Federal Budget: House 2009 Appropriations Bill Contains Even More Drug War Funding Increases... And a Slight Cut to Plan Colombia

Just two weeks ago, the Congress passed the $787 billion economic stimulus bill, which included $3.8 billion for law enforcement, much of it destined for continuing the war on drugs. On Monday, the free-spending House Democratic leadership was at it again as it unveiled its fiscal year 2009 omnibus appropriations bill, and again there is more money for drug law enforcement.

To the undoubted dismay of drug reformers, taxpayer groups, fiscal conservatives, and good governance advocates alike, the Edward Byrne Memorial Justice Assistance Grant program looks to once again get increased funding. The appropriations bill contemplates $2 billion for the Office of Justice Programs, a 16% increase over 2008's $1.679 appropriation. The biggest chunk of that will go to the Byrne JAG grant program.

While the Byrne JAG grants can be used to fund drug courts and drug prevention programs, they are most commonly used to fund multi-jurisdictional anti-drug law enforcement task forces, such as the ones that ran amok in Texas in recent years. Arguing that the spending had not proven effective, the Bush administration attempted to substantially reduce or even zero out Byrne JAG grant funding, but faced constant opposition from "tough on crime" representatives from both parties.

Besides funding the Byrne JAG grant program at higher levels than last year, the appropriations bill includes $550 million for the Community Oriented Policing Services (COPS) program, which got $1 billion just two weeks ago in the economic stimulus bill. It also includes another $3.2 billion for state and local law enforcement crime prevention grants -- another area where the Bush administration sought and got funding reductions. This grant program was cut from $4.7 billion to $2.7 billion during the Bush years.

The Drug Enforcement Administration is also a winner, garnering an $84 million increase over 2008 and pushing its annual budget to $1.9 billion. That includes $73 million earmarked "to fight meth including targeted areas in 'hot spots.'"

And so is the Federal Bureau of Prisons. The congressional response to a federal prison system straining under the results of harsh federal drug law enforcement and sentencing laws is to simply increase the prison budget. Under the bill, the BOP budget would jump nearly 10% to $6.2 billion.

There are also drug war spending increases -- and one notable decrease -- in the State Department and foreign operations section of the appropriations bill. The Merida Initiative to assist the Mexican state in its battle against violent drug trafficking organizations would get $405 million. That's on top of a $465 million emergency appropriation already passed. And the State Department's Bureau of International Narcotics Control and Law Enforcement -- known colloquially as "drugs and thugs" -- is in line for a whopping 35% budget increase, from $557 million in 2008 to $875 million this year.

The one drug war loser in the appropriations bill is Plan Colombia, known as the Andean Counterdrug Program under the Bush administration. With the US having poured more than $5 billion into the program since 1999, only to see coca production increase, House Democrats are moving to shave just a few dollars from that failed program. Instead of the $405 million the Bush administration requested for 2009 or the $320 million that Plan Colombia received in 2008, the new appropriations bill has only $315 million for the Andean drug war.

Law enforcement was among the winners in the massive economic stimulus bill passed last week by Congress and signed this week by President Obama. The package includes nearly $3.8 billion for state and local law enforcement, much of it destined for enforcing the country's draconian drug laws.

The biggest single chunk of police money in the bill, $2 billion, goes to fund the Edward Byrne Memorial Justice Assistance Grant program. While Byrne JAG grant funds may be used for a variety of state and local criminal justice programs, including drug courts and drug treatment programs, the bulk of Byrne JAG spending has gone to fund multi-jurisdictional anti-drug task forces.

The Byrne JAG program has been criticized by fiscal conservatives and progressive reformers alike as ineffective and a waste of money. The Bush administration tried repeatedly to zero out funding for the program, but it was always reinstated -- albeit sometimes at lower levels -- by the Congress.

The second largest chunk of police spending in the bill, $1 billion, is for the Community Oriented Policing Services (COPS) program. It will pay to put thousands more police officers on the street.

The bill also includes $225 million in state and local law enforcement grants "to improve the functioning of the criminal justice system" and another $225 million for law enforcement assistance to Indian tribes. There is another $40 million in grants "to provide assistance and equipment" to police agencies along the Mexican border, with $10 million of that allocated for the Bureau of Alcohol, Tobacco, Firearms and Explosives for its Project Gunrunner aimed at reducing gun smuggling into Mexico. Another $125 million is destined for rural states and rural areas to prevent and combat crime, "especially drug-related crime."

Cops and elected officials are already salivating and have created huge wish lists. The public safety wish list from the US Conference of Mayors totaled $5.5 billion and includes items such as $1.6 million for SWAT equipment, $56,000 for military grade rifles, $625,000 for unmanned aerial surveillance drones, and $130,000 for "covert operations" in Arlington, Texas; $600,000 for a "live fire" SWAT team practice house and $420,000 for a SWAT armored vehicle in Sparks, Nevada; $3.5 million for "Air Tactical Unit Support and Equipment" (read: cool new helicopter) for Hampton, Virginia; and $60,000 for five "tactical entry rifles" and other equipment in Ottawa, Iowa. Incarceration: Federal Judges Order California to Free Tens of Thousands of Prisoners

A panel of federal judges charged with overseeing the California prison system tentatively ruled Monday that the state must release tens of thousands of inmates from its swollen prison population to reduce overcrowding. The three-judge panel said that no other action would improve conditions so awful that inmates regularly commit suicide or die from lack of proper medical care.

