't ignore these issues entirely when choosing our next president.

Last week marked the 40th Anniversary of President Nixon declaring a war on marijuana and other drugs. In an oped in the New York Times last week, timed for the 40th Anniversary, former President Jimmy Carter called for reforming marijuana laws.

The legislation also comes on the heels of the Global Commission on Drug Policy, which released a report on June 2 calling for a major paradigm shift in how our society deals with drugs, including calling for legal regulation of marijuana. The report sent a jolt around the world, generating thousands of international media stories.  The commission is comprised of international dignitaries including Kofi Annan, former Secretary General of the United Nations; Richard Branson, entrepreneur, founder of the Virgin Group; and the former Presidents of Brazil, Colombia, Mexico, and Switzerland. Representing the U.S. on the commission are George P. Shultz, Paul Volcker, and John Whitehead.

46.5% of Californians voted last year to legalize marijuana in their state, and voters in Colorado, Washington and possibly other states are expected to vote on the issue next year. In the past year at least five state legislatures have considered legalizing marijuana, including California, Maine, Massachusetts, Rhode Island, and Washington. 16 states and the District of Columbia have legalized marijuana for medical use, but the federal Drug Enforcement Administration (DEA) continues to arrest people under federal law and U.S. Attorneys have in recent months sent threatening letters to state policymakers in an apparent attempt to meddle in state decision-making.

Rep. Frank’s legislation would end state/federal conflicts over marijuana policy, reprioritize federal resources, and provide more room for states to do what is best for their own citizens.

WASHINGTON, D.C. – Today, for the first time in history, two bills that would benefit members of the medical cannabis industry were introduced in Congress. The introduction of the bills, which address banking and tax issues faced by medical cannabis providers, follow months of advocacy by the National Cannabis Industry Association (NCIA). The bills were part of a coordinated introduction of three bills to protect and support medical marijuana patients and providers in states where the use of medical marijuana is legal. The third bill, the “States’ Medical Marijuana Patient Protection Act,” would modify federal law so that individuals acting in compliance with state law are immune from federal prosecution.

            The industry bills were introduced with bipartisan lead sponsors. Rep. Pete Stark (D-CA) and Rep. Dana Rohrabacher (R-CA) are the lead sponsors of the “Small Business Tax Equity Act of 2011,” which would amend Section 280E of the Internal Revenue Code so that medical marijuana providers can take standard business deductions like any other business. The “Small Business Banking Improvement Act of 2011,” sponsored by Rep. Jared Polis (D-CO) and Rep. Ron Paul (R-TX), would allow financial institutions to work with medical marijuana businesses without the fear of running afoul of federal banking regulations.

            These bills have been introduced at a time when the nation is witnessing a strange reaction by U.S. Attorneys to the development of state-regulated systems of medical marijuana distribution. In October 2009, the Department of Justice issued a memo to federal prosecutors, instructing them to de-prioritize the prosecution of individuals acting in compliance with state medical marijuana laws. This has given states like New Mexico, Colorado and Maine the ability to establish tightly regulated system. Yet some U.S. Attorneys, faced with the prospect of sensible regulations being established in other states, have issued misleading and threatening letters to sidetrack legislative and administrative progress.

            “There are hundreds of thousands of medical marijuana patients in this country who benefit when they are able to purchase their medicine from safe, reliable and regulated establishments,” said Steve Fox, NCIA’s director of public affairs. “It is time for the federal government to acknowledge that these businesses are providing a service to their communities, not causing them harm. Without these regulated, tax-paying businesses, all medical marijuana sales would occur underground. The profits would bolster the criminal market and local, state and federal governments would receive no tax revenue. These medical marijuana providers are not looking for special treatment. They just want to be able to function in a manner similar to any other legal business. That is what these tax and banking bills would allow.”