The state must present a plan to bring inmate numbers down within two to three years, the judges said. They suggested a target of 108,000 to 121,000 inmates from the current California prison population of around 158,000. That would mean that somewhere between 36,000 and 50,000 prisoners would be freed.

According to the California Department of Corrections and Rehabilitation Services year end 2007 report, some 34,000 drug offenders were imprisoned in the Golden State. That figure includes some 1,500 marijuana or hashish offenders.

"There are simply too many prisoners for the existing capacity," they wrote in the 10-page order. "Evidence offered at trial was overwhelmingly to the effect that overcrowding is the primary cause of the unconstitutional conditions that have been found to exist in the California prisons."

The San Francisco-based panel said it may hold more hearings before making the decision final. It suggested the state could reduce the prison population by the amount required through changes in parole and other policies without endangering the public safety.

Reducing the size of the nation's largest state prison system "could be achieved through reform measures that would not adversely affect public safety, and might well have a positive effect. This is particularly true considering that California's overcrowded prison system is itself, as the governor, as well as experts who have testified before the Court, have recognized, a public safety hazard," the judges said.

The order came quickly after the judges heard two days of closing arguments last week. The judges said they hoped to force the state to either reach a settlement with attorneys for the inmates who brought the lawsuit or to act on its own to rectify the situation. Previous negotiations had failed to achieve a settlement, leading to a two-week trial in November and December.

"Obviously, the governor and I strongly disagree with the panel's conclusions and our response will be based on how best to protect the public from a court-ordered release of inmates," said CDCR Secretary Michael Cate said in a statement.

But the judges said California largely brought the problem on itself, and that savings from reforms could help pay for reentry services for the expected flood of ex-inmates. "California, like most other states, is in the throes of an unprecedented economic crisis," the panel noted. State law enforcement, courts, and rehabilitation services are stretched tightly in the state's $42 billion budget deficit crisis.

The judges pointed out that the CDCR has projected it could save $800 to $900 million a year by sending fewer parolees back to prison on technical violations and by increasing good time for inmates who take classes and vocational programs. "It appears from these figures that the State could easily fully fund all the community rehabilitative and other programs... without expending any funds other than those regularly provided in the prisons budget," the judges wrote.

This is not a done deal yet, but we could be seeing the beginning of the end of California's massive over-incarceration binge. Too bad it's taking an intervention by the federal courts to wean the state of its addiction to mass imprisonment.

Feature: Is This the Year New York's Rockefeller Drug Laws Will Be Repealed?

For more than 35 years, New York state has had the dubious distinction of having some of the country's worst drug laws, the Rockefeller drug laws passed in 1973. While pressure has mounted in the past decade to repeal those draconian laws, the reforms made to them in 2004 and 2005 have proven disappointing. But now, in what could be a perfect storm for reform, all the pieces for doing away with the Rockefeller drug laws appear to be falling into place.

New York is now governed by an African American, David Paterson, who was arrested in an act of civil disobedience against the Rockefeller drug laws and who has vowed to reform them. The Democratic leader of the state Assembly, Sheldon Silver, is on board for serious reforms. And for the first time in years, Democrats also control the state Senate. Add to that mix the budgetary crisis in which the state finds itself, and it would appear that this is the year reform or repeal could actually happen.

But it hasn't happened yet -- no bills have even been filed -- and there is opposition to real reform, mostly from district attorneys, representatives whose upstate districts depend on prisons as a jobs program, and the law enforcement establishment. Those folks may latch onto pseudo-reforms as a means of blocking real reform.

Their handbook could be the State Sentencing Commission report issued this week. That report, commissioned by Gov. Paterson last year, calls for marginal reforms in sentencing and parole, as well as limited judicial discretion, but leaves too much power in the hands of prosecutors, said reform advocates.

"The Sentencing Commission proposal was positive in that it would return some judicial discretion in limited cases," said Caitlin Dunklee, coordinator of the Rockefeller repeal coalition Drop the Rock. "But we hope and will press for more sweeping and meaningful reform of the Rockefeller laws. This report was the product of a commission composed of many prosecutors and corrections people, and it does not go far enough."

"I can't believe at this particular moment that they would put this out," said Gabriel Sayegh of the Drug Policy Alliance (DPA) New York state office. "Not only does it not include real reforms to the Rockefeller Drug Laws, but it takes a step backward," Sayegh continued. "The commission acted as though the political climate we're in is not happening. It's like they drafted this thing from a cave."

DPA wants judicial discretion and treatment programs, which are included in the Sentencing Commission report, Sayegh said. "The problem is that when you dig into the details of the recommendations, what they are actually saying is that their version of judicial discretion, expanding treatment, and expanding diversion opportunities are all crafted out of the prosecutorial perspective. Prosecutors would maintain their leading roles and their diversion criteria would eliminate half the people from even being considering for it. That's the substance of our objections to the report," Sayegh said.

While Sayegh criticized Gov. Paterson for allowing the commission to "continue with its bumbling," he also took heart from Paterson's non-response to the report's release. "Paterson was going to hold a public event around the release, but that got changed to a press conference, and then even that got cancelled," he noted. "We see that as a good sign, an indication that he will not lend his backing to this report."

Instead, Sayegh said, a much better starting point would be the report issued two weeks ago by Assembly leader Sheldon Silver, Breaking New York's Addiction to Prison: Reforming New York's Rockefeller Drug Laws. In that report, Silver laid out the "principles" of reform:

  • Ilegal drugs should remain illegal. Adults who sell drugs to children, individuals who use guns in drug deals, and drug kingpins deserve harsh punishment.
  • Mandatory minimum sentences for low-level offenders must go. Mandating that judges sentence drug users and very low level street sellers to state prison has not impacted crime or reduced addiction but, rather, has led to a massive increase in New York's prison population with a disproportionate number of Latinos and African-Americans being incarcerated.
  • Real judicial discretion means an end to mandatory minimum prison sentences for Class B felony drug offenses and second time, nonviolent drug offenders and the placing of an equal emphasis on alternatives to incarceration and treatment. Except for the most serious crimes, judges in New York already have the discretion to fashion appropriate sentences for criminal acts. Judges should have the ability to make an informed decision whether circumstances warrant imposing a state prison sentence in drug crimes just as they do in cases of many assault, larceny, property damage and any number of other crimes.
  • District Attorneys should continue to play a key role in the process, but they should not be able to veto a judge's discretion. Indeed, to the extent there are district attorney-sponsored initiatives, such as Drug Treatment Alternative to Prison (DTAP) programs that have proven success rates with the limited populations they serve, judges will have the discretion to continue them.
  • Existing maximum determinate sentences for first and second class B level felony and below offenders should be maintained so that if a judge decided circumstances warrant, those who commit the crime will do serious time.

Partial reforms like those achieved in 2004 and 2005 are not going to cut it, said Caitlan Dunklee. "The reforms in 2004 and 2005 failed across the board... the only positive thing about them was that a few hundred people got to go home to their families, but they failed to address the underlying inequities of the Rockefeller drug laws. Specifically, they failed to return any discretion to judges, perpetuating the one size fits all justice that has led to huge levels of incarceration in New York."

The 2004 and 2005 reforms can be judged by their fruits. According to a Drop the Rock 2008 fact sheet, 5,657 people were sent to prison in 2004 for nonviolent drug offenses. That number increased to 5,835 in 2005, 6,039 in 2006, and 6,148 in 2007. About 40% of drug offenders behind bars in New York, some 5,300 people, are doing time simply for drug possession. And more than half of all drug offenders behind bars are doing time for the lowest level drug felonies, which involve only tiny amount of drugs. For example, it takes only a half-gram of cocaine to be charged with a Class D possession felony. More than 1,200 people are currently locked up for that offense.

So, is 2009 the year that real reform (or outright repeal) of the Rockefeller drug laws will happen? DPA thinks so, and held a conference two weeks ago to help make it happen. New Directions for New York: A Public Health and Safety Approach to Drug Policy brought together numerous drug policy stakeholders in an effort to break the grasp of the criminal justice template on drug policy.

"This was the first time in state history where we had stakeholders ranging from the Medical Society of New York to needle exchange providers to people who actively use injection drugs and do outreach to reduce HIV to academics, prosecutors, and elected officials," said Sayegh. Although New York has good drug policy programs -- harm reduction offices, overdose prevention strategies in place -- the overall discussion is still framed too much by the criminal justice perspective, Sayegh said.

"There is an apparatus in place to lead the charge for more progressive drug policies, but the discussion is framed by the Rockefeller laws," he said. "At this conference, stakeholders who are focused on the Rockefeller laws met with groups who focus on treatment, harm reduction, and medical research. We used the four-pillars approach pioneered by Vancouver, which for many people was a new concept. This allowed them to look at drug policy and reform from a new conceptual perspective, and that's part of what will bring about change."

Sayegh is guardedly optimistic about the prospects for reform this year. "In the past, we hadn't been able to move forward because the prosecutors controlled the language and logic of the debate," he noted. "But now, we can provide the legislature with new language and a new framework, the logic of public health, not criminal justice. This will make the legislature much more willing to move on reform proposals. Who doesn't like public health?"

"I'm very optimistic," said Drop the Rock's Dunklee. "I think we'll see a progressive piece of legislation get passed this year that will include meaningful restoration of judicial discretion in drug cases. Hopefully, it will also include an expansion of funding for alternative to incarceration programs like job training and drug treatment."

Not everyone was so sanguine. "I'm optimistic that something will happen, but I don't think its going to be as profound as everyone would like," said Randy Credico of the William Moses Kunstler Fund for Racial Justice, which has been part of the Rockefeller repeal effort for years. "That's because there is no street movement anymore, not a lot of grassroots pressure.

While mobilizations in 2004 and 2005 put tens of thousands of people on the street calling for reform, the minor reforms achieved then took the steam out of the mass movement, Credico argued. "Some people thought incremental change would work then," he said, "but we said it's better to get no loaf than half a loaf. That way, the pressure would remain and build. But we got half a loaf, and four years later, all these guys are still in jail and all the air has gone out of the movement."

"And it's not just the Rockefeller drug laws -- we need to completely overhaul the criminal justice system, from sentencing to the appointment of judges to judge-shopping by prosecutors to racial profiling to banning stop and frisk searches. People need to focus on the overall criminal justice system, or just as many people will be going to prison as we have now."

Drop the Rock's Dunklee begged to differ with Credico over the state of the mass movement for reform. "Drop the Rock is the statewide campaign for repeal, and we haven't gone away," she said. "There is a movement. The 25,000 signatures we've gathered on our petition for repeal is a sign of that. Last year, we took more than 300 people up to Albany, and we will do it again this year."

Still, Dunklee conceded, the partial reforms of 2004 and 2005 did take a lot of air out of the movement. "The media spun that like they were real reforms, and that did weaken the movement," she said. "But in terms of movement building, we still find it easy to organize around this issue because people are so pissed off. I think there is still a lot of energy there."

That energy will be needed in the coming months. While New York's budget mess will occupy legislators for the next few weeks, they will eventually turn to the Rockefeller law reforms. No bills have been filed yet, but they are expected shortly. And hearings are set for May. This year's battle to repeal the Rockefeller drug laws is just getting underway.

Drug Task Forces: House Passes Economic Stimulus Bill with Byrne Grant Funds Intact, Reform Advocates Mobilize

The US House of Representatives Wednesday passed the $819 billion economic stimulus bill endorsed by the Democratic leadership and President Obama. The $4 billion in "public safety" funding in the bill includes $3 billion for the Byrne Justice Action Grant program and $1 billion for the Community Oriented Policing (COPS) program. (For detailed coverage of the Byrne grant program, which funds multi-jurisdictional anti-drug task forces, see our story last week here.) But reform advocates, including 15 national organizations, are calling for the funding to be removed or redirected and hoping the Senate will listen.

In a Thursday press release, the groups warned that "a 'stimulus' directed at law enforcement is misguided and could be counterproductive by increasing costly arrests and imprisonments for lower-level offenses." Instead, the groups called for the $4 billion to be spent on "more comprehensive approaches" that will reduce incarceration rates and decrease spending on jails, prisons, and police. They called for spending to be refocused on education, job training, treatment, and other programs shown to boost communities and local economies.

"Economic security is a crucial element of an effective public safety strategy, but this funding will stimulate neither Main Street nor safe streets," said Tracy Velázquez, executive director of the Justice Policy Institute (JPI), a research organization that studies alternatives to incarceration. "Instead of placing our limited resources in the most expensive, deep end of the system -- police and prisons -- it's time we move more funding upstream, to the kinds of jobs and programs that are proven to promote safety and support communities."

Under the Bush administration, both the Byrne grants and the COPS program were slashed because they were "not able to demonstrate an impact on reducing crime," and the Byrne grants' "lack of long-term goals and measures inhibited targeting of resources to address crime needs," as the Office of Management and Budget put it.

"A $4 billion mistake now will be magnified in the future; jails and prisons will continue to grow at the expense of states and counties, which will be forced to find funds to imprison people by cutting critical community services," said Velázquez. "Let's seize this opportunity to move in the right direction by investing in a more positive future."

The bill now heads to the Senate.

The groups calling for eliminating the Byrne grant and COPS funding are: the American Civil Liberties Union, the American Humane Association, the American Psychological Association, the Center for Children's Law and Policy, the Drug Policy Alliance, the Interfaith Drug Policy Initiative, the Justice Policy Institute, the Open Society Policy Center, the National Black Police Association, the National Council on Crime and Delinquency, the Rebecca Project for Human Rights, the Sentencing Project, Students for Sensible Drug Policy, the United Methodist Church, and Youth Represent.

If there are any silver linings in the current economic, fiscal, and budgetary disaster that afflicts the US, one of them could be that the budget crunch at statehouses around the country means that even formerly sacrosanct programs are on the chopping block. With drug offenders filling approximately 20-25% of prison cells in any given state, prison budgets are now under intense scrutiny, creating opportunities to advance sentencing, prison, and drug law reform in one fell swoop.

Nationwide, corrections spending ranks fourth in eating up state budget dollars, trailing only health care, education, and transportation. According to the National Association of State Budget Officers, five states -- Connecticut, Delaware, Michigan, Oregon and Vermont -- spend more on prisons they than do on schools.

The US currently spends about $68 billion a year on corrections, mostly at the state level. Even at a time when people are talking about trillion dollar bail-outs, that's a lot of money. And with states from California to the Carolinas facing severe budget squeezes, even "law and order" legislators and executive branch officials are eyeing their expensive state prison systems in an increasingly desperate search to cut costs.

"If you look at the amount of money spent on corrections in the states, it's an enormous amount," said Lawanda Johnson of the Justice Policy Institute. "If they could reduce prison spending, that would definitely have an impact on their state budgets. Now, a few states are starting to look at their jail and prison populations," she said.

Among them:

Alabama: The state Department of Corrections is facing a 20% budget cut in 2009. Alabama Corrections Commissioner Richard Allen is telling legislators he will try to "dampen down" the number of new inmates by working on sentencing reform, community corrections, new pardon and parole rules, and a supervised reentry program. The number of Alabama prisoners jumped from nearly 28,000 in March 2006 to more than 30,000 in December 2008, an increase Allen said was caused in part because the legislature had created 67 new felony crimes since 2001.

California: With a prison population of more than 170,000 and the state facing budget deficits of gargantuan proportions, Gov. Arnold Schwarzenegger (R) has suggested eliminating parole time for all non-serious, nonviolent, and non-sex offenders. His plan would cut the parole population by 65,000 people, more than half the 123,000 currently on parole. It would also reduce by tens of thousands the number of people behind bars in the Golden State by increasing good-time credits for inmates who obey the rules and complete rehabilitation. That move could cut the prison population by 15,000 by June 2010. Schwarzenegger's proposal is opposed by -- you guessed it -- the California Correctional Peace Officers Association, for which mass imprisonment is a job security issue.

Colorado: Gov. Bill Ritter (D) has proposed extensive cuts in the state corrections system, including closing two state prisons, delay the construction or expansion of two other prisons, and selling a department-owned 1,000-acre ranch. Those cuts would eliminate at least 71 jobs and save $13.6 million in the coming fiscal year.

Kentucky: Gov. Steve Beshear (D) and state legislators last year granted early release to some 1,800 prisoners, including some violent offenders, in a bid to take a bite out of the state's $1 billion budget deficit. Although Beshear and the legislature have protected the Corrections Department from budget cuts afflicting nearly all other state agencies and programs, the state's dire financial straits are making passage of a treatment-not-jail bill for drug offenders more likely this year. That could save the state $1.47 million.

Michigan: Gov. Jennifer Granholm (D) will propose keeping prison spending near the $2 billion mark in 2010, 57% higher than a decade ago, but legislators are about to chew on proposals for reform from the Council of State Governments Justice Center to cut the number of state prison inmates by 5,000. That would save about $262 million by 2015, far short of the $500 million annual savings now being called for by the Detroit Chamber of Commerce, among others. The Justice Center proposals include cutting the average time above the minimum sentences inmates serve from 27% to 20%. Some 12,000 inmates have already served more than their minimum sentences. Deputy Corrections Director Dennis Schrantz said those proposals were only the beginning, noting that the state had closed nine prisons since 2003 and will close three more this year.

Mississippi: Faced with an emergency $6.5 million (2%) budget cut for the current fiscal year, the state Department of Corrections is moving to reduce the number of inmates in county and regional jails and private prisons. The state pays counties $20 per inmate per day to house them and pays private prison companies at least $31.70 per inmate per day. The state will remove 300 inmates from county jails and 50 from private prisons. Corrections Commissioner Chris Epps also has sent a list of 2,900 nonviolent inmates to the parole board for possible early release. The department may also grant early release to prisoners with severe medical problems, allowing the state to cut costs by not having to provide medical care for them.

New York: With a $15 billion budget deficit and a Department of Correctional Services eating up $2.5 billion a year -- more than any other state agency -- Gov. David Paterson (D) is seeking to release 1,600 offenders early and reform or repeal the state's draconian Rockefeller drug laws. The prison budget has continued to increase despite a whopping 35% drop in crime in the last decade and a prison population at the lowest levels since the 1980s. Now Correctional Services Director Brian Fischer wants to close prison camps and correctional annexes sitting empty with a thousand beds, saving the state $100 million and cutting the 31,000 corrections department employees by about 1,400 through attrition. It's a start.

South Carolina: After running in the red for the last two years, the state's prison director, Jon Ozmint, told legislators he needed $36 million for the current fiscal year, leaving the solons with three choices: cut spending for health, education, or other services; finance corrections through the reserve, or close prisons. Legislators last year rejected Ozmint's suggestion that they save money by releasing prisoners early and closing prisons. This year, Ozmint is suggesting that the state reduce the requirement that serious felons serve 85% of their sentence to 70%. The prison crisis in South Carolina has prompted the normally pro-prison Charleston Post & Courier to call for "alternative sentencing that could keep nonviolent offenders out of prison" and "revising mandatory minimum sentences."

Virginia: Telling legislators "we want to lock up people we're afraid of and not ones we're mad at," Virginia corrections director Gene Johnson said this week Gov. Tim Kaine (D) wants to release some nonviolent offenders 90 days early to save the state $5 million a year. Nearly 1,200 inmates would qualify for early release, he said. Virginia has already closed five prisons employing 702 people, and may resort to limited lay-offs, Johnson told legislators.

This is by no means a list of all the states grappling with prison spending in the current crisis. Correctional costs are on the agenda at statehouses across the country, but as the list above suggests, the economic squeeze is providing openings for reform.

"In the handful of states that have already opened legislative sessions this year, the corrections budget is frequently raised in budget conversations," said Ryan King, an analyst for The Sentencing Project. "A number of governors have raised the issue. It will definitely be on the table. With the recession really taking hold this year, it will be a major, major issue," he said.

"With each passing year, there is a little greater acknowledgement that we are in a position where states are spending far too much money to incarcerate and can't build their way out of it, but the prison population is still increasing each year," said King. "If we want to talk about a sustainable reduction in the prison population, we need to revisit who is going and for how long, as well as a critical evaluation of sentencing laws, repealing mandatory minimums, and expanding parole eligibility. Those are the big steps that need to be taken."

There is still resistance to reform, King said, but things are changing. "There is now much broader consideration of amending parole and probation policies, along with diversion of drug offenders," he said. "Those are probably the two most widely achieved reforms in the last few years. We will probably see more of that, but if we're going to move this from diverting a few thousand people to really addressing the 1.5 million in prison, we are going to have to start asking whether people belong in prison for decades, whether life without parole is really necessary. The real engines of growth for the prison population are admissions and sentence lengths, and a lot of policymakers are still uncomfortable having that conversation."

After decades of seemingly endless sentence increases and prison-building, perhaps the wheel is beginning to turn. Politicians immune to "bleeding heart" pleas for humanity are not immune to pocket-book issues. But while change is starting to come, the US remains a long way from losing its crown as the world's leading jailer.

Prohibition: UN Drug Chief Says Black Market Drug Profits Propped Up Global Banking System Last Year

Profits from the global illicit drug trade helped keep the international banking system afloat during the crisis that swept the global financial system during the second half of last year, the UN's leading drug fighter said in an interview with the Austrian magazine Profil, which was made available Sunday. Drug money was almost the only available capital for banks, said Antonio Maria Costa, executive director of the UN Office on Drugs and Crime (UNODC).

Costa's remarks came as the Profil interviewer questioned him about the size of the global drug market. "If you look at agriculture markets, it is the most important," Costa replied. "According to our calculations, the wholesale value of illegal drugs is more than $90 billion, in the range of world meat and grain trade. The street trade, we assess at a volume of over $320 billion."

While profits from the illicit drug trade fund political violence by the likes of the Taliban or Colombia's leftist FARC insurgents and rightist paramilitaries, they are also finding their way into the coffers of the world banking system at a critical time, Costa said. The drug business is one of the few global growth industries right now, he noted.

"The drug trade at this time could be the only growth industry, with little unemployment," Costa explained. "The money that is being made is flowing only partly back into illegal activities, in parts of Asia, Africa, and South America, where it is used to bribe politicians, buy elections, or finance insurgents, such as the Talibans in Afghanistan, the Tamil Tigers of Sri Lanka, or the FARC in Colombia, for example."

The rest of the profit, Costa said, "is fed into the legal economic circulation through money laundering. We do not know how much, but the volume is imposing. As such, seen from the macroeconomic effect, this is simply bringing in investment capital. There are indications that these funds also ended up in the finance sector, which has been under obvious pressure since the second half of last year. In many instances, drug money is currently the only liquid investment capital, to buy real estate, for example," Costa continued. "In the second half of 2008, liquidity was the banking system's main problem and hence liquid capital became an important factor."

When pressed on just how this was accomplished, Costa responded: "It appears that interbank credits have been financed by money which comes from the drug trade and other illegal activities. It is naturally hard to prove this, but there are indications that a number of banks were rescued by this means."

Costa noted that money laundering controls put in place to stop drug trafficking have "ironically" resulted in drug traffickers sitting on large stashes of cash -- the ultimate liquid financial instrument. "To get around the electronic surveillance of bank transactions, now criminals stash their funds in cash sums which can be up to hundreds of millions of dollars. This is the way they try to hold these funds liquid."

There go those drug dealers propping up the global economy.

Feature: Narcs Cheer -- House Economic Stimulus Bill Would Give Byrne Grant Program $3 Billion Over Three Years

As part of the $825 billion economic stimulus bill passed by the House last week, the Democratic Party leadership and the Obama administration included $3 billion for the controversial Byrne Justice Assistance Grant program, which funds multi-agency drug task forces across the country, and $1 billion for the Community Oriented Policing (COPS) program, which will pay for thousands of additional police officers to hit the streets. Drug enforcement lobby groups are pleased, particularly about the Byrne funding, but others predict that any "stimulus" more Byrne grants might provide will be followed long-term drag on state budgets in ways going beyond the federal dollars.

In one of the few drug policy-related decisions made by the Bush administration that reformers could cheer, the Bush administration tried throughout its second term to reduce or eliminate funding for the Byrne grants. In so doing, it was heeding the concerns of conservative and taxpayer groups, who called the program "an ineffective and inefficient use of resources." But while the Bush administration tried to gut the program, Congress, still tied to the "tough on drugs" mentality, kept trying to restore funding, albeit at reduced levels.

The Byrne grant program, and especially its funding of the scandal-ridden multi-jurisdictional anti-drug task forces, also came in for harsh criticism from drug reform, civil rights and criminal justice groups. For these critics, the program was in dire need of reform because of incidents like the Tulia, Texas, scandal, where a Byrne-funded task force police officer managed to get 10% of the black population of the town locked up on bogus cocaine distribution charges. Scandals like Tulia showed the Byrne grant program "did more harm than good," the critics wrote in a 2006 letter demanding reform.

Of course, Tulia wasn't the only Byrne-related scandal. A 2002 report from the ACLU of Texas found 16 more scandals involving Byrne grant-funded task forces in Texas, including cases of witness tampering, falsifying of government records, fabricating evidence, false imprisonment, racial profiling, and sexual harassment. Byrne-related scandals have also occurred in other states, including the misuse of millions of dollars of grant money in Kentucky and Massachusetts, false convictions because of police perjury in Missouri, and making deals with drug offenders to drop or lower charges in exchange for cash or vehicles in Alabama, Arkansas, Georgia, Massachusetts, New York, Ohio, and Wisconsin.

In accord with its own budget-cutting imperatives, and in response to critics on the right and left, the Bush administration again tried to zero out the Byrne grant program in FY 2008. While the program was indeed cut from $520 million in 2007, Congress still funded it at $170 million for 2008. Now, it has folded the Byrne program and the Clinton-era COPS program into the emergency economic stimulus bill, leading to loud cheers from the law enforcement community.

"Safe communities are the foundation of a growing economy, and increased Byrne JAG funding will help state and local governments hire officers, add prosecutors and fund critical treatment and crime prevention programs," said National Criminal Justice Association President David Steingraber, executive director of the Wisconsin Office of Justice Assistance. "I applaud the stimulus bill proposed by the House Democrats and press Congress for its quick approval."

"This is very encouraging," said Bob Bushman, vice-president of the National Narcotics Officers Associations Coalition and a 35-year veteran of drug law enforcement in Minnesota. "We think it's a very good sign that this was included in the House bill. The House side was where we struggled in past years. Maybe now the House has listened to us and is taking our concerns more seriously," he said. "We built a broad coalition of law enforcement and drug treatment and prevention people."

Byrne money doesn't just fund the task forces, Bushman pointed out, although he conceded that's where much of the money has gone. "Byrne money goes to all 50 states, and most of them used it for the multi-jurisdictional task forces. Here in Minnesota, we split it between task forces and offender reentry programs and drug courts."

While a answer to just how much Byrne money has gone to the task forces remains buried deep in the bowels of the Justice Department -- part of the problem is that the 50 states are awarded block grants and then decide at the state level how to allocate the funds, and some states are better than others at reporting back to Justice -- observers put a low-ball figure of at least 25% going to fund them, and possibly much higher.

The task forces are needed, said Bowman. "While we are never going to arrest our way out of this, I've seen too much of the damage done by drug abuse, and we need all the help we can get," he said. "Not just for policing, but also for treatment and prevention and drug courts. We need all three pillars, and the Byrne program helps with all three."

If law enforcement was pleased, that wasn't the case with civil rights, taxpayer, and drug reform groups. They said they were disappointed in the restoration of funding under the auspices of the economic stimulus bill, and vowed to continue to try to either cut or reform the program.

"We're working on a letter to Congress about the Byrne grants right now," said Lawanda Johnson, communications director for the Justice Policy Institute, one of the organizations that had signed on to the 2006 DPA letter. "The Byrne grant program is not an effective use of funds for preserving public safety or stimulating the economy. The only way you will get an economic boost from this is if you own stock in Corrections Corporation of America," she laughed, grimly.

"With so many smart people working on the budget and the stimulus package, you would think they would understand that the states are looking to reduce their prison populations and change those policies that have jailed so many people," said Johnson. "To then turn around and have the federal government invest $4 billion in more police and more grants seems paradoxical. It's just going to jack up the spending for states and localities, and they are already struggling."

"We oppose the wasteful economic stimulus bill and we oppose the inclusion of the Byrne grants in it," said Leslie Paige, spokesperson for Citizens Against Government Waste, one of the conservative taxpayer groups that has opposed the grants for the past several years. "If there is going to be government spending, the least you can do is make sure the money is going to have a long term positive impact on the economy."

"This is disappointing, but not surprising," said Bill Piper, national affairs director for the Drug Policy Alliance. "This reverses Bush's cuts in the program and restores funding at even higher levels. At the same time Congress and the Obama administration are expressing great concern about racial disparities and over-incarceration, they keep trying to fund this program, which will only stimulate more arrests of more nonviolent drug offenders," Piper noted.

"The Democrats are framing this as helping in these tough economic times, but the people who will be arrested will end up in state prison, and the states will have to pay for that," Piper pointed out. "The states may well end up paying more in the long run. It's far from clear that this will stimulate the economy, but what is clear is that it will stimulate the breaking up of families and decreasing productivity and tax revenues, especially in communities already devastated by the impact of over-incarceration."

Killing funding outright is unlikely, said Piper. "I don't think there's any way we can stop this from being included because the support for it is strong and bipartisan," he said. "No one wants to go up against the police. Our real hope is that later in the year we can put some restrictions on the program, which is what we've been working on. Instead of trying to cut it, we can try to use it to encourage state and local law enforcement to change how they operate. They're so addicted to federal funding that they may do just about anything, such as documenting arrests or having performance measures."

Bushman and the rest of law enforcement aren't resting easy just yet. "The funding has to survive hearings and make it into the final appropriation," he noted. "This is not a done deal yet."

But it looks like Congress is well on the way to funding three more years of Byrne grants at $1 billion a year, the highest level of funding in years. And don't forget the 13,000 new police officers to be funded for the next three years by the COPS program. If Congress and the cops have their way, we can look forward to more drug busts, more prosecutions, more people sentenced to prison, and a greater burden on already deficit-ridden state budgets.

The White House: Obama on Drug Policy

The incoming Obama administration has posted its agenda online at the White House web site Whitehouse.gov. While neither drug policy nor criminal justice merited its own category in the Obama agenda, several of the broad categories listed do contain references to drug and crime policy and provide a strong indication of the administration's proclivities.

But before getting into what the agenda mentions, it's worth noting what the agenda does not mention: marijuana. There is not a word about the nation's most widely used illicit drug or the nearly 900,000 arrests a year generated by marijuana prohibition. Nor, despite Obama campaign pledges, is there a word about medical marijuana or ending the DEA raids on providers in California -- which doesn't necessarily mean he will go back on his word. It could well be that the issue is seen as too marginal to be included in the broad agenda for national change. With the first raid on a medical marijuana clinic during the Obama administration hitting this very week, reformers are anxiously hoping it is only the work of Bush holdovers and not a signal about the future.

Reformers may find themselves pleased with some Obama positions, but they will be less happy with others. The Obama administration wants to reduce inequities in the criminal justice system, but it also taking thoroughly conventional positions on other drug policy issues.

But let's let them speak for themselves. Here are the relevant sections of the Obama agenda:

Under Civil Rights:

  • End Racial Profiling: President Obama and Vice President Biden will ban racial profiling by federal law enforcement agencies and provide federal incentives to state and local police departments to prohibit the practice.
  • Reduce Crime Recidivism by Providing Ex-Offender Support: President Obama and Vice President Biden will provide job training, substance abuse and mental health counseling to ex-offenders, so that they are successfully re-integrated into society. Obama and Biden will also create a prison-to-work incentive program to improve ex-offender employment and job retention rates.
  • Eliminate Sentencing Disparities: President Obama and Vice President Biden believe the disparity between sentencing crack and powder-based cocaine is wrong and should be completely eliminated.
  • Expand Use of Drug Courts: President Obama and Vice President Biden will give first-time, non-violent offenders a chance to serve their sentence, where appropriate, in the type of drug rehabilitation programs that have proven to work better than a prison term in changing bad behavior.
  • Promote AIDS Prevention: In the first year of his presidency, President Obama will develop and begin to implement a comprehensive national HIV/AIDS strategy that includes all federal agencies. The strategy will be designed to reduce HIV infections, increase access to care and reduce HIV-related health disparities. The President will support common sense approaches including age-appropriate sex education that includes information about contraception, combating infection within our prison population through education and contraception, and distributing contraceptives through our public health system. The President also supports lifting the federal ban on needle exchange, which could dramatically reduce rates of infection among drug users. President Obama has also been willing to confront the stigma -- too often tied to homophobia -- that continues to surround HIV/AIDS.

Under Foreign Policy:

  • Afghanistan: Obama and Biden will refocus American resources on the greatest threat to our security -- the resurgence of al Qaeda and the Taliban in Afghanistan and Pakistan. They will increase our troop levels in Afghanistan, press our allies in NATO to do the same, and dedicate more resources to revitalize Afghanistan's economic development. Obama and Biden will demand the Afghan government do more, including cracking down on corruption and the illicit opium trade.

Under Rural Issues:

  • Combat Methamphetamine: Continue the fight to rid our communities of meth and offer support to help addicts heal.

Under Urban Issues:

  • Support Local Law Enforcement: President Obama and Vice President Biden are committed to fully funding the COPS program to put 50,000 police officers on the street and help address police brutality and accountability issues in local communities. Obama and Biden also support efforts to encourage young people to enter the law enforcement profession, so that our local police departments are not understaffed because of a dearth of qualified applicants.
  • Reduce Crime Recidivism by Providing Ex-Offender Supports: America is facing an incarceration and post-incarceration crisis in urban communities. Obama and Biden will create a prison-to-work incentive program, modeled on the successful Welfare-to-Work Partnership, and work to reform correctional systems to break down barriers for ex-offenders to find employment.

Marijuana: Washington State Decriminalization Bill Filed

Three Democratic legislators -- state Reps. Jim Moeller, Dave Upthegrove, and Brendan Williams -- Wednesday introduced a bill to decriminalize possession of less than 40 grams of marijuana in the state of Washington. By day's end, the bill had additional nine cosponsors.

Under current Washington law, possession of up to 40 grams is a misdemeanor punishable by up to 90 days in jail. The penalty for pot possession also includes a mandatory minimum one-day jail sentence and $250 fine.

Although the city of Seattle pioneered the lowest law enforcement priority approach to adult marijuana possession offenses, the rest of the state has not followed suit. According to figures provided in a Seattle Stranger article by activist turned journalist Dominic Holden, there were some 11,553 people arrested on pot possession charges in 2007.

Holden quoted cosponsor Williams as saying he will make a budgetary argument for the bill. The state faces a $6 billion budget shortfall, and arresting, prosecuting, and jailing penny ante pot offenders costs the state nearly $7.5 million a year, he said, citing a study from the Washington Institute for Public Policy.

"We will frame it in terms of the tradeoff in the budget discussion and set a square alternative," Williams said. "Do you choose to provide health care for X number of children or fund criminalizing marijuana possession?"

If Washington were to pass a decriminalization bill, it would become the 13th state to do so. Most of the existing decrim states changed their laws in the 1970s, but Nevada voters chose decriminalization in 2002 and Massachusetts overwhelmingly supported it in November.
